Dear Comrades,

 

MEETING WITH MINISTER OF STATE FOR FINANCE

        As informed already, a delegation Comprising Com. S. K. Vyas, Com. M. S. Raja, Chairman, Com. V. Bhattacharjee, Convener apex JAC and Com. A. K. Mehta, Convener, local JAC, Delhi met Shri Nomonarain Meena, Minister of State for Ministry of Finance on 18th January 2010. This appointment materialised subsequent to the letter sent to him by apex JAC on 14/12/2009 (copy Circulated through earlier Circular).

 

      The delegation requested Hon'ble Minister to implement the arbitration award dated 24/08/2004 on grant of higher Pay Scales to the Accounts and Audit Employees with effect from 01/01/1986. The delegation also explained that the Govt. had restored parity between the Central Secretariat Assistants and Sr. Accountant/Auditors after the 4th CPC. However, Govt. had upgraded the Pay Scale of Assistants of Central Secretariat unilaterally in 1990 retrospectively from 01/01/1986 denying the same to Sr. Accounts and Sr. Auditors. The parity between the Central Secretariat Assistants and Sr. Accountant/Auditors was however partially restored by granting it with effect from 01/01/1996 through an order in 2003. Subsequently the Board of arbitration had awarded that the party between the Central Secretariat Assistants and Sr. Accountant/Auditor should be restored w. e. f. 01/01/1986. In the negotiation on the award subsequently, Department of Expenditure had taken the position that, since there would be involvement of expenditure to tune of Rs. 625 crores for payment of arrears, govt. can not afford to implement the award. Appreciating the financial burden of the government, staff side had offered in writing to forgo the arrears and requested to grant the notional fixation benefit with effect from 01/01/1986 without any arrears. But the Department of Expenditure has not responded to this request favorably.

 

     The delegation, requested the H'ble Minister to kindly consider the proposal of staff side and take an early favorable decision in this respect. Responding to the request of the delegation, H'ble Minister informed that he has already received the letter of apex JAC inthis respect and directed his office to call for the informations from Expenditure Department.

 

COM. BASUDEV ACHARIA WROTE TO P. M.

     Through the Circular No:- 7/2009 dated 31/08/2009 we had Circulated the letter we had written to the Prime Minister and the Finance Minister urging upon them to implement the arbitration award notionally from 01.01.1986/01.011996 and actually from 01/01/2006.

 

     We had also requested Com. Basudev Acharia, MP for his intervention. Com. Acharia has taken up the meter with the Prime Minister. Copy the letter of Com. Basudev Acharia is furnished here under.

 

APEX J.A.C. MEETING AT JAIPUR

    In Continuation the Circular No: - 1/2010 dated 14/01/2009, it is hereby informed that the meeting of the apex JAC shall be held at Jaipur on 1st February 2010 5.P.M. The meeting shall be held at the venue of the Conference of All India Audit & Accounts Association ie in AG Colony, Jaipur near Gandhi Nagar Rly Station.   

 

   Following shall the agenda for the meeting-----

 

  1. Review of the decisions taken in the meeting held on 8th December 2009
  2. Finalisation of date for Industrial action.
  3. Any other matter with the permission of Chairman.

         Please find the enclosed representation received from Shri V. Bhattacharjee, Convener, Joint Action Committee of Audit & Accounts & Employees & Officers Organization regarding "implementation of Award of the Board of Arbitration JCM in CAR No. 3/2001 on the grant of higher Pay Scales to staff of IA&AD and organizes Accounts at par with the Pay Scales of the Assistants of the Central Secretariat.

 

        The matter was discussed, during meeting with Additional Secretary, Department of Expenditure and Department of Personal and Training and it was proposed by the staff, that the actual payment of arrears on accounts of implementation of award may be paid with effect from 19th February 2003 instead of 12/11/2001 as per the award. The JAC had also proposed through its letter dated 2nd December 2008 to forego all the arrears and stated that the award may be implement notionally from 01.01.1986/01.01.1996 and actually from 01.01.2006, the date from which the higher Pay Scales have been granted as per the 6th CPC recommendations. But till the date no action has been taken in this regard.

 

       I request you to kindly go through their genuine appeal and issue necessary instruction to the concerned so that higher pay scale awarded by the Board of Arbitration may now be granted at the earliest.

Sir,

            The 6th Central Pay Commission did not do justice to Accounts and Audit Employees and while implementing the recommendations of 6th Central Pay Commission, Government of India did not also take any favorable action to remove the injustice done by the Pay Commission. The Accounts and Audit employees have been consistently requesting the Government of India to resolve the grievances of the Accounts and Audit Employees regarding their pay scale related issues. But the Government has created further disparity between the Accounts &Audit cadres and the Cadres in Central Secretariat by upgrading the pay scales of Central Secretariat cadres. 

