PREPARE FOR DAY LONG MASS DHARNA ON 8TH DECEMBER 2010

 

            We hope all of you have been preparing for the Mass Dharna to be held in front of CGA office on 8th December 2010.

All Branches are requested to send fresh list of the persons who shall be coming to participate in the Dharna to the federation headquarters. As informed already, boarding and lodging of outstation participants shall be arranged by the federation headquarters while at Delhi. In order to do so, it is essential that the Federation Headquarters should have the informations about presence of actual number of participants well in time. Therefore, all are requested to send the list within 10th November 2010 preferably by e-mail.

All Branches and Units are requested to increase the number of participants by 20 % more than the number they had informed before the Dharna of 24th September 2010..

The Accommodation for stay of out station participants has been booked. It shall be "Chug Dharamsala, Udyan Marg, New Delhi -110001". The accommodation shall be available from 7th to 9th December 2010. All other conditions circulated through earlier circulars shall remain same.

Observe Campaign Fortnight

            Period between 8th and 19th November, 2010 may be observed as Campaign fortnight. Since the tour programme circulated through the earlier circulars is yet to be implemented, Regional co-ordinators are requested to finalize the names of the persons and dates for the visits to different stations immediately after the receipt of this circular.  Tour programme should preferably be conducted during the campaign fortnight.

Further, all Branches are requested to organize unit/area wise lunch hour meeting/demonstration etc. during the campaign fortnight and popularize the 16 point charter of demands among the rank and file membership.

PROTEST AGAINST

REFUSAL TO GRANT HONORARIUM

            After implementation of recommendations of every Pay Commission, different categories of Civil Accounts Employees were granted honorarium by CGA at fixed rates for checking of pay fixation cases and revision of pension cases. Since the Defence Accounts Department has already issued the orders granting honorarium to different categories of its employees and officers  after implementation 6CPC recommendations, we had requested CGA vide our letters dated 31st July 2009 and 21st July 2010 to grant honorarium to different categories of staff and officers like previous occasions at the following rates -

 But the CGA vide its letter dated 1st October 2010 informed Central Headquarters of AICAEA that the Jt.CGA (Gr.-B) has not acceded to the request of grant of honorarium to the officers and staff for the extra labor they have been rendering in checking the pay fixation cases and revision of pension cases.

            Present Jt. CGA being one of the most unreasonable and anti-employee officers is out to snatch away the benefits we had achieved through our long struggle. We can not afford to remain as a silent spectator to such a situation.

It has therefore been decided that, Central Headquarters of AICAEA and AICAEA CAT II shall write letter to CGA and all Units shall forward following Resolution to the Controller General of Accounts demanding grant of incentive for checking of pay fixation cases and revision of pension cases immediately after the receipt of this circular.

RESOLUTION

This joint meeting of the members of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category II working in the PAO/ZAO_____________________ held to day the            November 2010 expresses its deep anguish and protest against refusal to concede the request of the Association by  the CGA authorities for granting honorarium at fixed rates to  different categories of employees and officers for checking of pay fixation cases and revision of pension cases after implementation of the 6th CPC recommendations.

The request made by the All India Civil Accounts Employees Association was not a new demand. After implementation of recommendations of every Pay Commission, CGA had granted incentives to Civil Accounts Employees and officers for the extra burden of workload they had shouldered.

The meeting therefore, urges upon the Controller General of Accounts to intervene into the matter personally and take an early favorable decision at the earliest.

The meeting resolves to forward the copy of the Resolution adopted to the Controller General of Accounts, Ministry of Finance Department of Expenditure, New Delhi and the Secretary General, National Federation of Civil Accounts Associations, New Delhi.

   We would like to refer your office letter No: - A-11019/25/2009/MF.CGA(A)/NGE/AICAEA-HQ/756 dated September 20, 2010 on the above mentioned subject and state that, as per the directive of our Central Working Committee meetings held at Shillong on 11th & 12th June 2010, we had requested you through our letters dated 4th July 2010 to kindly initiate dialogue on the 16 point charter of demands on 6 CPC related issues and long pending demands which are linked with the effective functioning of Civil Accounts Organization.

