 AICAEA, PAO, Ministry of Health & Family Welfare Unit, Kolkata organised three days Dharna from 21st to 23rd January2015 on the demand of filling up of vacant posts and grant of pay as per the rate prescribed by the Ministry of Labour to those Data Entry Operators who have been engaged through contractor. Data Entry Operators are not only getting less pay but also lesser than their counterparts working in the Ministry of Health & Family Welfare itself.

With profound sorrow, we would like to inform all that Com. I. S. Biltoria, ex-Additional Secretary General, All India Civil Accounts Employees Association and ex-Branch Secretary, All India Civil Accounts Employees Association, Delhi Branch expired on 10th January 2015. He had retired from service in the year 1998. He was suffering from various age related ailments.  

A Condolence meeting was organised by the NFCAA headquarters in the Central Office of the AICAEA, New Delhi on 23rd January 2015. Com. S. Bandyopadhyay, ex- Finance Secretary and Permanent invitee presided over the Meeting.

Save BSNL Campaign – extend support & build up public opinion.

Dear Comrades,

            BSNL, the telecom PSU, fully owned by the government, is facing serious difficulties both financially as well as in providing a satisfactory service to the customers.

            BSNL, though being the market leader both in landlines and Broadband, is far below major private telecom operators, with only less than 10% of market share. The Company is in loss for the last 4 years, with an accumulated loss of about Rs. 28,000/- crores, though in the first seven years, it had earned more than Rs. 48,000/- crores as profit.

            The loss of market share and also poor service have been mainly due to the non-procurement of essential mobile equipment, broadband modem, cables, dropwire, telephone instrument, towers etc. BSNL though granted licence for mobile connections only in 2002, after 7 years of the same granted to private companies, forged ahead with positive growth and became the second biggest mobile connection provider and was almost going to became number one. But the Central Government denied its permission to purchase mobile and other equipments and ensured that no development and expansion takes place in order to allow the private players to move ahead.

            The Government went back from all its promises to financially assist BSNL for its loss making connections in rural areas, which was socially necessary for universal service. Further the government in rural areas, which was socially necessary for universal service. Further the government took away the more than Rs. 40,000/- crores of surplus cash balance with BSNL on one plea or another putting BSNL unable to purchase equipment to expand and develop.

            The inefficiency of BSNL top management, who do not belong to BSNL and are mainly ITS (Indian Telecom Service) officers on deputation from Government has worsened the situation. Many of them are influenced by the private telecom companies, resulting in a precarious situation.

            The Forum of BSNL Unions/Associations have been taking up all these issues both with the Government and BSNL Management. The BSNL workers went on a one day successful strike on 11th July, 2007, only on the demand of procuring mobile connections and developmental issues, which resulted in some temporary results. Both the earlier UPA and the present NDA government are continuously taking pro-private and anti- BSNL decisions making BSNL financially unviable and crippling its services.

            The Forum of BSNL Unions & Associations of Non-Executives and Executives had organized several agitational programmes to pressurize government and Management to take suitable decisions for the Revival of Bonus. Since there is no response, the Forum has decided further programme of agitation as follows:-

(1)   3 days Dharna at all SSA Offices (District) Circle Offices (State) capitals and at BSNL Corporate Office, New Delhi from 6th to 8th January, 2015.
(2)   A Parliament March by thousands of BSNL workers on 25th February, 2015.
(3)   Indefinite Strike from 17th March, 2015.

            It is also decided to submit a Memorandum signed by more than one crore people and employees to the Prime Minister on the day of the Parliament March with demands for taking necessary measures for Revival of BSNL. A massive SAVE BSNL Campaign is also being organized.

            The forum of BSNL Union/Association, New Delhi has sought support and solidarity in the SAVE BSNL Campaign and the programmes of action. You are requested to extend support to the SAVE BSNL Campaign being organized by BSNL Unions/Associations.

Subject:- Request for convening meeting with the National Executives of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category – II.

Sir,

            A meeting between the official side of CGA office and the National Executive members of the All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category-II was held on 17th July 2014. But, it is more than six months majority of the issues discussed in that meeting have not yet been settled. Moreover, a few items have been recorded as closed by the official side unilaterally while issuing the minutes of the meeting.

            The apex level policy formulating forum of both the Associations undertook a thorough review of the items discussed in the above referred meeting and thereafter, directed me to request you to convene a meeting with the representatives of the Associations atleast within the last week of February 2015 for review of the status of the items discussed in earlier meeting and discussion of fresh items and their settlement too.

            As some of the items discussed earlier have undergone change due to change in the situations, the issues we propose to discuss in the meeting are being submitted shortly.

Subject:- Injustice to newly recruited Accountant in respect of 1st increment of service life – Request for redressal regarding.

