FOR
48 HRS. STRIKE ON 12TH AND 13TH
FEBRUARY 2014
As decided in the Federal Executive
meeting of NFCAA held at New Delhi on 11th and 12th
January 2014, the Strike notice shall be served by the All India Civil Accounts
Employees Association and the All India Civil Accounts Employees Association
category II jointly on 21st January 2014.
As per
the decision, all Branches are requested
to organize centralized demonstration at each Branch Headquarters and forward
the strike notice to all heads offices falling under their jurisdiction.
The draft of the letter of intimation on
strike is annexed to this
circular which is to be served to
the local head of offices as well as to head of Offices situated in outstations also by the
Branches. According to our decisions
taken at our Meeting, all Branch
Secretaries are requested to download the text, fill up the relevant portions
and then forward the letter along with the enclosures, without fail and report
on this may be furnished to Hqrs, immediately.

The Confederation of Central
Government Employees and Workers’ has decided to organize 2 days strike on 12th
and 13th February 14 in pursuance of its charter of demands.
The All India Civil Accounts
Employees Association and the All India Civil Accounts Employees Association
Category II being an affiliates of the Confederation, all members of these
Associations will go on strike (for 48 hours) on 12th and 13th
February 2014.
The
Charter of Demands in support of which the employees shall go on two days
strike on 12th and 13th February 2014 is annexed herewith.

CHARTER OF DEMANDS
PART I
1.
Accept
the terms of reference of 7th CPC, submitted by the staff side,
National Council JCM.
(a) To examine the existing structure
of pay, allowances and other benefits/facilities, retirement benefits like
Pension, Gratuity, other terminal benefits of various categories of Central
Government Employees including Gramin Dak Sevaks (GDS) of Postal Department.
(b) To work out the comprehensive
revised pay packet for the categories of Central Government employees including
GDS as on 1.1.2014.
(c) The Commission shall determine the
pay structure, benefits, facilities, retirement benefits etc. taking into
account the need to provide minimum wage with reference to the recommendation
of the 15th Indian Labour Conference (1957) and the subsequent judicial
pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.
(d) To determine the Interim Relief
needed to be sanctioned immediately to the Central Government
employees including GDS.
(e) To determine the percentage of
Dearness allowance/Dearness Relief immediately to be merged with Pay and
pension including GDS.
(f)
To
settle the anomalies raised in various fora of JCM.
(g) To work out the improvements needed
to the existing retirement benefits, like pension, death cum retirement
gratuity, family pension and other terminal or recurring benefits
maintaining parity amongst past, present and future pensioners and family
pensioners including those who entered service on or after 1.1.2004.
(h) To recommend methods for
providing cashless/hassle-free Medicare facilities to the employees and
Pensioners including Postal pensioners.
2. Ensure
every five year revision of wages of Central Government Employees in future.
3. (a)
Regularization of Gramin Dak Sevaks of the Postal Department and grant of Civil
Servant status, statutory pension and all other benefits at par with regular
employees.
(b) Regularization and revision
of wages of casual and contract workers.
4. Compassionate
appointment – removal of restrictions imposed by Government.
5. JCM and Anomaly
Committee Functioning.
6. Fill up all vacant
posts and creation of new posts wherever justified.
7. Stop
downsizing, outsourcing, contractorisation and privatization of Government
functions.
8. Stop
the move to introduce performance related Pay (PRP) system, Extend PLB Bonus
for all, removing bonus ceiling.
9. Revise OTA and
Night Duty Allowance rates and clothing rates.
10. Implement arbitration
awards.
11. Five promotions to all.
12. Rescind the PFRDA Act.
Ensure statutory Pension for all.
13. Stop price rise. Revive
and extend public distribution system for all.
14. Stop trade Union
victimization.
15. Ensure Right to
strike.

CALL OF DAY LONG DHARNA ON 29TH JANUARY 2014 AND OTHER
ORGANIZATIONAL ACTIONS GIVEN BY APEX JAC
The Federal Executive meeting of
NFCAA was held at Chug Dharamsala, New Delhi on 11th and 12th
January 2014. Com. T. Janardanan, President, NFCAA presided over the meeting . Ignoring the chilly cold condition, Federal
Executive members from Lucknow, Shillong Guwahati, Kolkata, Cochin, Chennai and
Mumbai attended the meeting. However, a good number of Federal Executive
members remained absent without intimation. This Federal Executive meeting was
held as a follow up of the one day Dharna organised by the Confederation at
Jantar Mantar New Delhi on 9th January 2014 in support of the 15
Point Charter of Demands, extended National Executive meeting of the
Confederation held on 10th January 2014 and the Joint National
Executive meeting of constituents of apex JAC held on 11th January
2014.