 

            Also, there are various other issues –enclosed herewith- that are pending for long without resolution. The employees and officers of IA&AD and Organised Accounts are agitated over the non upgradation of pay scales of Audit & Accounts Cadres at par with CSS and also over the inaction on other long pending grievances.

 

            It is therefore requested that, appropriate action for negotiated settlement of all the demands may kindly be taken at an early date.

OBSERVE DEMANDS DAY ON 21ST JANUARY, 2010

 

      The apex JAC Circular No: - JAC/Circular – 01/2010 dated 14/01/2010 containing the details of the developments in annexed herewith.

 

     The direction for observing Demands day on 21st January 2010 has been furnished in the Circular.  You are requested to observe Demands day without fail by following guide lines   

 

1.           Contact local JAC leadership for uniformity in implementation of the programme

or

2.           Organise Branch level Joint lunch hour meeting/demonstration of AICAEA & AICAEA Cat – II in front of the senior most officer of the station.

 

3.           Submit the letter containing the Charter of Demands (JAC and Departmental) under the joint signatures of the representatives of AICAEA & AICAEA Cat – II to seniormost officer of the station through a delegation (draft which is annexed to this Circular) and endorse its copies to all heads of the offices/departments falling under the Branch, local JACs, Federation of Headquarters and apex JAC headquarter. 

 

 

VISIT TO STATIONS

 

             As per the tour programme circulated under the NFCAA Circular No: - Cir 11 of 14/12/2009, Com. V. Bhattacharjee, Secretary General visited Kolkata and Guwahati. Rest of the Federal Executive members shall move to their assigned stations within a week's time. Branch and Unit Secretaries of the station being visited are requested to contact the visiting leaders to ensure that the visits of the representatives become purposeful and members are motivated for the industrial action without any hesitation.

  

            Since no visit to Units has so far been initiated in Delhi as per the direction given through the above circular, Delhi Branch is requested to expedite its action.

            Under the previous circular, all Branches were requested to furnish the report of preparation in the following proforma within 25th January 2010.

Dear Comrades,

 

            At the very outset, wish you all a very happy and prosperous New Year 2010.

 

            Hope the Campaign Week Programme from 4th to 8th January 2010 has been implemented by all branches of every Constituent of JAC exhorting the members for industrial action to achieve the demands. A detailed report on the campaign week may please be sent to apex JAC headquarter immediately.

 

            As per the decisions taken in the last meeting of apex JAC held on 8th December, 2009, Com.M.S.Raja, Chairman visited Mumbai and Bangalore. In Mumbai, no meeting of JAC was arranged as the major Constituent organisation was busy with its own organisational affairs. In Bangalore, a well attended JAC meeting was held on 4th January 2009.  The Bangalore meeting was attended by the units of All India Audit & Accounts Association and All India Audit & Accounts officers Association and All India Postal Accounts Employees Association. The representative of AICAEA could not attend the meeting due to some communication gap.

 

            Com. V. Bhattacharjee, Convener visited Kolkata and Guwahati. In Kolkata a joint meeting of constituents of local JAC was held on 21st December, 2009 under the Chairpersonship of Com. Ashim Kr. Bhattacharjee, President, AICAEA, West Bengal Branch. Representatives of Civil Accounts( Category II &III), Audit and Accounts (Commercial Audit, AG(A&E) West Bengal, P&T Audit, Scientific Audit, Railway Audit, Pr Director of Audit Central and Defence Audit) Defence Accounts, Railway Accounts and Postal Accounts participated in the meeting. This meeting unanimously took the decision of reviving the local JAC by convening a meeting of all constituents on 12th January 2010.

                            

            Convener had a meeting with leaders of All India Defence Accounts Employees Association. The leadership of All India Defence Accounts Employees Association assured that they would co-operate with Apex JAC in all future activities. Com. G.P.Dutta, Secretary General, All India Defence Accounts Employees Association (Hq.Kolkata) attended the meeting of local JAC meeting. He assured the house that, his Association shall continue to be the integral part of the JAC and implement all decisions of JAC.   He further assured that, he being one of the leaders of the apex JAC shall participate in all meetings in future.

 

            The local JAC, Guwahati organized a meeting of its constituents on 31st December, 2009 under the Chairpersonship of Com. B. P. Bhattacharjee, ex-Secretary General of AIA&A Association. Representatives of Audit and Accounts, Civil Accounts, Railway Accounts and Postal Accounts attended the meeting. Local JAC of Guwahati was re-constituted in this meeting wherein Com. S. K. Dutta, (Civil Accounts) and Com. G. K. Gohain (Audit Accounts) have been elected as Chairman and Convener respectively. Since no communication was received from Shillong, Com. V. Bhattacharjee, Convener, apex JAC, could not visit the station and he requested the newly elected JAC leadership of Guwahati and other available National leaders of constituents of apex JAC stationed at Guwahati to visit Shillong jointly at the earliest and take effort of reviving the local JAC there.