Sir,

            I am directed to draw your kind attention to the fact that the newly recruited Accountants are allowed 1st increment of his service career from 1st day of July in any year that comes after passing of his departmental confirmatory Examination though they may otherwise eligible for such increment on the 1st day of July of the previous year. As illustration it can be said that if an Accountant joins in November – 2013, the present systems of examination etc. makes him eligible to sit for Departmental Confirmatory Examination only in the beginning of the year of 2014. This results his increment w.e.f. 1st July 2014 i.e. after 17/18 month from his date of joining service. This is grossly against sprit of all ideas related to such Confirmatory Examination and highly demoralizing.

            Under such circumstances, I would request you to issue orders to effect the increment retrospectively i.e. from the 1st day of July that comes immediately after joining of six month of a newly recruited Accountant who qualified the Department Confirmatory Examination.

Subject:- Clarification with regard to 2nd ACP to Senior Accountants of CCAS cadre appointed as Accountant on the basis of Limited Departmental Competitive Examination.

Ref:- O.M. No. A-11019/25/05/MF.CGA (A)/NGE/AICAEA-HQ/289 dated 27.10.2014 issued by the office of CGA.

Sir,

            I have been directed to refer to the above and  draw your kind attention to the following few lines in the matter of grant of IInd financial  upgradation under ACPs to those who were appointed as Junior Accountants on the basis of the results of Departmental Competitive Examination conducted by the SSC during the years 1981 & 1982-
1.      The candidates who had qualified the Departmental Competitive Examination for the posts of Junior Accountants conducted by the Staff Selection Commission during the year 1981 & 1982 against direct recruitment quota of different departments of Civil Accounts Organization are required to be equated with the Junior Accountants who were directly recruited through the examination conducted by the Staff Selection Commission for recruitment to the post of Junior Accountant as the standard and method of both the examinations were similar at that point of time.
2.      Clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol-IV dated 10th February 2000 states that, if relevant Recruitment Rules provide for filling up of vacancies by direct recruitment, induction of a person from lower grade in the next grade through Limited Departmental Competitive examination may be treated as direct recruitment for the purpose of ACPs.  In such cases, service rendered in a lower pay scale shall not be counted for the purpose of benefit under ACPs. Not only this, the said order nowhere states that the benefit under ACPs shall be limited to those incumbents only where there is a change of their cadre/service.
3.      The CCAs (Group – C) Recruitment Rules provides for filling up of vacancies in the grade of Accountant through direct recruitment and it fulfills the requirements stated in the clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol – IV dated 10th February 2000.
4.      The scheme of granting ACP was introduced in the year 1998-1999, whereas the officials who have qualified the departmental competitive examination prior to the issuance of the DOPT orders should in no way be deprived of this benefit. In fact, the clarification was specifically meant for such officials only.
5.      The benefit of the scheme has already been implemented in CGA’s organizations itself. Examples are as below:-
i)        CBEC: - Pr. CCA, CBEC, New Delhi vide order No. Admn.1 (17) 9/ACP Scheme/770 office order No. 164 dated 14.08.2007 granted IInd financial upgradation with effect from 01.04.2007 to Shri A.J. Kulkarni (PAO, CEX, Pune). He had qualified the departmental competitive examination conducted by the SSC in the year 1981.
ii)      CBDT: - Pr. CBDT, New Delhi office order No. Admn.ii/5-23/ACP/Sr.Acctt/2005-06/486 dated 16/23.03.2007 granted IInd financial upgradation with effect from 06/08.07.2007 to Shri S.N. Kaulgud, ZAO, CBDT, Pune. He had qualified the departmental competitive examination conducted by the SSC in the year 1982. Incidentally, it may be placed for your information and record that Shri S.N. Kaulgud of PAO, CBDT (Roll No – 018 rank No.-11) was granted 2nd ACP but Shri Subhash Chander Bamrara (Roll No. 010 rank No.-6) at present working under CCA, Ministry of External Affairs, New Delhi has been deprived of the same benefit while both of them had qualified the same examination in the year 1982.
iii)    Min. Home Affairs: - Though there is no specific example readily available with us, but many employees of Ministry of Home Affairs were also extended the said benefit by the then Heads of The Departments.
Decisions by all the heads of the Departments had been taken with the concurrence of the Controller General of Account. There may be many others who might have been accorded the benefit of 2nd ACP and as on record only a handful of employees have been kept out of the benefit at present.
            Therefore, on behalf of this Association, I seek your personal intervention into the matter and requests you to kindly take a favorable decision of extending the benefit to the left out and deprived section of employees as a onetime measure so that they could be able to get rid of the feelings of discrimination they have been suffering from due to non-receipt of their legitimately due benefit on par with their batch mates.
            For a kind and early favourable decision of yours, this Association shall be highly thankful to you.
