Grant of Honorarium for checking of pay fixation cases and revision of pension cases

Sir,

                  You are aware that, all offices of Civil Accounts Organization are now a days confronting serious work pressure due to huge member of vacancies in all cadres. Inspite of such a stress, Civil Accounts Employees are extending their best performance in attending the extra workload relating to 6 CPC works. But due to recent retirements, problem in the offices have further aggravated and the works connected with checking of pay fixation cases and revision pension cases are suffering very badly.  As such, the Employees have been providing extra time and effort to attend and dispose such works.

                 It may be brought to your kind notice that, after implementation of recommendations of earlier pay commissions, the Civil Accounts Employees of different cadres were granted honorarium for checking of pay fixation and pension cases at fixed rates by your office and such type of recognition to their services had enthused them.

                 This time the Controller General of Defence Accounts vide order No: AT/11/0187/VICPS/HON dated 21-1-09 granted honorarium for different cadres. A Copy of the order is enclosed herewith for your kind reference.

                 We request you to kindly issue orders for granting honorarium to the officials who have been dealing with the revision of pay fixation cases and the pension cases at the following rates-

Dear Comrades,

The joint National Executive meeting of the Constituents of apex JAC was in Gandhi peace foundation hall, Deendayal Upadhyay Marg, New Delhi from 11.AM to 5 PM on 21st July 2009.

        65 National Executive members and leaders from All India Audit and Accounts Association, All India Civil Accounts Employees Association, All India Civil Accounts Employees Association Category- II, All India Postal Accounts Employees Association and All India Audit officers Association participated in the meeting.

        A presidium composing of Com. M. S. Raja, Chairman, Apex JAC and Secretary General, All India Audit and Accounts Association, Com. T. R. Janarddanan, President, National Federation of Civil Accounts Associations, Com. G. K. Gohain, Vice President, All India Audit and Accounts Association, Com. R. S. Dubey, Addl. Secretary General, All India Audit and Accounts officers Association and Com. A. P. Shastri, President, All India Postal Accounts Employees Association conducted the meeting.

After the introductory remarks by Com M. S. Raja, Chairman, Comrade V. Bhattacharjee, Convener placed a work paper on behalf of the apex JAC for discussion by the representatives present in the house. The work paper dealt on the organizational position of JAC at different levels, question of its continuance for the purpose of effective persuasion of the common charter of demands of the Accounts and Audit Employees and Officers adopted by the apex JAC.

Com. N. Nageswara Rao, Addl. Secretary General, AIA&AA addressed the house on behalf of his organization. He stated that due to our long struggle, we achieved the demand of parity partially with effect from 12-11-2001. The benefits of VI CPC are gradually disappearing and in future it will be wiped off. AIA& AA is in favour of re-invigorating JAC in every field station and prepared to take all possible steps.

              Com. R. K Chaurasia, Addl. Secy. Genl., All India Civil Accounts Employees Association while speaking on behalf of   his organization, not only stressed on the need of revitalizing the JAC at levels but also stated that, disparity which came in different cadres should be taken care off. The JAC leadership should take a serious note of it and must give continuous call for struggles to re-group the members of Audit & Accounts.

              Com. P Rajanayagam, General Secretary, All India postal Accounts Employees Association congratulated the Chairman & Convener of apex JAC  for taking positive effort to re-vitalize the local JAC in all stations. After endorsing the work paper, he told that to reconstitute the local JAC, we should take care of the potentiality of the local organization. He stated that as per the recommendations of VI CPC, there is a small gap between the pay of AAO&PAO, we should take care of that.

             Com. S. Mohan, S.G. of All India Audit & Accounts Officer's Association stated that we should re-group ourselves to take care of the grievances in terms of pay of our members. He told that we should identify the stations where the local JACs are not functioning property. He assured that the member of his organization will follow the direction of the apex JAC.

              Com.M.P.Pandit, Secretary General, All India Civil Accounts Employees Association Category II stated that his organization will take positive effort to re-constitute the JAC all over the country.