Branch participated in the Dharna held at Jantar Mantar on 9th
January 2014.
In the extended National Executive
meeting of Confederation held on 10th January 2014, Com. K. Venkatasubramanian, President, AICAEA,
Com. V. Bhattacharjee, Secretary General, AICAEA, Com. A.K. Mehta, President,
AICAEA Cat-II, Com. G.K. Nair, Secretary General, AICAEA, Cat-II attended as
authorized representatives.
In the Joint
National Executive meeting held under the banner of apex JAC on 11th
January 2014, 22 Federal Executive members from different parts of country
attended.
Agenda No:1
Review of the last meeting held on 20th and 21st September 2013
Before discussing
the fresh items of agenda meeting reviewed the decisions taken in the extended
Federal Executive meeting held on 20th and 21st September
2013.
·
The meeting was attended by 67 Federal/National Executive/Women
Committee members and nominated representatives of Branches.
·
The meeting was inaugurated by Com. M. Krishnan, Secretary
General, Confederation of Central Government Employees and Workers.
·
The decision taken to seek Strike Ballot from the members for
resorting to indefinite strike was not implemented as the Confederation
suspended the decision temporarily after the announcement of 7th CPC
by the Government.
·
Signature campaign against the transfer of 5 Sr. Acctts. of PAO
(Ptg), Delhi to different other stations was implemented. However, expected
numbers of signatures had not been received so also was the position of Block badge
wearing. The protest memorandum containing more than 2000 signatures was handed
over to CGA on 12th October 2013. The call of Branch wise Dharna on
22nd October 2013 on the same issue was implemented by very few
Branches. However, CGA finally discussed the matter with Secretary General and
settled it before Diwali festival responding to the demand placed by the Secretary
General before him.
·
Resolution forwarded to CGA demanding review meeting within one
month on the issues discussed on 30th May 2013 was not responded by
CGA.
·
Despite forwarding resolution by the meeting and reminding
subsequently, Secretary General had not been relived for Foreign Service by the
PCCA, CBEC.
·
The Trade Union Class organized on 15th and 16th
November 2013 in Mumbai under the auspices of Confederation was attended by
nominated candidates from Kolkata (2), Pune (1) and Mumbai (7). Persons nominated
from Ahmedabad did not attend.
·
2nd National Women Convention of the Confederation held
at Delhi on 25th and 26th November 2013 was attended by
Delegates from Chennai (2), Madurai (1), Nagpur (4), Kolkata (5) and Delhi (1).
·
The decision of membership mobilization did not take reasonable
progress. In the meantime, responding to the letter of AICAEA headq1uaretes,
CGA had directed all CCAs to furnish the verification report within 15th
November 2013.
In supplementing the discussion,
representatives from Mumbai informed that the leaders from Civil Accounts of
Mumbai had played very important role in organizing the Trade Union Class.
Similarly, Federal Executive members
from Delhi also appraised the house that they were the major force in
organizing the 2nd Women Convention of Confederation in Delhi.
After review the meeting discussed
the rest of the items and look decisions on them.

Implementation of the decisions of Confederation
The decisions of Confederation to
organize one day Dharna on 19th December 2013 and relay Dharna from
30th December 2013 to 3rd January 2014 were observed and
Civil Accounts Employees had participated in those programmes with their full
strength.
The extended National Executive
Committee meeting of the Confederation held at Delhi on 10th January
2014 decided that there shall be 48 hours (two days) strike from 12th
and 13th February 2014 in persuasion of 15 Point Charter of Demands
and all affiliates of Confederation shall organizing massive due outstation.
The
federal executive meeting endorsed the call of strike and appealed upon rank
and file membership of NFCAA to take part and make the strike a grand success.
It has been decided to serve the strike Notice in the following manner:- on
21-01-2014
1. Central Headquarters of AICAEA & AICAEA Cat-II shall serve
joint strike notice to CGA under the signatures of both Secretary Generals.
2. Branches shall organize centralized demonstration at each Branch
Headquarters and forward the strike notice to all heads of offices falling under
their jurisdiction.
In order to make the strike successful,
it has been decided to visit stations by Federal Executive members. A tour
programme of Federal Executive members attended the Federal Executive meeting
shall be issued immediately and they would carry-out the decision without fail.

