Subject: - Meeting between official side of
Pr. CCA, CBDT and representatives of All India Civil Accounts Employees Association.
Sir,
When some of us
had met you in your chamber on 12th May, 2017 you had kindly asked
us after a brief discussion to submit a duplicate copy of the letter of request
for the meeting with the representatives of this Association submitted by us.
Accordingly, we had handed over the copy of our letter No:-
AICAEA/HQ/A-3/CBDT/2017/222 dated 26.04.2017 to your Secretariat on 15.05.2017.
In the meantime
one of our Assistant Secretary Generals, as well as Branch Secretary, Gujrat
Branch and also the Unit Secretary, ZAO, CBDT Unit, Ahmedabad was transferred
to Rajkot reportedly on the ground that he is a representative of the
Association. As the transfer was totally against the DOPT and Controller
General of Accounts instructions, this Association vide its letter No:-
AICAEA/HQ/C-9/2017/249-50 dated 31.05.2017 requested you to kindly intervene
and revoke the transfer order.
But, in
pursuance of above mentioned requests, when we had tried to seek meeting with
your good self we were advised to meet the Controller of Accounts to resolve
the issues as you had been proceeding for long leave.
Accordingly, we
met the Controller of Accounts on 2nd June, 2017. All issues annexed
to our letter dated 26.04.2017 and the issue of revocation of transfer orders
of our National level office bearer were discussed with him. He had assured
that, the issue of revocation of transfer of the office bearer and other issues
under his discretionary powers shall be settled by him and rest of the items
shall be placed before you for your consideration after your return from the
leave.
Since no action
was taken by the Controller of Accounts within last three months and our
members in your organization are totally disappointed with the prevailing
situation, we had repeatedly tried to meet your good self personally with the
request of convening a full fledged meeting on all matters.
But, for one
reason or the other, we could not be able to meet you. We were advised by your
secretariat to make our request in writing.
We are
therefore, hereby making a formal request to you to kindly convene a meeting
with the representative of this Association at your earliest convenience.
The issues we
propose to discuss are annexed to this letter as “Items of Agenda”. We shall be
thankful for your kind and early favorable response.

ITEMS OF AGENDA
1.
Revocation of transfer
order of the Association functionary from Ahmedabad to Rajkot.
a.
Shri Naresh Khatri is
one of the democratically elected Asstt. Secretary Generals of All India Civil
Accounts Employees Association which is a recognized Association and he being
stationed at Ahmedabad had been entrusted the task of looking after the welfare
of the employees of entire Gujarat Region. His dislocation from Ahmedabad has
created serious hindrance to the smooth functions of the All India Civil
Accounts Employees Association.
b.
In addition to being the
Unit Secretary of Zonal Accounts Office, Central Board of Direct Taxes Unit,
Ahmedabad, Shri Naresh Khatri is the democratically elected Branch Secretary of
the All India Civil Accounts Employees Association, Gujarat Branch as a whole.
c.
Being one of the
National Executive members of the Association Shri Naresh Khatri has to carry
out the directive of All India Civil Accounts Employees Association and being
the representative of the Branch and the Unit he has to peruse the issues
concerning with the Civil Accounts Employees of Gujarat in terms of the
following orders of the Government of India:-
i.
DOP & AR (Now
DOP&T) OM No:- 10/4/82-JCA dated 19.10.1983 issued vide Controller General
of Accounts OM No:- A-60015/1/77/MF. CGA/XV dated 19.10.1983 (Relating to Unit
functioning)
ii.
Controller General of
Accounts OM No:- A-11019/47/91-92/MF.CGA (A)/750 dated 11.05.1983 containing
the decisions of 62nd meeting of Departmental Council of Department
of Expenditure (Relating to Branch functioning)
d.
As per DOPT OM No:- 2/7/88-CS (IV) dated
19.08.1988, the functionaries of
recognized Unions/Associations including President and Branch Secretaries
should not be dislocated even from main office Building. But Shri Khatri had
been ordered to move to another station.
e.
The transfer order of
Shri Naresh Khatri, Accountant had been issued in total violation of CGA OM
No:- C-11021/63/15/CGA/CVO/Office Guidelines/1419 dated 15.12.2015.
f.
The local administration
of ZAO, CBDT, Ahmedabad do not take care of the issues of the employees or
follow the mechanism of grievance redressal
envisaged in the Controller General
of Accounts OM No:- A-60015/1/77/MF.CGA/XV dated 19.10.1983 and OM No:-
A-11019/47/91-92/MF.CGA (A)/750 dated 11.05.1983 respectively. As such, our
Gujarat Branch had been forced to refer some of the major pending problems
concerning with the employees and functioning of offices to this Central
Headquarters for taking up at your level. Central Headquarters vide its letter
No:- AICAEA/HQ/A-3/CBDT/2017/222 dated 26.04.2017 had accordingly, submitted
those items along with other items of various other ZAOs to your good self and
requested to convene a formal meeting for discussion of these items.
g.
