            I am directed to refer your office letter No:- A-11019/25/2015/MF.CGA (A)/NGE/AICAEA/HQ/350 dated 18.09.2015 and state that the Delhi based National Executive members of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category – II had handed over a memorandum bearing No:- AICAEA/HQ/A-2/2015/519 to your kind self on 2nd June 2015 with the request of convening a meeting with the National Executive members of both Associations.

            Since there has been no discussion on these items so far, the extended National Executives meeting of this Association held on 23rd & 24th September 2015 in Delhi has directed me to inform you that, the list of the items submitted by us through our memorandum dated 2nd June 2015 may kindly be considered as the Agenda item for the meeting to be held on 16.10.2015.

Subject: - Recruitment Rules of AAOs – Regarding.

Sir,

            In response to the above mentioned letter of your office, we would like to inform you that, opinion was sought from our Branches and Units on the proposal of your office to create the post of Supervisor (Accounts) in place of the 10% promotional quota for promotion of Senior Accountants as AAOs. On the basis of the opinions given by our Branches and Units we would like to submit the following:-
1.                  From the very date of inception of Civil Accounts Organization, the All India Civil Accounts Employees Association had been demanding reservation of 50% posts in the cadre of JAO (at present AAO) for promotion of Senior Accountants on seniority cum fitness basis. But the Civil Accounts authorities were never been considerate enough and agreed to concede this demand. As a result, large numbers of highly skilled Accountants/ Senior Accountants, most of whom were graduates, had been forced to retire from service after working in the same post for their entire service length. Obviously, the basic cadre of Accountant/ Senior Accountant was extremely frustrated and agitated in their minds.  However, due to sustained struggle by the All India Civil Accounts Employees Association up to the extent of Indefinite fast and strike actions etc., the Civil Accounts authorities had finally agreed in the year 2000 to reserve 10% posts in the cadre of JAO for promotion of Senior Accountants. The other important angle of making such a provision was to pave the way for the ACP benefit to Senior Accountants which was implemented by the Government on the basis of the recommendation of 5th CPC in 1999.The CCAs (JAO and AAO) Recruitment Rules, 2000 stipulates that  90% of the post shall be filled up from the seniority list of persons who have passed the Junior Accounts Officer (Civil) Examination and 10% of the post in the grade of Junior Accounts Officer shall be filled up by promotion from  a common seniority list to be drawn up and maintained by the CGA of Sr. Accountants who have rendered not less than 10 years service in the grade on the basis of selection cum seniority and who have crossed the age of 53 years as on 1st January of the year.
The 6th CPC had recommended for delayering of cadres. The Government of India had adopted this recommendation and made applicable in respect of Central Secretariat cadres. The Government had also asked all departments to follow the procedure. In terms of these guidelines, the authorities of CBEC, CBDT have amended the Recruitment Rules to improve the service conditions of their employees. While implementing the 6th CPC recommendations, Government had merged the posts of Junior Accounts Officer and Assistant Accounts Officer and created single cadre of AAO (Gazetted).  So the post of Junior Accounts Officer ceased to exist in the Central Civil Accounts organization with effect from 01.01.2006 and all JAOs irrespective of their merit or seniority had been elevated to the posts of AAO.
The original demand of the All India Civil Accounts Employees Association being reservation of 50% posts of JAOs for promotion of Senior Accountants, provision of 10% of the posts of JAO available at present is in fact less than 2% of the total number of posts of AAOs. Moreover, the cadre of JAO being non-existent, it can no longer be a determining factor for fixation of promotional quota for the Cadre of Accountant/ Senior Accountant.
Hence, the cadre of Accountant/ Senior Accountants being more than three times bigger than the cadre of AAO, 30% of the total number of the post of the cadre of AAO should be available for promotion of the cadre of Accountants/ Senior Accountants which is most logical and totally justified demand of the Association.
