In continuation of this
Association’s letter No AICAEA/HQ/A-40/2017/351-354
Dated: 10. 06.2017, I have been directed to draw your kind attention to the
following few lines -
1. The Central Board of Direct Taxes,
Department of Revenue, Ministry of Finance, New Delhi vide its letter F.
No.B-12020/2/2003-Ad.IX dated 15-01-2007 had conveyed the decision of the
Central Board of Direct Taxes to The President of the Income Tax Employees
Federation not to extend the deputation period of Shri K. K. N. Kutty,
Secretary General(copy enclosed as ANNEXURE –A1)
Responding to the above letter of Central Board of Direct Taxes,
the Income Tax Employees Federation
vide its letter No. Itef/Z-1/2007 dated 19-02-2007 had forwarded the Department
of Posts Circular No:- 86-5/200-SPB-II dated 5th March, 2002 (copy
already forwarded to your office by this Association) and requested to the Board authorities to grant extension of
foreign Service period of Shri K. K. N. Kutty, Secretary General, Income Tax
Employees Federation(copy enclosed as ANNEXURE –A2).
The Central Board of Direct Taxes had accepted the request made
by the Income Tax Employees Federation through its letter dated 19-02-2007 and vide
letter No F. No.B-12020/2/2003-Ad.IX dated 21-03-2007 had extended the Foreign Service
period of Shri K. K. N. Kutty, Secretary General, Income Tax Employees
Federation uninterruptedly. The Board had also endorsed the copy of its letter
to the CCIT, Chennai where Shri K.K.N. Kutty was originally posted (copy enclosed
as ANNEXURE –A3).
2. Shri M.S. Raja Secretary General, All
India Audit & Accounts Association is working in his Association on Foreign
Service terms. He is a Senior Accountant in the office of the Principal
Accountant General Accounts and Entitlement, Maharashtra, Mumbai. The requests of Shri M.S. Raja, Secretary
General, All India Audit & Accounts Association to continue with the
Foreign Service facility un-interruptedly is being approved by the Comptroller
& Auditor General of India.
In
support of the above facts, we are enclosing the copies of the Principal
Accountant General Accounts and Entitlement, Maharashtra, Mumbai “OFFICE ORDER”
No. Admn-I/Deptn/Sr. Acctt/MSR/28 dated 17-05-2016 and letter No.
Admn-I/Deptn./MSR/9801 dated 09-02-2017 and also the Comptroller and Auditor General
letter No. Staff (app-1/06-2017 279 dated 17-02-2017 as ANNEXURE- B1,
ANNEXURE-B2 and ANNEXURE- B3 respectively for your kind perusal.
Therefore, I have been directed further
by the Association to request you to kindly consider the above submission and
the submissions made by us through our earlier correspondences and take a
favorable decision on the matter of continuation of Foreign Service facility
uninterruptedly.

Sir,
The National Executives Meeting of
this Association held today has reviewed the outcome of the official meeting
held between the official side of the Office of the Controller General of
Accounts and the National Executive of this Association on 9th June
2017 under the Chairpersonship of Joint Controller General of Accounts. Apart
from other items, while reviewing the outcome of the discussion and assurance
of official side to take a favorable decision in a week’s time on the issue of unilateral
discontinuation of Foreign Service facility to All India Civil Accounts
Employees Association in violation of DOPT instructions and ignoring the role
of CGA by the office of the Principal CCA, CBEC, the meeting of the National
executive has decided bring the following matters to your kind information:-
1. Ministry of Labour & Employment
OM. No. 18/21/60-LRI dated 09-05-1961 and Ministry of Finance OM No. 1(10)-EIII
(B)/75 dated 20.10.1975 has extended the facilities to the representatives of
recognized Unions/Associations of Central Government employees to work as Union functionaries on Foreign
Service terms.
Accordingly, the Foreign Service facilities to the service Associations/
unions of Income Tax Department, Department of Post, Indian Audit and Accounts
Department and Railways etc has been
granted by the apex authorities concerned and the same procedure is applicable
to Civil Accounts Organization too.
Therefore, it is amply clear that the discretion of extending Foreign
service facilities to All India Civil Accounts Employees Association which is representing
the employees working under more than 35 (thirty five) Heads of the Departments
of Civil Accounts Organization rest with the authority who have granted the
recognition i.e. Controller General of Accounts and not on any other subordinate
authority to the Controller General of Accounts.
Accordingly, the All India Civil Accounts Employees Association
being recognized at the level of CGA, it had sought Foreign Service facility
for the Association and the same was made effective with effect from
09.02.2007.
Further, the Association never requested the Pr. CCA, CBEC, New
Delhi to extend Foreign Service facility to the Association who is not at all
competent to take any decision on this matter.
2. The clarifications of DOPT circulated
by the Department of Posts vide its Circular No:- 86-5/200-SPB-II dated 5th
March, 2002 stated that, the DOPT OM
dated 05.01.1994 is not applicable to the cases of deputation of officials to
Union/Associations and it has been accepted by
all the Departmental Heads of Government of India.
This Circular when submitted to the authorities of the Departments
other than the Department of Posts by the respective service Associations requesting
them to extend the facilities extended through the circular, the authorities of
those departments have accepted the request of their Associations and extended
them the facilities.
Therefore, the All India Civil Accounts Employees Association is
to get similar treatment from Controller General of Accounts who is the apex
authority of Civil Accounts organization.
