Subject: - Revocation of inter-station transfer orders of National Executive member and Branch Secretary - Request regarding.

Sir,
            On behalf of this Association, I have been directed to bring it to your kind information that, Shri Naresh Khatri, Accountant, working in ZAO, CBDT, Ahmedabad has been vindictively transferred to Rajkot by the office of the Principal Chief Controller of Accounts, Central Board of Direct & Taxes, New Delhi vide orders dated 29.05.2017 (copy enclosed). Shri Naresh Khatri is one of the democratically elected Assistant Secretary Generals of this Association. He is also the Branch Secretary of Gujarat Branch and the Unit Secretary of the ZAO, CBDT, Ahmedabad Unit of this Association.

            However, before encroaching into your precious time, we had made our submission to the Principal CCA, CBDT, New Delhi vide our letter No:- AICAEA/HQ/C-9/2017/249-50  Dated 31.05.2017  and requested him to kindly intervene and revoke the transfer order of Shri Naresh Khatri, Accountant as well as the representative of this Association with immediate effect. A copy of the said letter enclosed is herewith for your kind perusal.

            Further, with a view to resolve the matter amicably, we have met the concerned Controller of Accounts of the office of Principal Chief Controller of Accounts, CBDT consecutively on 31st May and 2nd June 2017 respectively and requested him to kindly to withdraw the transfer order. But he has not responded positively so far.

            Since the vindictive transfer orders has been issued against Shri Naresh Khatri, Assistant Secretary General in violation of the Government of India instructions and the instructions of your office as well, there is wide spread resentment among our members across the country.

            Therefore, we request you to kindly intervene into the matter and direct the authorities concerned to revoke the transfer orders of Shri Khatri with immediate effect and retain him in the ZAO, CBDT, Ahmedabad.

Subject:- Revocation of inter-station transfer orders of National Executive member and Branch Secretary - Request regarding.