 

            But it appears from the above referred letter of your office that the Civil Accounts authorities are having no concern about the discriminatory treatment given to the Employees and Officers of Civil Accounts Organization while implementing the 6 CPC recommendations or resolving the problem of improvement in functioning of the Organization.

 

            We however, once again request you to review the stand taken by your office and convene meetings with the National Executives of both Associations at your earliest convenience.

 

            We would also like to inform you that, if we do not get any favorable response from your end, the decision conveyed by us through our letter dated 23rd September 2010 shall stand and we shall be forced to hold day long dharna in front of your Office on 8th December 2010.

Subject: One day strike on 7th September, 2010

 

Sir,

 Kindly refer to the OM. No.A-12017/1/2010/ MF.CGA(A)/NGE/Asso-Agi/781  dated 15-09-2010 of your office on the subject of one day strike on 7th September 2010. Instead of issuing instructions in respect of strike on 7th September 2010, your office has referred one day Dharna on 24/09/2010 in front of your office (intimation for which was given by us on 09/09/2010).

         

          We have therefore to presume that, these instructions were not meant to curb the Dharna on 24th September 2010. If however, your office had issued these instructions applicable in respect of Dharna; we have the following submission to make-

         

          Rule 7 (1) of CCS (conduct) Rules only prohibits such Dharnas which are against the security of a state/county and certain other purposes specified in the said rule. This provision in no way prohibits any democratic method of demonstrative protest including Dharna if organized by any Association or any other forum in order to manifest its protest/discontent on the anti-employee approach/ decisions and actions or inactions in respect of the employees by the authorities. We had decided to sit for Dharna to record our protest against not initiating discussions to settle our long pending demands as well as the discriminatory treatment given to in different categories of Civil Accounts Employees and Officers at the time of implementing the 6CPC recommendations by your office and the Government of India altogether.  This right of ours which come under fundamental right of freedom of expression has been sought to be curbed by blending it as an action in the nature of strike ignoring the fact that, even the Parliamentarians of this country are organizing Dharna in front of the Parliament house to register their protest against various issues and decisions of the Government.

         

          The instructions issued under the above OM of your office are ultra vires of constitution and therefore illegal.

 

          We therefore, request you to direct your office to withdraw the said OM.

 

          We hope, you will consider these submissions with a positive attitude and do the needful.

         

          We would also like to request  that, you may kindly' meet the representatives of the AICAEA and AICAEA CAT II for discussion and settlement of 16 point demands whereby the harmonious relations between you and the employees organizations are established and nurtured.

Subject: One day Dharna on 24th September, 2010 – regarding

 

Reference:- Your Office circular No. Pr. AO (A)/General/ 2010-11/367 dated 16th September, 2010

 

Sir,

 

          We are shocked to go through the contents of the above circular of your office whereby the instructions issued by the CGA regarding the 7th September 2010 strike have been made applicable by your office against one day Dharna on 24th September 2010. In terms of Rule 7(1) of the CCS (conduct) Rules, demonstrative action in the form of Dharna is not misconduct. Even in the definition given under Rule 7(2), Dharna has not been included as a form of a strike. The honorable Parliamentarians of this country are often resorting to Dharna in protest against the decisions of the Government.

 

          In these circumstances, on what authority or rule your office has treated Dharna as a misconduct and thereby decided to resort to punitive actions like not permitting casual leave and will be treated as unauthorized absence etc could not be understood.

 

          I therefore, request you to direct the administration of your office to take back such provocative and illegal instructions which have been issued by it. None of the Civil Accounts authorities other than your office has issued such instructions. It is apparent that, your administration has over reacted which portray its intolerant attitude towards the causes of the employees and Association activities. We plead with you to direct your administration to change such negative attitude and co-operate with the Association.