3. It has been noted that, after the
above mentioned circular of Department of Post was forwarded by the Association
to the Pr. CCA, CBEC, New Delhi, the plea of discontinuation Foreign Service facilities
to the Association was changed by the administration of Pr.CCA, CBEC from the
question of “extension deputation period beyond three years” to “administrative
reason”.
Not only this, initially the administration of Pr.CCA, CBEC also
tried to stall the Foreign Service facility granted to the Association keeping
the Controller General of Accounts away from the picture. It has started
endorsing the copies of its correspondences to the lowest of level of hierarchy
of the Office of CGA only after noticing that, All India Civil Accounts
Employees Association has sought the intervention of the Controller General of
Accounts.
Therefore, the meeting is of the opinion that the administration
of Pr. CCA, CBEC has been trying to discontinue the Foreign Service facility by
overstepping its discretion undermining the role of CGA and perusing a double standard approach only with the
objective of straining the relation between the Association and the authorities
and victimizing the individual association functionary .
4. At the time of relieving Shri V.
Bhattacharjee, Senior Accountant and Secretary General to join in the All India
Civil Accounts Employees Association vide Office order No:- Admn/1/ (10)
3/Association/2013-14/1408 dated 14.01.2014 the office of the Pr.CCA, CBEC had
stated in its order that terms and condition of deputation would be
communicated in due course. But it did not issue the terms and condition within
last three years even after several rounds of discussions with different level
officers and written request made by the Association vide its letter No.
AICAEA/HQ/A-40/FS/2015 /110-112 dated 24-02-2015.
Now to cover up its lapses and with the objective of
destabilizing the functions of the Association by panelizing the Secretary
General of the Association in different forms, the administration of the Pr.
CCA, CBEC is taking shelter of those orders of Government on deputation which
are not applicable to the persons working on deputation basis to the service
Associations.
Therefore,
the meeting of the National Executives held this day is of the firm opinion
that, future relations between the CGA authorities and the employees
Association and also the welfare of thousands of Civil Accounts Employees
working under rest of the heads of the departments of Civil Accounts Organization
should not be entrusted to the departmental head who is not competent in terms
of the Government of India Rules.
5. It is very clearly evident from the letter
No. A.11019/25/2011/MF. CGA (A)/NGE/AICAEA-HQ/101 dated 15th May
2017 issued to the Pr. CCA, CBEC by the office of the CGA that, Controller
General himself has expressed his desire for continuation of Foreign Service
facility to the All India Civil Accounts Employees uninterruptedly. But from
the orders and correspondences of the administration of Pr. CCA, CBEC, it implies that the administration of Pr.
CCA, CBEC preferred to ignore the letter and thereby ignored the desire of the
highest authority of Civil Accounts organization.
In
consideration of above situations, the meeting of the National Executives has
decided to request you once again to kindly regulate foreign service facility
at the apex level of the organization and
direct the administration of Principal CCA, CBEC to regulate the
facility in terms of the Government of India instructions.
Therefore, I on behalf of the Association
request you to kindly consider the request of the National Executive meeting of
this Association and take an early favorable decision on this matter.

inter-station transfer orders of National Executive member and Branch Secretary
- Request regarding.
Sir,
While
deliberating on the outcome of the meeting held between the official side of
office of Controller General of Accounts and the National Executive of this
Association under the Chairpersonship of the Joint Controller General of
Accounts on 9th June, 2017, the National Executives meeting of this
Association held on 9th and 10th June, 2017 has reviewed
the issue of vindictive transfer of Shri Naresh Khatri, one of the Assistant
Secretary Generals of this Association from Ahmadabad to Rajkot.
The
meeting of the National Executives noted that Shri Khatri has been transferred
vindictively at the advice of the local authorities and without cross verifying
the facts. The effort of Shri Khatri to present his case in person before the
higher authorities was a wasteful exercise by him. Representation submitted by
Shri Khatri in this regard has not also been forwarded by the local
administration to the office of Principal Chief Controller of Accounts, Central
Board of Direct and Taxes and the advance copy of the said representation
handed over to the competent authority by this Association has not been given
any cognizance.
This
Association vide its, letter No:- AICAEA/HQ/C-9/2017/249-50 dated 31.05.2017
had requested Principal Chief Controller of Accounts, Central Board of Direct
and Taxes to kindly intervene and revoke the vindictive transfer order. But, no
response was received by this Association.
However,
thereafter this Association vide its letter No:- AICAEA/HQ/C-9/2017/291 dated
05.06.2017 had sought your kind intervention in this regard. Further, the
National Executives of this Association when raised this matter in the meeting
on 9th June, 2017, it has been assured by official side that, the
issue shall be looked into at the earliest and a favorable decision shall also be
taken.
In
view of this, National Executive meeting of this Association has directed me to
request you to kindly direct the authorities concerned to revoke the vindictive
transfer order and allow Shri Naresh Khatri, Accountant and Asstt. Secretary
General, All India Civil Accounts Employees Association, Branch Secretary, AICAEA, Gujarat Branch and Unit Secretary, All India Civil Accounts Employees
Association, Zonal Accounts Office, Central Board of Direct and Taxes, Ahmadabad to work as Accountant in Zonal Accounts Office, Central Board of
Direct and Taxes, Ahmadabad, so that he could perform his official duty, take
care of his family and discharge his responsibility towards the Association
without any difficulty.
