Subject: - Settlement of the long pending issues and appropriate recommendations on 7^th CPC related matters- regarding

Sir,

            We have been directed to refer our letter No: AICAEA/HQ/A-2/2016/417 dated 17^th April, 2016 on the subject mentioned above and state that the employees are totally aggrieved for non-settlement of their grievances for more than one and a half years.

            Moreover, large numbers of the issues that were discussed in the meeting held between the official side of CGA office and the National Executive of All India Civil Accounts employees Association under your Chairpersonship on 6^th November 2015 are yet to be settled. Further, it was stated in the said meeting that the

“Ministry of Finance, Department of Expenditure has returned the Cadre Review proposal of Group ‘B’ & ‘C’ cadres of CCAS with the remarks that proposal may be re-examined in terms of instructions contained in their O.M. NO. 5(3)/E.III/97 dated 07.01.1999 and No. 7(1)/E.Coord/2014 dated 29.10.2014. DoE has also informed that the revision of pay in respect of Civil Accounts Employees will not be done in isolation and the same may be viewed and examined in the larger context of Organized Accounts Service as a whole. Therefore, the matter will be examined by DoE, MoF, in a holistic manner keeping in view the recommendations of 7^th Pay Commission as well. The Association was therefore asked to wait for the 7^th Pay Commission recommendation and the decision of the Government.”

            But, we would like to bring the following facts to your kind information -

1.            Pending implementation of 7CPC recommendations, the Ministry of Finance has accorded approval to the Cadre Review proposals of the Department of Posts.

2.            The C&AG has made his recommendations to the Government for cadre review/ cadre restructuring/ amendments in the Recruitment Rules.

            Hence, in view of these facts and as per the DOPT instructions, cadre review of the Gr. B & C employees of Civil Accounts Employees, which should have been done much earlier and before the cadre review of the Gr “A” cadres of Civil Accounts organization was done in 2012-13, needs to be initiated immediately in consultation with the Associations.

            Apart from the above, the employees and officers of Civil Accounts organization are yet to learn about the recommendations given by the Controller General of Accounts to the Empowered Committee constituted by the Government for implementing the recommendations of 7CPC.

            Therefore, for the purpose of review of the status of the issues discussed on 6^th November 20159 (including the issue of Cadre Review) and to be appraised about the recommendations given by the Controller General of Accounts to the Empowered Committee constituted, our National Executive Members wish to meet you on 10^th June 2016. We shall be thankful if you kindly accept our proposal and make it convenient to meet us on the proposed date. Time of the meeting may kindly be intimated to us at an early date please.

            It may kindly be noted that the issues for discussion in the meeting will be the items forwarded by us through our letter dated 17^th April, 2016.

Subject:- “Grant of two financial up gradations to the higher grade pay of Rs.1900/- and 2800/- respectively under ACP scheme to those  MTS who had completed 12/24 years of service before  implementation of MACP Scheme” – item No:- 13 of the meeting held on 6^th November, 2015 between CGA authorities and National Executive of AICAEA.

Reference:- This Association’s letter No:- AICAEA/HQ/A-2/2015/2657 dated 03.12.2015.

Sir,

            In pursuance of our above referred letter, we would like to bring it to your kind information that the clarifications issued by the office of the Controller and Auditor General of India vide letter No: - 708-staff hak 1/254-2014 dated 04.06.2015 in the matter of implementation of ACP/MACP Scheme is as stated below-

“        …………. that the revised pay structure after obtaining on job training the non-matriculate MTS have  been placed in PB0-1with Grade Pay of Rs.1800/-i.e. equivalent to the matriculate MTS as on 01.01.2006. Hence, on job training to non-matriculate MTS place them at par with Matriculate MTS w.e.f 01.01.2006.

2.            Further, the promotions earned/financial upgradation(s) earned under ACP scheme in past to those post(s)which now carry the same Grade Pay of Rs.1800/- due to merger of post(s)recommended by 6^th CPC are to be ignored for the purpose of grant of financial up gradation under ACP/MACP Scheme. Hence, on completion of 12/24 years of service between  01.01.2006 and 31.08.2008 such MTS are eligible for consideration of 1^st and 2^nd financial up gradation under ACP Scheme  to higher grade pay of Rs.1900/- and 2800/-  respectively  subject to fulfillment of required condition under par 6 below Annexure-I to DOPT’s OM No.35034/1/97-Estt.(D)dated 09-08-1999. Also in case such MTS are granted 2^nd financial up gradation to the grade pay of Rs. 2800/- under ACP Scheme, they shall be eligible for 3^rd financial up gradation under MACP Scheme on completion of 30 years of service on or after 01.09.2008.”

            The MTS working in Civil Accounts Organization are also similarly placed and they are entitled to the same benefit.

            Therefore, on behalf of this Association, I request you to kindly issue the orders at the earliest for granting the benefit of two financial up gradations to the higher grade pay of Rs.1900/- and 2800/- respectively under ACP scheme to those MTS of Civil Accounts Organization who had completed 12/24 years of service before  implementation of MACP Scheme.

            A copy of the aforementioned letter of the office of the Controller and Auditor General of India is enclosed herewith for your ready reference.

CONFEDERATION CIRCULAR DATED - 27.04.2016

1.     CONFEDERATION ALL INDIA CONFERENCE PRE-PONED TO 2016 AUGUST16^TH,17^TH&18^TH

Diamond Jubilee year National Conference of the Confederation of Central government Employees & Workers will be held at Chennai on  16^th, 17^th & 18^th  August 2016. Confederation was formed on 16.08.1956. The conference is preponed from 26^th, 27^th & 28^th August to 16^th, 17^th & 18^th, as the All India general Strike is on 2^nd September 2016. The above dates are final. Notice for the National Conference will be issued shortly.