              Com. S. K. Vyas, Chairman, Confederation of C. G .Employees & workers advised that we must think and find the reasons for nonfunctioning of different units of local JAC in different stations. Previously in two times Govt. gave higher pay scales to the Assistants of Central Sectt. and after that the anger of Audit & Accounts cadre grew up. The JAC had very reasonably proposed to forego all the arrears and stated that the arbitration award may be implemented notionally from 1-1-86 /1-1-96 and actually from 1/1/2006, the date from which the higher pay scales have been granted on the basis of recommendation of VI CPC. But the Govt. did not respond in appositive way. Keeping in view of the above fact, he suggested that the apex leadership should go to different stations and take necessary steps to reconstitute the local JACs to achieve the right demands of audit & Accounts Employees. 

         Com. B. K. Bhambhi, (Ahmedabad), Com. S. C. Pandey (Allahabad), Com. K. C. Mathai (Nagpur), Com. K. L. Yadav (Jaipur), Com. R. S. Dubey, (Bhopal), Com. R. P. Singh (Lucknow), Com. T. Satyanarayana (Hyderabad), Com. S. R. Mahato (Patna), Com. J. Sreenivasan (Bangalore), Com. R. K. Chaurasia ( Mumbai), Com. S. D. Ravindran (Kerala), Com. S. P. Bhattacharjee (Kolkata), Com. G. K. Gohain, (Guwahati), Com. Santosh Kumar (Chennai), Com.L.K.Salve (Mumbai), and Com. A. K. Mehta (Delhi) participated in the discussion and placed their views.

While admitting the fact that, in most of the stations, local JACs are not functioning upto the expectations with a few exceptions like Mumbai, Hyderabad and Bangalore,  it was also very clearly expressed  by all speakers that, JAC should  not only survive in the greater interest of the Accounts and Audit Employees and officers but it should function effectively.  

Com. K.S.Rana (Sundar Nagar) and Com. C.K. Sanal (Cuttack) assured that though in their stations only Postal Accounts exist, the programmes of JAC will be implemented in future.

The members of the Presidium, Com. R. S. Dubey, Addl. SG, All India AOs. Assn, Com. C. K. Shastri, President, All India Postal Accounts Employees Association and Com. T. R. Janarddanan, President, National Federation of Civil Accounts Associations expressed their views independently. While endorsing the work paper, they pleaded for strengthening the work & organization of local JAC as well as Apex JAC.

After detailed deliberations following decisions were taken by the meeting unanimously-

1.       In order to revive JAC-

(a)    All Local JAC Conveners shall organize a joint meeting and inform apex JAC within one month from the date of receipt of this circular so that the representatives of apex JAC could attend such meeting.

(b)   Apex JAC shall identify the places where local JAC(s) do not exist and visit such stations.

2.      All Constituents and local JACs shall popularize the demands adopted by JAC. However, anybody can suggest their demand to Apex JAC which can be taken care of after discussing at appropriate level.

Respected Sir,

 

            I may bring to your kind attention that no decision has so far been taken to implement the award of Board of Arbitration (JCM) in CAR No.3/2001 on the grant of Higher Pay Scale to the staff of IA&AD and Organised Accounts at par with the pay scale of Assistants of Central Secretariat. It would be apt to mention the various developments which have happened relating to this matter.

 

            As the leader of opposition in Rajya Sabha you have written a letter to Shri Yashwant Sinha, the then Finance Minister dated 28.03.2001 that the higher pay scales to the Senior Auditors/Senior Accountants may be granted on the basis of a High  Court decision. The matter was, however, not agreed and disagreement was recorded in the National Council (JCM) held on 12.11.2001.

 

            This matter was referred to Board of Arbitration (JCM) in CAR No.3/2001 and after hearing both the sides the Board of Arbitration gave the following award on 24.8.2004.

 

            Normally the Government should decide the issue within a period of 6 months, if they decide to implement the award. If they do not accept the award they have to move resolution in the Parliament for its rejection within six months. No such action, however, was taken.

