- Item No. 11 (eleven) of minutes of the meeting held on 06.11.2015 - grant of
Pay Scale of Rs. 1350-2200 from 01.01.86 to DEOs as has been granted by the
Defence Accounts Department as well as in terms of the CAT Judgement.
Sir,
I
have been directed to draw your kind attention to the above and state that, in
the meeting held on 6th November, 2015 between the official side and
the National Executive of this Association under your Chairpersonship, the
official side had informed the following
–
“This office vide I.D. No.
A-11020/2/2000 /MF. CGA(A)/NGE/DEOs/P. Scale/7 dated 13.04.2015 has requested
Ministry of Finance, Department of Expenditure that Data Entry Operator Grade
‘A’ of CCAS may be granted pay scale of Rs. 1350-2200 w.e.f. 01.01.1986. The Ministry
has raised some queries and asked this office to seek clarification from CGDA
in this regard. The matter has been referred to CGDA for clarification. Jt. CGA
vide D.O. No.A.11020/2/2000/MF.CGA(A) /NGE/ DEO/337 11.09.2015 has also
requested to Jt. CGDA, Defence Accounts for sending necessary clarification in
this regard at the earliest. In the meanwhile CGDA has asked for our comments
along with similarly placed organizations on the judgment delivered by Supreme
Court in this regard. The reference of CGDA and Judgment of Supreme Court in
this regard are under examination. A reply in this regard will be sent to CGDA
soon."
But,
we are yet to know about the action taken by your office.
Further,
we are enclosing copies of following documents from which it is crystal
clear that the Defence Accounts
Department has granted the Pay Scale of Rs.1350-2200 to the DEO Grade –‘A’ from
01-01-1986 or from the date of their initial recruitments.
1.
MOD
(FIN) I.D. No. F10 (II)/C/Misc/2003 (294) dated 20.12.2004.
This document has been conveying the decision of the Defence Accounts Department to implement the CAT Judgement dated
16.10.2003 in C.P. No. 16/2003 in OA No:- 371/2002 through granting the pay scale of Rs.
1350-2200 to DEOs Gr-A after obtaining undertakings from the individuals(ANNEXURE – I)
2.
CGDA
letter No:- EDP/113/11 (PC) Vol. 13 dated 04.01.2005 directing all PCs
DA/CSDA/PC of A (Fys)/CF & A (Fys)
This order is a direction to grant the
Pay Scale of Rs. 1350-2200 all DEO Gr-A and B (ANNEXURE – II).

The
Controller of Defence Accounts, Bangalore – 7 orders Part II OO No. 43 dated
01.02.2005
This order conveys that the DEO Gr-A
have been granted pay fixation benefit in the Pay Scale of Rs. 1350-2200 either
from 01-01-1986 or from the date of
their initial appointment.(

The
CGDA letter No:- EDP/113/II (PC)/Vol-14 dated 4th January 2006
This letter has been issued directing
the Principal Controller of Defence Accounts, New Delhi to implement the Pay
Scale of Rs:- 1350-2200 to both Date Entry operations Grade “A” and Grade “B”(ANNEXURE-IV).

CGDA
letter No:- AN/III/3053/RTI/CPIO/TMR/C No. 352 dated 08.07.2009
This letter is a reply to the
application under RTI Act 2005 addressed to Shri TVNL Mallikkarjuna Rao,
Chennai. In this letter detailed information has been provided to the applicant
admitting that in terms of the direction of CAT Hyderabad, the DEOs Grade ‘A’
have been granted the Pay Scale of 1350-2200 w.e.f. 1.1.1986(ANNEXURE-V).

RTI
application dated 29.04.2010 of Shri T.V.L.N Mallikarjuna Rao and CDA Chennai
letter No:- RTI/CDA Chennai/TBLNMRAO dated 06.05.2010.
These documents clearly establish that
the DEOs Gr-‘A’ working in the Defence Accounts Department are enjoying the Pay
Scale of Rs.1350-2200 either from 1986 onwards or from their initial
appointment.(ANNEXURE – 6 & 7
respectively).
Therefore,
the DEO Gr-A working in Civil Accounts organization being similarly
circumstanced with the DEO Gr-A of Defence Accounts Department and since the Honb’le Calcutta Bench of CAT vide order
dated 15.07.2014 in O.A.No. 63 of 2013 has kindly given a clear direction of
granting the same Pay Scale to DEOs Gr-‘A’ of Civil Accounts also, we request
you to issue orders granting the Pay Scale of Rs. 1350-2200 to DEO Grade ‘A’ of
Civil Accounts Organization with effect from 01.01.1986 or from the date of
their initial appointment (whichever is later) without any further delay.