It has been reported by
our Branch Committee members from Gujarat Branch that, due to referring some
among the long list of pending problems of the office to your level, the local
administration of your Ahmedabad office had been feeling uncomfortable with the
situation and on account of this it had sought the transfer of the Chief
executive of the Unit and Branch Shri Naresh Khatri from that office by
leveling allegation against him so that their inactions and anti-employee
activities are not exposed in front of
the higher authorities.
h.
Our Branch Committee has
also brought it our knowledge that some of the officers have been passing loose
and derogatory comment against Shri Khatri and other office bearers that they
are doing “unionbaji” and they shall be panelized for doing “unionbaji”.
It is crystal clear from the above discussed points that
the transfer order issued by the administration of your office against Shri
Naresh Khatri is a vindictive transfer order and such a step has been taken not only with the attempt to
curb the democratic functions of the Associations but to create an atmosphere
of fear among the employees so that they
keep away from taking part in the Association activities and do not dare to
point out the deficiency of administration or speak for their rights.
Moreover, we would like to place it on rerecord that,
using the derogatory word of “Unionbaji” by responsible officers is
untenable. Right to form Association and
participate in Association activities are enshrined in the article 19 of
Constitution of India and the Government of India has kindly extended these
rights to the employees and workers and also to every citizen of the country.
No sensible employees’ organization shall silently tolerate such insulting
remarks in respect of their responsible office bearers or this form of attempt
of belittling the stature of their Associations.
2.
Filling up of vacant
posts in all Zonal Accounts Offices:-
In the Zonal Accounts Office,
CBDT, Cochin post of one LDC and 5 Accountants are vacant since long time.
Similar situation prevails in all offices like Bhubaneswar, Patna, Mumbai,
Kolkata and Chennai etc. Therefore, the vacancies be filled up immediately.
3.
Provision of LDC and MTS
for each section of Pr. Accounts office and each ZAO:-
All offices are in need of these
posts. While the new posts for new ZAOs had been created, these posts were not
created. Three Sr. Accounts Officers are working in the ZAO, CBDT, Cochin. MTS
post has not been sanctioned to ZAO, CBDT, Cochin so far. One Casual worker is
attending all these works. One post of MTS may therefore be sanctioned/allotted
to ZAO, CBDT Cochin and also other offices confronting similar condition.
4.
Rest room for ladies
staff in the ZAOs where 30% employees are women.
5.
Regularization of
temporary status employees – Case of Shillong, Cochin and Bhubaneswar
regarding:-
Shri
Atul Malakar, working in ZAO, CBDT, Shillong as temporary status employee is
yet to be regularized. Since all the documents sought by the Principal Accounts
Office have already been provided by the ZAO, CBDT, Shillong, the
regularization case of Shri Malakar may kindly be settled without any further
delay. Since, there is no MTS in the
office, he may be regularized against the post. Similar situation is there in
ZAO, Bhubaneswar and it may therefore be also settled. Smt. Sarada aged 48
years is working ZAO, CBDT, Cochin for the last 6 years. She may be
regularized.
6.
Strengthening of Internal Audit wing:-
a.
The internal Audit wing may consist of one AO, one
AAO and two Sr. Accountant/Accountant. Otherwise it is very difficult to
complete the work in time bound manner. In Cochin the Audit work is entrusted
with one Sr. AO, one AAO and one Accountant. One more Accountant may be posted
in Audit wing.
b.
Routine works such as pay fixation, anomaly,
Post-check, verification of qualifying service etc. may be excluded from the
Internal Audit wing. Because, to complete these works department have to send
service books to Accounts Office. Most of the time the Audit party in tour as
per approved tour programme and the service books of the department staffs have
to be kept pending in the Accounts Office and it causes some grievance from the
department.
7.
Settlement of all pending Compassionate appointment
cases:-
In the discussion on 26.12.2016,
it was assured that DPC shall be conducted soon in respect of the cases
mentioned below-
a.
Shri Ajay Bagchi, S/o late Shri Arnab Bagchi, Senior
Accountant expired on 28.10.2012 Kolkata.
b.
Mrs. Potana, w/o late Shri H.B. Potana, Senior
Accountant Ahmedabad expired on 12.05.2015.
c.
Smt. Archana S, widow of late Sri. S. Suresh, Senior
Accountant, FPU Calicut expired on 08.01.016.
8.
Grant of adhoc
Promotion:-
As per the
recommendations of ZAO, CBDT, Cochin adhoc promotion to the part of Accounts
may be granted.
9.