 

            The Department of Personnel and Training vide their OM No.7/1/2006-JCA dated 19.05.2006 circulated the list of 16 pending awards which were to be referred to Parliament for rejection at item No 3, the above CA reference No.3/2001 was listed.

 

            In the meeting of the Standing Committee of JCM held on 15th February 2006 the Government agreed to discuss with the Staff Side these awards before taking a final view.

 

            This issue was discussed with Additional Secretary, Department of Expenditure twice, 4th October 2006 and 22nd May 2007 and with Secretary Department of Personnel & Training on 10.07.2007 and again in October 2007. During these meetings the Staff Side has proposed that the actual payment of arrears on accounts of implementation of award may be paid w.e.f. 19th February 2003 instead of 12.11.2001 as per the award.

 

            The Department of Expenditure indicated their inability to implement the award notionally from 1.1.86 and actually from 19.2.2002 on the ground that the arrears to be paid would be of the order of 675 crores and would entail annual expenditure of recurring nature to the time of 152 crores. In the last meeting the Secretary, Department of Personnel & Training, therefore, asked the Department of Expenditure to suggest the date from which they are prepared to implement the award and pay the arrears. The Department of Expenditure, however, did not indicate any such date.

 

            The JAC in their letter dated 2nd December 2008 have formally proposed to forego all the arrears and stated that award may be implemented notionally from 01.01.86/ 01.01.96 and actually from 01.01.2006, the date from which the higher pay scales have been granted on the basis of 6th CPC recommendations.

 

            There has been no response from or action by the Department of Expenditure to implement the award when the very ground on which they were not inclined to accept the award viz the huge arrears of 675 crores has been wiped out.

 

            It appears that the Department of Expenditure wants this matter to attain its natural death by keeping it pending for an indefinite period and Government have not to even take the matter to Parliament with a proposal for its formal rejection. This is so because in the light of the fact that the Staff Side has forgone all the arrears the very ground on which they could go to the Parliament for rejection of the award is no longer there.

 

            I, therefore, request you to consider these developments and issue necessary instruction to Department of Expenditure to implement the award notionally from 01.01.86/ 01.01.96 and actually from 01.01.2006. Without your kind intervention the Department of Expenditure will not do any thing in this matter.

Copy of the apex JAC letter Reference: JAC/FM/2009Dated: 22nd July 2009 to Shri Pranab Mukherjee,Hon'ble Finance Minister,Government of India,

 

Respected Sir,

 

            I enclose herewith a copy of our letter to Dr. Manmohan Singh, Hon'ble Prime Minister dated 22nd July 2009.

 

            This letter has been written by us in connection with grant of higher pay scale to the Senior Auditors/Senior Accountants of organised Account at par with the pay scale of Assistants of Central Secretariat. There is an award of the Board of Arbitration (JCM) in CA reference No.3/2001 according to which the higher pay scale to Senior Auditors/Senior Accountants at par with the pay scale of Central Secretariat has to be granted notionally w.e.f. 01.01.86 and actually from 12.11.2001, the date on which this reference was taken up by the Board of Arbitration.

 

            We have in discussion with the representatives of Department of Expenditure and Department of Personnel & Training have suggested that as huge arrears will have to be paid if the award is actually implemented from 12.11.2001 or even from 19.02.2003, it may be implemented actually only from 01.01.06, the date on which the higher pay scales have been granted by the government on the basis of recommendation of 6th CPC. That way the entire arrears will no longer be payable. The ground on the basis Department of Expenditure was not inclined to implement this award was the huge arrears. Since no arrears are required to be paid the Department of Expenditure has no ground not to implement this award.

 

            I, therefore, request you to intervene in the matter and direct the Department of Expenditure to implement the award by granting higher pay scales notionally from 01.01.86 to the Senior Accountants/Senior Auditors for the period from 01.01.86 to 31.12.2005. So far as higher pay scales are concerned the government has already granted it with effect from 01.01.2006.