Sir,
            We have learnt that, your office vide office order No:- 24/2017-18 issued under No:- ADMN-I/1-2/PCCA/CBDT/2017-18/256-67 dated 29.05.2017 has transferred Shri Naresh Khatri, Accountant from Zonal Accounts Office, Central Board of Direct Taxes, Ahmedabad to Zonal Accounts Office, Central Board of Direct Taxes, Rajkot with immediate effect.
            In this respect, I on behalf of this Association would like to draw your kind attention to following few lines:-
1.           Dislocation of Shri Naresh Khatri from Ahmedabad at this stage shall put him and his family into a deep trouble. On one side, his four years old innocent female child shall be one of the major sufferers as she has been admitted to a School at Ahmedabad and her readmission to another school at Rajkot shall cause psychological affect on her and on the other side the family shall suffer from financial loss. Shri Naresh Khatri vide his representation dated 29th May 2017 addressed to you has explained all his difficulties. 
2.           Shri Naresh Khatri being a native of Jodhpur, Rajasthan has represented for considering his transfer request to Jodhpur. But the office of the Controller of Accounts, Central Board of Direct Taxes, Mumbai, while forwarding the representation of Shri Khatri to your office vide letter No:- CA/MUM/CDN/2017-18/170 dated 27.04.2017 had stated the following:-
At present Zonal Accounts Office, Central Board of Direct Taxes, Ahmedabad, has 15 working strength against 24 sanctioned post of Accountant. If the transfer application of Shri Naresh Khatri, Accountant is considered favorably, he will be relieved on joining of a suitable substitute.”
The staff position does not seem to be changed in Zonal Accounts Office, Central Board of Direct Taxes, Ahmedabad after the representation of Shri Khatri was forwarded by your Mumbai Office. But, your administration has taken a self contradictory stand and ordered for transfer of Shri Khatri to Rajkot.
3.           To explain his circumstances and submit the advance copy of his representation for re-consideration of order for transfer, Shri Naresh Khatri had come to your office on 30th May 2017 from Ahmedabad. Despite his all endeavor till the end of the working hours of the day, he was denied audience by your administration. On the other hand, the local administration of ZAO, CBDT, Ahmedabad has threatened him of not granting casual leave for visiting your office.
4.            Shri Naresh Khatri is one of the democratically elected Asstt. Secretary Generals of All India Civil Accounts Employees Association which is a recognized Association and he being stationed at Ahmedabad has been entrusted the task of looking after the welfare of the employees of entire Gujarat Region. It is beyond doubt that, his dislocation from Ahmedabad shall create serious hindrance to the smooth functions of the All India Civil Accounts Employees Association.
5.           In addition to being the Unit Secretary of Zonal Accounts Office, Central Board of Direct Taxes Unit, Ahmedabad, Shri Naresh Khatri is the democratically elected Branch Secretary of the All India Civil Accounts Employees Association, Gujarat Branch as a whole.
6.           Being one of the National Executive members of the Association Shri Naresh Khatri has to carry out the directive of All India Civil Accounts Employees Association and being the representative of the Branch and the Unit he has to peruse the issues concerning with the Civil Accounts Employees of Gujarat in terms of the following orders of the Government of India:-
i.        DOP & AR (Now DOP&T) OM No:- 10/4/82-JCA dated 19.10.1983 issued vide Controller General of Accounts OM No:- A-60015/1/77/MF. CGA/XV dated 19.10.1983 (Relating to Unit functioning)
ii.      Controller General of Accounts OM No:- A-11019/47/91-92/MF.CGA (A)/750 dated 11.05.1983 containing the decisions of 62nd meeting of Departmental Council of Department of Expenditure (Relating to Branch functioning)
7.           As per  DOPT OM No:- 2/7/88-CS (IV) dated 19.08.1988,  the functionaries of recognized Unions/Associations including President and Branch Secretaries should not be dislocated even from main office Building. But Shri Khatri has been ordered to move to another station.
8.           The transfer order of Shri Naresh Khatri, Accountant has been issued in total violation of CGA OM No:- C-11021/63/15/CGA/CVO/Office Guidelines/1419 dated 15.12.2015.
9.           The local administration of ZAO, CBDT, Ahmedabad do not take care of the issues of the employees or follow the mechanism of grievance redressal  envisaged  in the Controller General of Accounts OM No:- A-60015/1/77/MF.CGA/XV dated 19.10.1983 and OM No:- A-11019/47/91-92/MF.CGA (A)/750 dated 11.05.1983 respectively. As such, our Gujarat Branch has been forced to refer some of the major pending problems concerning with the employees and functioning of offices to this Central Headquarters for taking up at your level. Central Headquarters vide its letter No:- AICAEA/HQ/A-3/CBDT/2017/222 dated 26.04.2017 has accordingly, submitted those items along with other items of various other ZAOs  to your good self  and  requested to convene a formal meeting for discussion of these items.
10.      It has been reported by our Branch Committee members from Gujarat Branch that, due to referring some among the long list of pending problems of the office to your level, the local administration of your Ahmedabad office has been feeling uncomfortable with the situation and on account of this it has sought the transfer of the Chief executive of the Unit and Branch Shri Naresh Khatri from that office by leveling allegation against him so that their inactions and anti-employee activities  are not exposed in front of the higher authorities.
11.      Our Branch Committee has also brought it our knowledge that some of the officers have been passing loose and derogatory comment against Shri Khatri and other office bearers that they are doing “unionbaji” and they shall be panelized for doing “unionbaji”.
            It is crystal clear from the above discussed points that the transfer order issued by the administration of your office against Shri Naresh Khatri is a vindictive transfer order and such a step  has been taken not only with the attempt to curb the democratic functions of the Associations but to create an atmosphere of fear among  the employees so that they keep away from taking part in the Association activities and do not dare to point out the deficiency of administration or speak for their rights.
            Moreover, we would like to place it on rerecord that, using the derogatory word of “Unionbaji” by responsible officers is untenable.  Right to form Association and participate in Association activities are enshrined in the article 19 of Constitution of India and the Government of India has kindly extended these rights to the employees and workers and also to every citizen of the country. No sensible employees’ organization shall silently tolerate such insulting remarks in respect of their responsible office bearers or this form of attempt of belittling the stature of their Associations. 
            Not only this, we would also like to add here that the government has  introduced JCM Scheme for redrassal of grievances of the employees and issued instructions for operating the scheme at the different levels of the government departments.  But instead of following those instructions of Government, taking vindictive actions against the employees for ventilating grievances by them through their democratic platforms is not at all expected from a good administration.
            Therefore, I on behalf of this Association request you to kindly intervene personally in to the matter and revoke the transfer order of Shri Naresh Khatri, Accountant and a representative of this Association with immediate effect.