2.                   Though the Civil Accounts organization is being identified as a part of the organized Accounts cadre, but the functioning of Civil Accounts organization and facilities available with the organized Accounts cadres of other Accounts and Audit organizations are not comparable. A few examples are as discussed below-
a)      Civil Accounts organization is spread over more than 40 Ministries/Departments of the Government of India. The Ministries and Departments are functionally different from each other. Naturally, these conditions are reflected on the Accounting and payment functions and the Civil Accounts employees are required to adjust with such conditions for ensuring the smooth payment and Accounting functions. This condition is totally different from other accounting organizations where the accounting setup is required to deal with only one department/Ministry.
b)      The Civil Accounts organization is technically most advanced organization and responsibilities on each and every cadre of Civil Accounts are more in comparison to other organized Accounting cadres. All cadres of Civil Accounts organization have accordingly been trained and equipped by the Civil Accounts authorities. Unlike other Accounts organizations, payment and accounting activities take place through tiny Pay and Accounts/Zonal Accounts Offices in Civil Accounts Organization where Accountants and Senior Accountants require sharing more responsibilities than their counterparts working in other organized Accounts. Moreover, there are several instances where the Accountants and Senior Accountants are independently handling the accounting and payment functions. Those are ;-
i)                    Field pay units of CBDT and
ii)                   Offices under merged DDO scheme.
c)      All cadres of Civil Accounts Organization bear All India transfer liability on them. The AAOs of Civil Accounts organization require to serve anywhere in India. No all India transfer liability is there for the Accountant, Senior Accountant and AAOs working in IA&AD or other Organized Accounts departments.
d)      The Accounts Employees working in Railways are having the privilege of availing Railway pass on par with the Railway employees while such type of a facility is not at all available with the Civil Accounts Employees.  
e)      The Defence Accounts Employees are permitted to avail the Defence Canteen facility where all consumer items are sold with heavy subsidy. Such type of facility is far from the dream of the Civil Accounts Employees.
f)       Departmental pool accommodation facilities are available for all organized Accounts cadres except Civil Accounts Employees.
So, the cadres of  Civil Accounts organization being in  different footings  of higher responsibility with less privilege  and  functional requirements of the organization being different, the Civil Accounts  organization could have its own cadre regulation/promotion policy which need not essentially be exactly same to another department or organization.
3.                  The letter of your office under reference is silent about following pertinent issues which could lead us to the stage for formulating a considered view :-
i)        Pay scale and grade pay of Supervisor (Accounts)?
ii)      Number of posts likely to be earmarked as Supervisor (Accounts)?
iii)    Procedure under which the posts shall be distributed Ministry/Department wise and Station wise?
iv)    Status and responsibilities of Supervisor (Accounts)?
v)      Whether Supervisor (Accounts) shall be given the facilities that are available for AAOs?
vi)    Whether the existing condition of age bar of 53 years shall continue as one of the eligibility conditions for promotion.
vii)  Whether the Sr. Accountants who have already been promoted as AAO against 10% promotion quota shall be re-designated/reverted as Supervisor (Accounts)?
viii)Whether the employees from other departments who have been inducted laterally in the cadre and accommodated as AAOs simply on the ground that they were drawing the Grade Pay Rs. 4800/- in their parent department and who are not AAO(C) passed officials shall be redesignated/reverted as supervisor (Accounts)?
            Therefore, being unable to reach to any conclusion due to the above discussed situations,         I have been directed to request you the following:
1.       kindly to direct your office to provide us
(a)   the proposal(s) of your office on the points discussed in Sl.No.3 and
(b)   the proposal(s) for amendment(s) in the Recruitment rules of different relevant cadres
2.      Convene an exclusive meeting on the subject matter with the representatives of the Association so that a final conclusion could be there at an early date.