Implementation of apex JAC decisions:
The meeting of apex JAC in its joint
National Executive meeting decided that
While
serving the strike notice on 21st January 2014, the affiliate shall
incorporate the demands of apex JAC as Par-II charter of demands.
Further
all units/Branches of constituents of apex JAC shall organize a day long Dharna
on 29th January 2014 and there shall be different other programmes
like signature campaign and National Convention etc. after the strike on 12th
& 13th February 2014.
The meeting of the Federal Executive
endorsed the decisions of apex JAC meeting and directed the Branches and Units
of affiliates of NFCAA to implement the directive unitedly.
Agenda No:-4
Departmental problems & next course of
action to be taken:-
a. Departmental demands: - The status of the Departmental demands was
reviewed by the meeting. In the last federal executive meeting held on 20th
and 21st September 2013, a resolution was adopted and CGA was
request to convene a meeting within one month to review the progress of the
items discussed in the official meeting held on 30th May 2013. But
CGA not convene any meeting and there was no progress on any of the items
discussed.
The meeting
therefore, in pursuance of the decisions taken in the separate National
Executive meetings of AICAEA & AICAEA Cat-II held on 12th
January 2014, adopted a resolution and forwarded CGA demanding immediate
settlement of the pending demands. The meeting further decided that there shall
be organizational action on departmental demands and Federation headquarters
shall adopt the programmes if there is no response from the authority within
one month.
b. Irregularities in conducting AAO© Examination:- It was brought to
the notice of the meeting that, some of the candidates earlier working on
deputation basis were allowed to appear the AAO © examination after one year of
their absorption. Since such an action on the part of the authorities being
against the interest of Civil Accounts Employees, the meeting in order to have
the accurate information has directed Federation headquarters to seek
information through RTI.
c. E-payment: - It was reported in the meeting that as per the decision of last
meeting, a note on the e-payment was forwarded to CGA seeking discussion. But,
there was no response. Regarding the scheme of expansion of e-payment up to DDO
level, the meeting was of the opinion that, the scheme should be discussed at
the Branch level and the conclusion arrived at may be sent to headquarters for
further necessary action.
d. Elevation to the post of Sr.
Accountant from Accountant is not a promotion:-
As per a judgement delivered in Nagpur High court case, it was declared in the
High court that when an elevation of post occurs due to cadre restructuring (as
done from 01.04.1987) the elevation from Accountant to Sr. Accountant, given to
an employee due to the policy of that cadre restructure, should not be
considered as promotion.
Further,
as per the judgement given in respect of the case of one Accounts Assistant
from Southern Railway, Chennai, the judgement was delivered in all the levels,
namely, CAT, CHENNAI, HIGHCOURT CHENNAI AND SUPREME COURT, ND, the contention
of the employee that elevation of post from Accountant to Sr. Accountant, done
due to policy change or cadre restructure done in organised Accounting Cadre,
is not to be considered as promotion at all.
In view of the above facts, it was decided
that this matter shall be taken up with CGA.
e. Recruitment of consultant:- It was noted by the meeting that, CGA has
issued circular pointing out guidelines for recruitment of Consultants. The
Association being opposed to recruitment of consultants requested the members
not to co-operate with such an anti-worker move and directed the federation
headquarters to write to the authorities re-iterating its standing decision on
this matter.
f.
Joint action of
two Association:- In response to the decisions of the separate national executives
meeting of AICAEA and AICAEA Cat-II held on 12th January 2014, the
meeting of the federal executive took following decisions.
i.
There will be signature campaign from 15th to 28th
February 2014 on the demand of grant of recognition to AICAEA Cat-II without
further delay and totality of the membership of the affiliates of NFCAA shall
participate in the signature campaign..
ii.
The AICAEA Cat-II shall held Dharna on 12th March 2014
on its demands and the AICAEA and NFCAA shall its support to the agitational
action in all respects.
iii.
All the National Executive/ women Committee members/ Branch/Unit
committee members of AICAEA shall not take accept e-payment and they shall requite
the DDOs in writing to pay them in cash of y cheque.
g. Sectional issues:- Apart from the
common issues, the meeting of the Federal Executives discussed various other
issues lying pending with different heads of the departments. It has been
decided by the meeting that the Federation headquarters shall seek meetings
with the Pr. CCA, CBEC, Pr. CCA, CBDT, CCA, Home, CCA, Supply and CCA, I&B
at the earliest as more than one issues are lying pending with such
departmental authorities.
It was observed that
maximum number of issues including the issue of release of Secretary General to
Foreign Service are pending with Pr. CCA, CBEC and hence, in the event of
non-response by the authority concerned, the Branches of Delhi shall organize
Dharna in front of the office Pr.CCA, CBEC and all other Branches shall hold
demonstration on the same day in front of CBEC Units of the country.
Different Federal
Executive members raised the following issues and accordingly the meeting
directed Federal headquarters to pursue those on priority basis:-
i.
Non-implementation of transfer policy of AAOs in its proper sprit.
ii.
Vindictive transfer in Ministry of U.D. Chennai.
iii.
Attempt of CCA, Home to unilaterally centralize the GPF Accounting
of CISF.
iv.
Non-grant of adhoc promotion in CBEC setup – case of Mumbai.
v.
Pendency of transfer cases in CBEC, setup – cases of Madurai.
vi.
Refusal to grant annual honorarium to Employees of CBEC setup.
vii.
Problems of the members working under Ministry of Information and Broadcasting
- cases from Mumbai and N.E.
viii.
Pendency of compassionate appointment cases in Lucknow.