Settlement of all transfer requests:-
Under
mentioned transfer requests have been forwarded on sympathetic ground to your
office by the authorities concerned and these are yet to be considered
favorably.
i)
Shri Vikas Mandal, Acctt. ZAO, CBDT, Cochin to
Ranchi/Kolkata/Durgapur. The request of the official has been forwarded
by Dy. CA, CBDT, Chennai vice letter No.ZAO/ CBDT/ CHENNAI/CDN/2015-16/372-73
dated 14-09-2015.
ii)
Shri P.A. Azeez, Sr. Accountant ZAO, CBDT, Hyderabad to PAO,
GSI, Hyderabad. Official has submitted representation on 02.02.2017 through
proper channel.
iii)
Shri Rahul Gupta, Sr. Accountant, Pr. CCA, CBEC, New Delhi to
ZAO, CBDT Kanpur/Lucknow. Case has been recommended by the office of Pr.
CCA, CBEC vide letter No/1(33)13/unilateral/pt.III/2015-16/882 dated
1`1-12-2015.
iv)
Shri Santosh Kr. Barnwal, Acctt. PAO,
Printing, Nasik to ZAO, CBDT Durgapur. The issue is pending for
consideration in the Pr. Accounts Office, CBDT.
v)
Mrs. Somrita Mustafi Sabui, Sr. Acctt. PAO, H&FW,
Kolkata to ZAO, CBDT, Ahmedabad. CCA, MH&FW vide
letter No:- Pr.AO/Admn/1(1)/transfer posting of Acctt/Sr. Acctt/2016-17/3054

***Shri Amulya Parida Requested for granting
ante-date promotion as Sr. Acct. w.e.f. 01.04.2014 after granting
inter-se-seniority in the grade of Accountant (direct recruits). It is learnt
from the CBDT HQr that the case has already been sent to o/o the CGA & now
decision is pending with o/o the CGA.
11.
Incentive to ZAO staff regarding:-
TARANG-Scheme – a free BSNL SIM
card scheme offered to CBDT staff (Income Tax Department) under 1% incentive
scheme on Direct Tax Collection. This facility may be extended to ZAO staff
because they are also a part of CBDT collection work such as daily reporting of
CBDT collection and checking of delay in remittance to Govt. Account etc. More
over the ZAO staff are fully entrusted with establishment matters of the Income
Tax Department. In the same way, Railway Department has provided travelling
pass to Railway Accounts staff and the Defence Department also provided Canteen
Facility to Defence Accounts staff.
12.
Removal of outsourced
employees working against Accountant and Sr. Accountant:-
Outsourcing persons are working
in the post of Accountant/Sr. Accountants.
Moreover they are handing the work on computer using departmental
software. These persons should be removed from Pre-check Unit Ahmedabad immediately,
as work of PCU is conducted on the basis of rules and regulation of Central
Govt. which cannot in any condition be given to the staff of agency of
outsourcing. The key and passwords for operating payments are given to them is
not in the interest of Govt. safety and security. This may please be ordered to
stop.
13.
Proper internet
connection to ZAO, CBDT, Ahmedabad:-
Internet connectivity in server
is not available even at the time of Accounting period. Separate Net connection
should be provided to Revenue section of the office.
14.
Rotational transfers in
ZAO, CBDT Ahmedabad:-
In
ZAO Ahmedabad rotational transfer has not been done for last 7-8 years. No
action has been taken by the local administration in spite of instructions
issued by the office of Pr. CCA, CBDT.
15.
Proper office
accommodation for ZAO, CBDT, Ahmedabad:-
Office building of Zonal Accounts Office, CBDT,
Ahmedabad is working at 2nd Floor of Vasupujya Chambers, Ashram
Road, Ahmedabad. During the earthquake of 2001 this building was severely
damaged and owner of the building has not paid any attention toward repair and
maintenance of the building. Moreover heavy rains in past years after 2001 have
damaged the base of this building. Now building is not in good and usable
condition. Income Tax Department has also vacated its office from this building
due to the same reason. Building may collapse at any moment.
In revenue section there
are 28 banks preparing and sending scrolls from 020 to 030 heads. Weigh of the
scrolls each date is very heavy and being dumped on 2nd and 3rd
Floor since 2005. These weights has crossed all the limit of safety and
flooring of third floor has lost its capacity to bear more weight and may
collapse at any time costing lives of staff of Zonal Accounts Office,
Ahmedabad. Moreover theses papers of scrolls may catch fire at any moment as
there is no provision of fire safety and security.
16.
Grant of annual
Honorarium to all employees without discrimination:-
Many offices have not
been granted annual honorarium for more than two years. Hence all employees may
be granted annual honorarium without any discrimination. When discussed on 26.12.2016, it was assured
that the request of the Association shall be considered.
17.
Imparting Training to
staff:-
a.
All staff of the level
of Group-C may be given PFMS training.
b.
Frequent Training may be
given to all staff in the RTC regarding Accounts and establishment matters.