               We the undersigned do hereby forward a self-explanatory Resolution adopted in the meeting of this Co-ordination Committee held in Delhi on 23rd September, 2015.

               The Resolution contains the requests for immediate cadre review of Gr. B& C cadres including MTS and adoption of a mutually agreed transfer policy which embraces the totality of the Gr B and C Civil Accounts Employees.

               Since, the resentment has been precipitating among the officers and employees who are being represented by this co-ordination committee,  we request you to kindly open meaningful dialogue with the representatives of the co-ordination committee and take early favourable action to settle the demands.

RESOLUTION

               This meeting of the Co-ordination Committee of the Civil Accounts Employees and Officers Associations held in Delhi on 23rd September, 2015 under took a review of its demands of – 1. Cadre Review of Gr. B & C Employees, 2. Filling up of vacant posts and 3. Adoption of a mutually agreed transfer policy.  In fact the Co-ordination Committee had requested the Controller General of Accounts to kindly negotiate with the representatives of the Co-ordination Committee which represents All India Civil Accounts Employees Association, All India Civil Accounts Employees Association Category – II and All India Association of Pay and Accounts Officer (Civil) and settle above discussed demands at an early date. But the Controller General of Accounts has preferred to ignore the request of the Co-ordination Committee.

               However, the Controller General of Accounts vide his office letter dated 11.09.2015         conveyed to the All India Civil Accounts Employees Association that-
               The proposal for Cadre Review of Gr. B&C Cadres interalia recommending higher pay in        each grade was sent to department of expenditure by the Controller General of Accounts. But the Department of Expenditure has drawn the attention of Controller   General of Accounts to the instruction contained in its OMs. Dated 7.1.1999 and 29th  October 2014 and directed the office of Controller General of Accounts review its proposal. The Department of Expenditure further informed Controller General of Accounts that the revision of Pay in respect of Civil Accounts Employees will not be done      in isolation and the same shall be viewed and examined in the larger context of organized accounts services as a whole. Therefore, the matter will be examined by the         Department of Expenditure, Ministry of Finance, in a holistic manner keeping in view      the recommendations of 7th Pay Commission as well.

               Responding to the demand of filling up of vacant post, the Controller General of           Accounts informed the All India Civil Accounts Employees Association that 800 dossiers           for Accountants obtained from SSC have been sent to field offices for filling up of       vacant posts.

               In respect of Transfer policy the Controller General conveyed that the draft transfer     policy shall be made available in the website for comments by all.

               The meeting of the co-ordination committee deliberated on the contents of the above letter of the office of the Controller General of Accounts and noted the following:-

1.      The Ministry of Finance vide its OM dated 7.1.1999 had lifted the ban on cadre review/cadre restructuring and hence it vindicates the justification of the demand of Cadre Review in Civil Accounts which was not done within last 28 years  after 1987.
2.      The OM. Dated 29th October, 2014 of Ministry of Finance has dealt with expenditure management – Economy measure and rationalization of expenditure. Through the OM specific direction for cut in non-plan expenditure seminars and conferences, purchase of vehicles, domestic and international travel and creation of posts etc were given, but no restriction on cadre review and cadre restructuring was imposed. As such, contents of this OM of Department of Expenditure do not enforce any embargo in under taking cadre review.
3.      Cadre Review in majority of the Central Government Departments including Department of Post, CBDT and CBEC etc have been undertaken and implemented.  CBEC & CBDT are the two wings of the Department of Revenue and inspite of the fact that the cadre structures of both the organizations are analogous, the cadre review in these organizations have been conducted separately and implemented. Though it is being said that the cadres of Civil Accounts are a part of the organized Accounts but structurally and functionally the cadres of Civil Accounts are vastly different from the organized Accounts Cadres. Therefore, the decision of postponement of cadre review beyond the implementation of 7th CPC for entire organized Accounts cadre does not stand on justification and hence untenable.
4.      As per the point No .7 of the “POINTS TO BE FOLLOWED BY THE CADRE CONTROLLING AUTHORITIES WHILE FORMULATING PROPOSAL FOR CADRE REVIEW OF GR – ‘A’ SERVICES”, prescribed by DOP&T, the Cadre Review of Group “A” Services should be done after the Cadre Review of Gr. B, C & D are completed. But this basic norm was not observed and the Cadre Review of Gr. A officers of Civil Accounts Organization has been completed and implemented vide Department of Expenditure OM dated 11th March, 2015.
            The meeting of the Co-ordination Committee also observed that the Controller General of Accounts has not sought the views of all constituents of coordination committee on the most important issue of transfer policy inspite of the fact that entirety of the Gr. B, C & D employees of the Civil Accounts Organization are adversely affected by the existing transfer policy and all employees and officers organizations representing these categories have been persistently pleading for adoption of a mutually agreed employee friendly transfer policy.

            In view of the above situations this meeting of the Co-ordination Committee resolves to urge upon the Controller General of Accounts to kindly take note of the views expressed by the meeting and take favourable decision for resolving the grievances of all Group B and C cadres so that  cordial atmosphere prevails in the organization.