Formation of Civil Accounts Pensioners Association:-
The decision taken in the meeting of
Federal Executive held at Kolkata on 11th July 2013 on the matter
was reviewed by the meeting. Com. Asim Kumar Bhattacharjee, who had been
elected as Convenor for forming the Civil Accounts Pensions Association is not
in a state of good health and it would not be feasible on his part to visit
various stations frequently. In view of this the meeting decided that a
Conveners committee comprising Com. M. Elumalai (Chennai), Com. T.R.
Janardanan, Com. L.K. Salve, Com. M.P. Pandit (all from Mumbai), Com. M.S.
Bharne (Nagpur), Com. S. Bandhyopadhyay (Delhi) and Com. Asim Kumar
Bhattacharjee (Kolkata) shall take necessary steps jointly to from the Civil
Accounts Pensioners Association.

Formation of non-departmental (casual/contingent/outsourced/contract)
Employees Organization:-
The All India Conferences of AICAEA
& AICAEA Cat-II held in Kolkata from 9th to 11th July
2013, had discussed the need for formation of All India Organization of
non-departmental Employees of Civil Accounts Organization. The meeting reviewed
the position and noted that large members of non-departmental employees are
working in the Civil Accounts organization and resolution forwarded by the
joint delegate sessions of the All India Conferences to the Controller General
of Accounts in respect granting them the
legitimate benefit envisaged in the Ministry of Labour dated 23rd
January 2013 was ignored.
It was however, reported that, a
union of the non-departmental employees have formed at Kolkata. In appreciation
of this development it has been decided by the federal executive meeting that
the Branches of West Bengal shall forward the constitution of the union formed
to all Branches either through e-mail or by post. Further, all Federal
Executive members shall collect the number/name of the non-departmental
employees working in their respective Branches and forwarded the information to
Federation headquarters through their Branch Secretaries. On receipt of this
information, federation headquarters shall decide the next course of action.

Organizational Review:-
The Federal
Executive meeting reviewed the organizational position. It has expressed its
dissatisfaction for not taking the task of membership mobilization on propriety
basis by some of the Branches. The meeting therefore, directed all Branches to
process the membership enrolment in a time bound manner. The meeting also
appealed upon the Civil Accounts Employees to enroll themselves as members of
the Association so that the Organizations i.e. AICAEA and AICAEA CAT II are
strengthened and their recognitions are sustained.
In order to mobilize the members for
the ensuing strike, it has been decided by the meeting to organize extensive
tour to various stations and it may be finalized by the Secretary General of
AICAEA & AICAEA Cat-II jointly in consultations with their Presidents.
The meeting was thereafter declared over
by the Chair.