 

            We would like to meet you to explain the matter. You may kindly also recall that it was way back in 1983 that you were kind enough to grant us the pay scale at par with the Assistants and therefore we are confident that you would readily agree to restore this parity in the pay scales with Assistant to Audit & Accounts employees during the intervening period from 01.01.86 to 31.12.2005.

 

            To further explain this matter we would like to meet you on any date convenient to you. We may kindly be advised the date, time and place when and where we can meet you.

In the early morning of 12th August 2009, Secretary General suffered a major heart attack. He was admitted in Sir Ganga Ram Hospital, New Delhi immediately. In order to save his life, the Doctors had done two angioplasties on him on emergency basis consecutively on 12th and 13th August 2009.

                                              

             Immediately on receipt of the information, Comrade A.K.Mehta, Vice President and Comrade Mrs. Kalpana Datta, Convener, Women committee had rushed to the hospital. Comrade M.B.Sing, ASG had also reached hospital immediately.

 

            Comrade K. K. Verma, Finance Secretary, Co-ordination Committee, Central Government Employees and Workers', Delhi state and few more comrades also reached hospital immediately.

 

            Few thousands phone calls in the meantime, from different parts of the country were received by the family members and all other leaders of Central headquarter who had been there in the hospital.

 

           Apart from leaders of Civil Accounts Organization, leaders from different organizations visited the hospital during the period between 12th and 15th August 2009. Prominent among them are - Com. D. C. Chauhan, D. K. Arora, K. C. Sharma from NFPE, Com. C. C. Pillai, Working Chairman, Confederation of Central Government Employees and Workers, Com. Giriraj Singh, President, Com. A. K. Kanajia, Working President, Com. V. S. Negi, Addl. General Secretary, Co-ordination Committee of Central Government Employees and Workers', Delhi State and Com. K.K.N. Kutty, Secretary General, Confederation of Central Government Employees and Workers.

 

          Representing the Civil Accounts Authority, Shri Anthony Lianzuala, Jt. CGA accompanied by Shri Prem Ballav, Sr. AO(O/o CGA), Shri R. K. Gupta, Sr. A.O., PAO, RML Hospital, New Delhi visited  the ailing Secretary General in the Hospital on 14th August 2009. He wished him speedy recovery and assured all sorts of help from the authority.

         

          Com. L. K. Salve, President, AICAEA conveyed thanks to the authority on behalf of the members through a letter addressed to CGA.         

 

          Secretary General was hospitalized once again on 26th August 2009 on emergency basis. He was discharged after another angiography and few hours of treatment.

 

          Com. S. Bahdyopadhyay, Finance Secretary was also hospitalized with effect from 11th to 24th August 2009 on suspected Pneumonia. He was having high fever and other complications. He is now recovering slowly.

           We would like to express our sincere thanks and gratitude to you and the officers of Office of the CGA for the invaluable help and support extended to Shri V. Bhattacharjee, Secretary General of A.I.C.A.E.A and N.F.C.A.A. while he was in a critical condition due to a major heart attack he had faced in the early morning on 12th August 2009 and struggling for his life in Sir Ganga Ram Hospital, New Delhi. Shri Anthony Lianzuala, Joint Controller General of Accounts along with Shri Prem Ballav, Sr. AO and Shri R.K.Gupta, PAO, RML Hospital, New Delhi visited Sir Ganga Ram Hospital on 14th August to enquire about the health condition of Shri Bhattacharjee and wished his speedy recovery.   It is a rare gesture of your stature and your administration to spend the valuable time to visit an ailing Association representative and it has thus relieved the stress of everybody who loves Shri V. Bhattacharjee.

            We are also thankful to Shri Chandey Andrews, CCA, CBEC, Smti. Deepika Jain, CA, CBEC  and all the staff and the officers of O/O CCA,CBEC, New Delhi who have responded to the requests of the representatives of the Association instantly and accorded utmost priority to ensure release of medical advance for the treatment to save the life of Shri Bhattacharjee .