DECISIONS OF FEDERAL EXECUTIVE MEETING
Held on 17th July 2015

The very first meeting of the newly composed Federal Executive was held on 17th July 2015 at Chennai immediately after the 14th/6th AICs of AICAEA/ AICAEA Cat-II and 6th National Convention of Women’s Committee were over. The meeting was presided over by Com. G. K. Nair, President, NFCAA In this meeting representatives of AICAEA and AICAEA Cat-II had made brief reporting’s of the decisions taken in the Delegate sessions of the Conferences. On the basis of these reporting, following decisions were taken.-


STRIKE ON 2ND SEPT.2015 & INDEFINITE STRIKE FROM 23RDNOV. 2015


Since the call of strike on 2nd September 2015 has been endorsed by the Joint Delegate session of the Conferences, it shall be implemented unitedly and the NFCAA shall take joint effort to mobilise the members. Joint tour programme shall be drawn up and all federal executive members shall move jointly to make the strike a grand success. Branches/ stations/State/Regions like Uttar Pradesh, Uttarakhand, Bihar, Jharkhand, Chhattisgarh, Odisha, NE, M.P. Rajasthan, Punjab, Haryana and Karnataka shall be visited.   All Branches shall make their own tour programme too and ensure visit of all Units within 15th August 2015. Members should be explained the 12 point charter demands raised by the Central Trade Unions and 10 point Charter demands of the Confederation.
Further, as per convention, joint strike notice shall be served to CGA by both Associations on 11th August 2015 in terms of the direction of the Confederation.


ORGANISATIONAL ACTIONS ON DEPARTMENTAL DEMANDS


In pursuance of the decisions taken in the joint Delegate session, it has also been decided that while visiting the stations, the demand of cadre review and 19 other pending demands should be explained to the members. Importance of the demand of achievement of Cadre Review and its implementation before implementation of the 7CPC recommendations should be explained to the members and they should also be requested to participate in the organizational actions.
Following organizational actions have been adopted by the meeting for persuasion of the demand of Cadre Review and 19 other demands.-
1.     Demands day on 18th August 2015; - On this day, all members shall wear black badge. Unit/ Branch wise lunch hour demonstration at all stations shall be held.
2.     Joint Day Long Dharna on 100th September 2015:- A Joint Day Long Dharna shall be organized by the Branches on 10th September 2015 in front of the office of Sr. most Officer of the station. All office bearers of the Branches of AICAEA and AICAEA Cat-II shall sit for day long dharna by taking leave.
3.     Half day walk out on 14th October 2015:-Totality of the members shall stage half day walk out on 14th October 2015. The modalities about this programme shall be decided and informed to all.  


ORGANIZATIONAL MATTERS


Following decisions were taken by the meeting:-
a)   All Branches (both AICAEA and AICAEA CATII) which have not held their Conferences and Branch level Women Convention shall complete those within 31st August 2015. Alongwith Branch Conference and Women Convention they shall also form the Local level NFCAA as well as COC of Civil Accounts employees and officers and make it functional.
b)   Uniform rate of membership subscription of Rs.80/- shall be there and both Associations shall simultaneously write to the CGA in this regard.
c)   Effort shall be taken by federation headquarters to improve the coverage of the issues and correspondences of both Associations in the Accounts Crusader.
d)   Both Affiliates of NFCAA, in terms of the Article 14 a) of the Constitution of NFCAA, shall remit their due share of quota to federation @10% of the monthly subscription received from the members.  The quota of subscription shall be remitted to the Federation headquarters not later than the 20th of every month and it should commence immediately.




PROBLEMS IN PAO (CG, PDTM), MUMBAI


Attention of the Federal Executive meeting was invited by the Federal Executive Members of Mumbai that, on a suspected misappropriation of the Government money, the Civil Administration has intervened in to the acts of some of the officers of PAO (CG, PDTM), Mumbai. It has created an atmosphere of fear in the office and caused serious problems to the employees working in the office. In consideration of this situation, the meeting passed a resolution urging upon the Civil Accounts authorities to intervene into the affairs and protect the innocent employees from harassments. The meeting appreciated the role being played by the Branches and leadership of the Mumbai Branch in dealing the matter. The meeting also decided that all sorts of help and support shall be extended to the members who are innocent and facing various difficulties

Thereafter the meeting was declared over with vote of thanks to the Chair.