All India women’s convention of the confederation will also be held along with the National Conference.

All affiliated organisations of the Confederation, All

C-O-C’s and all CHQ office bearers and Women’s subcommittee members are requested to decide the names of Delegates/Visitors attending National Conference and  All India Women’s convention, well in advance and book their up and down travel tickets without any delay. Last minute, it will be very diffi-cult to get confirmed tickets.

2. CELEBRATE DIAMOND JUBILEE OF CONFEDERATION IN ALL STATES BY THE C-O-Cs IN A BEFITTING MANNER BY ORGANIZING AT LEAST ONE PROGRAMME BY EACH C-O-C.

Confederation was formed in the year 1956. The idea was mooted by Com. B N Ghosh, then Secretary General of NFPTE. There were many demands of the Central government Employees which were of a general nature concerning all the Central Government Employees. It was felt by Com B N Ghosh that an organization of all Central Government Employees is required for wider unity and struggle. As such he approached all the Unions and Federations in the central government establishments. Railway and defense federations did not show much interest. However other central government employees organisations showed much enthusiasm.

A joint meeting of all the willing Unions/Federations was held at New Delhi on 16^th August 1956 presided

by Shri Sarangdhar Das, Member of Parliament. Detailed discussion took place and “Confederation of Central Government Employees & Workers” was formed. Nath Pai, Member of Parliament, was elected as Chairman and S Madhusoodhanan of Civil Aviation was elected as Secretary General. Rest is history. In the formation meeting on 16^th August 1956 only ten organizations participated. The number of affiliates went on increasing year by year and as on date Confederation is having 112 affiliated organizations.

All the C-O-Cs are requested to celebrate the diamond jubilee in most befitting manner by organizing at least one program by each C-O-C. Senior leaders may be honored in the function.

3.  ALL INDIA TRADE UNION EDUCATION CAMP – 24^TH & 25^TH MAY 2016- DEHRADUN (UTTARAKHAND)

As already notified, the All India Trade Union Education Camp - 2016 of Confederation will be held at Dehradun on 24^th & 25^th May 2016. The last two camps held at Mumbai (2014) & Bangalore (2015) was a grand success. The COC Dehradun is actively involved in making all the arrangements for successful conducting of the camp. Detailed circular regarding classes, venue, food, accommodation, climate, contact phone numbers etc will be published shortly. Delegate fee per head is fixed as Rs.600/- (Rs Six hundred only).

All the affiliated organisations and C-OC’s are once

again requested to depute the given number of delegates to the camp. The Quota fixed is furnished below.

4.       OBSERVE MAY DAY JOINTLY WITH OTHER FRATERNAL ORGANISATIONS:

2016 May 1^st may be observed as May Day at all  important centers jointly with other fraternal organisations. The importance of the International Workers Day and the need to strengthen the unity of working class by building up class-oriented militant struggle against the imperialist neo liberal globa-lization policies may be explained to the workers.

5.       ALL INDIA GENERAL STRIKE :

The national convention of workers at Mavilanka Hall,  New Delhi on 30.03.2016 under the banner of all Central Trade Unions(except BMS) and other Federations/Unions/Associations has decided to organize one day ALL INDIA GENERAL STRIKE  on 2^nd September 2016 against the anti - people anti- labor policies of the NDA Govt. The national Secretariat of the Confederation of Central Government Employees and Workers call upon all its affiliated organizations and C-O-Cs to conduct intensive campaign and preparations for ensuring maximum participation of Central government Employees in the general strike. All affiliated organisations are requested to issue their own separate circulars to their lower units instructing them to participate in the strike. Central Government Employees are the worst victims of the neo liberal policies of the NDA Government and hence it is our duty to make the strike a grand success.

6.  GET READY FOR INDEFENITE STRIKE FROM 2016 JULY 11^TH ON 7^TH CPC RELATED CENTRAL GOVERNMENT EMPLOEES DEMANDS.

The National Joint Council of Action (NJCA) has decided to serve indefinite strike notice to the Govt on 9^th June 2016 and to commence indefinite strike from 11^th July 2016, if the Govt fails to come to a negotiated settlement on 7^th CPC related issues with the JCM National Council Staff Side. In the discussion held on 1^st March 2016 with the empowered committee of Secretaries headed by Cabinet Secretary, the Government has not disclosed its mind on any of the demands including minimum wage. Thereafter no discussion took place. NJCA has given enough time as requested by the Government by postponing the strike to July 11^th. 7^th CPC report was submitted to Govt on 19^th November 2015 and almost five months are over now. The developments that are taking place in the country shows that Modi Govt is becoming more and more and more aggressive towards the workers and common people. Unless we go for an indefinite strike, the Govt may not modify the retrograde recommendations of the 7^th CPC. Confederation National Secretariat calls up on all its affiliates and C-O-C’s to continue the campaign and prepare the rank and file membership to go for indefinite strike from July 11^th. All affiliates should serve the strike notice on June 9^th to their respective Departmental heads. Copy of the strike notice should be sent to all lower units without fail. Branch/Units of some of the affiliates of confederation has complained that their All India leadership has not issued any circular or instructions to them to participate in the strike. Without getting instructions from higher bodies they are reluctant to participate in the strike. Hence it is once again

requested to all affiliates of Confederation that:-

(1)    Clear instructions may be issued to all lower units now itself to participate in the July 11^th indefinite strike.

(2)    Copy of the strike notice served to the Departmental head on 9th June 2016 should be sent to all lower units