  

            OBSERVE DEMANDS DAY ON 21ST JANUARY, 2010

            As per the decision of the last apex JAC meeting, call was given for observing Demands Day on 21st January, 2010 by holding massive lunch hour demonstration and submitting the charter to demands to the authorities in all the field offices of all the JAC Constituents.

 

1.      Apex JAC shall submit the Charter of Demands to the Prime Minister, the Finance Minister, the Cabinet Secretary and the Expenditure Secretary.

2.      All constituents of apex JAC are to submit the Charter of Demands to their Departmental Heads and direct their Units and Branches to hold demonstration in front of the offices of their local heads and submit the Charter of demands through a mass deputation.

3.      The Charter of demands may include the demands formulated by apex JAC along with sectional demands.

 

LETTER TO MINISTER

            Apex JAC had issued a letter to Shri Nomo Narain, Minister of State for Ministry of Finance to intervene and persuade the Department and Expenditure to implement the Arbitration dated 24/08/2004 in regard to Pay Scale of Senior Auditors/Senior Accountants & Accounts Assistants of Railways notionally for the entire period of 01/01/86 to 31/12/05 and actually with effect from 01/01/06.

 

            The Minister incharge has invited the representatives of JAC for a discussion on 18th January, 2010. Available apex JAC leaders shall attend the meeting.

 

APEX JAC MEETING AT JAIPUR ON 1ST FEBRUARY

            It has been decided that the representatives of apex JAC shall meet at Jaipur on 1st February, 2010 as per the decision taken in the earlier meeting. This meeting shall take the stock of the situation and finalize the date for the united Industrial action of the Accounts and Audit Employees and Officers in the month of March, 2010. All constituents are therefore requested to attend the meeting positively. Time and venue of the meeting shall be informed to all concerned separately.

Accounts & Audit Employees & Officers Organisations letter Reference: JAC/FM/2009/11 dated 14th Dec. 2009 to Shri Nomo Narain, Minister of State Ministry of Finance,

 

Sir,

                                                   

           Respectfully we invite your kind attention to the award given by the Board of Arbitration on 24/08/2004 in regard to Pay Scale of Senior Auditors/Senior Accountants & Accounts Assistants of Railways:-

 

           "The Government is directed to upgrade Pay Scale same as to the Assistants of Central Secretariat services of Rs: 1640-2900 (Rupees 5500-9000 with effect from 01/01/96) to all Senior Auditors/Senior Accountants & Accounts Assistants of Railways with effect from 01/01/86 notionally and actual payment from 12/11/01 the date of reference of arbitration to the Board" 

 

          As per the instructions given by the Committee of Secretaries, the above award should have been implemented or referred to the Parliament for modification/rejection within a period of six months ending on 24/02/05. However, it has not so far been implemented.

 

           The matter was discussed in the Committee of National Council J. C. M. The official side contented that more than 1200 Crores would have to be paid by way of arrears if the award was implemented actually from 12/11/01 which the Government cannot afford. The staffside then suggested that actual payment may be from 19.02.03, the date from which Government have already ordered to upgrade the pay scale i. e. notionally w.e.f 01/01/96 actually from the above date. The officials stated that even then the amount of arrear to be paid would be Rs. 675 crores which is not feasible.

                   

          The staff representatives have been therefore, given in writing to forego all arrears and requested that the award may be implemented for the entire period from 01/01/1986 to 31/12/2005 notionally & actually from 01/01/06. Since accepting the recommendations of VICPC, Government have already upgraded the pay scale of these employees to pre-revised pay scale of Rs 6500-10500 Pay Band PB-2 with grade Pay of Rs 4200, there would be no extra liability for the Government.

 

           The matter is however kept pending for last 3years in the Department of Expenditure.

 

          We, therefore request you to intervene and persuade the Department and Expenditure to implement the award notionally for the entire period of 01/01/86 to 31/12/05 as it has been implemented with effect from 01/01/06.

 

          The entire fraternity of employees of IA & AD and Organized Accounts Establishments will be grateful to you for this intervention and settlement of long pending demand.

1.    Implement arbitration award by granting higher pay scale notionally w.e.f.1-1-1986 and effectively w.e.f 1-1-2006.

2.   upgrade LDCs by re-designating them as Acctts/Audit Assistants and following pay sales to different cadres-

Accountant/Auditor/ Steno Gr.II                        PB-2 with Grade Pay Rs.4200

Sr. Accountant/Auditor/ Steno Gr.I                    PB-2 with Grade Pay Rs.4600

                                                            PB-3 with Grade Pay Rs.5400

                                                            On completion of 4 years.

3.    Grant ACP on departmental hierarchy basis.

4.     Grant one increment and Grade pay of Rs.4800 from the day of passing JAO/SOG examination.

5.    Grant three increments on passing departmental confirmatory examination.

6.     Step up pay of Senior Promotees who exhausted ACP in the event of junior drawing more pay and getting ACP in compliance with apex court judgment.

7.      Grant recognition to Railway Accounts Staff Association.
