INDIFFERENT AND ANTI-EMPLOYEE ATTITUDE
OF C.C.A, MINISTRY OF COMMERCE AND HARASSMENT TO THE
EMPLOYEES & OFFICERS
Due to indifferent and adamant attitude of the CCA, Ministry of Commerce
and Textiles towards very serious issues concerning with the employees, it has
been decided that the branches of Delhi, Mumbai, Chennai and Kolkata shall hold
a protest Dharna on 14th or 15th October 2019
in front of Principal Accounts Office, Ministry of Commerce, Udyog
Bhawan, New Delhi and in front of the Pay and Accounts Offices of Ministry of Commerce and Textiles in Mumbai, Chennai and
Kolkata while all other branches shall hold lunch hour demonstration and forward a protest Resolution.
THE ISSUES CONCERNING HARASSMENT TO OFFICERS AND EMPLOYEES ARE:-
1. NON-GRANT OF COMPASSIONATE APPOINTMENT ON
CLASS BIASED OUTLOOK
Shri Sudeep Kumar Mandal, S/o of Late Pradeep Kumar Mandal, Ex-MTS (in
PAO, Supply, Kolkata) was offered appointment as Accountant on compassionate
ground vide order dated 28.07.2017 and asked to submit all documents including
his Medical fitness report and Character certificate etc. Shri Sudeep Kumar
Mandal had submitted all documents within the due date on17.08.2017. Since the
establishment of CCA, Department of Commerce/Supply Division was closed down by
the Government from 1st October, 2017, and the CCA, Ministry of
Commerce was entrusted with the responsibility of the Department in respect of
the residual work, administrative work and other functions it was assured by
the then CCA, Ministry of Commerce to the Secretary General of AICAEA/NFCAA in
an informal discussion that, since the process for appointment in respect
of the person concerned was completed, he would be accommodated against the
vacancies/posts transferred from CCA, Department of Commerce (Supply Division)
to CCA, Ministry of Commerce. But in spite of repeated
representations by the Shri Sudeep Kumar Mandal and request by the All India
Civil Accounts Employees Association for not less than twenty times to the
administration of CCA, Commerce Shri Sudeep Mandal has not been ordered to
report for duty till today.
After the death of late Pradeep Mandal, MTS, his son was brought up by
his mother with lots of miseries. As the meagre pension being received by them
was not sufficient for their survival, wife of late Mandal had worked as
domestic help in the houses and now being a cancer patient, she is counting her
days as she does not have the money for her treatment.
Shri Sudeep Mandal being a member of SC category and being economically
backward deserves priority dealings in terms of the policies of Government of
India. But, the office of the CCA, Commerce is handling his case from the caste
bias outlook and kept him away from joining the Central Government service for
the last two years.
2. NON- SETTLEMENT OF STALEMATE OF PAO, JUTE CELL, KOLKATA
PAO, Jute Cell, under PAO, Textiles, Kolkata was formed with 20
employees including 2 PAO/Sr. AO, 2 AAO in 2017 just at the juncture of closing
down of CCA Supply office. Immediately after joining in the new office of PAO,
Jute Cell, 1 Sr. AO, 1 AAO and 2 Sr. Accountants were posted in two spells in
the office of the Jute Commissioner, Kolkata to pass Jute procurement Bills. It
was assured that it was an interim measure. But even after more than 2 years
they are being forced to work there in an irregular manner and under huge
pressure in software “Jute smart” which is alien to Civil Accounts Organisation.
As per decision taken by the Union Cabinet and the CGA, the Chief
Controller of Accounts, Ministry of Commerce & Textiles vide letter
dated 28.03.2017 had given effect of transferring personals (Sr. AO-2, AAO-2,
Acctt/Sr. Acctt-12, LDC-2, MTS-2) from PAO, Supply Kolkata to PAO, Textiles,
Jute Cell, Kolkata. The RPAO Textile, Jute Cell was established for performing
PAO function for the payment of Jute bills received from Jute Commissioner,
Kolkata. But for this purpose, only one Sr. A.O., one AAO and two Sr. Acctts.
of PAO, Jute Cell, Kolkata have been deployed vide order of Principal
Accounts Office dated 23.08.2017 to the office of Jute Commissioner.
Maintenance of attendance and the salary of all officers and employees of PAO, Jute Cell are being paid from PAO,
Textiles, Kolkata. It is therefore, clear that-
1. 4(four) officers and employees of Civil
Accounts organization placed under the disposal of Jute Commissioner, Kolkata
without any rules of the Government of India.
2. The Jute Commissioner has been functioning as
PAO, Jute Cell in place of PAO and it is being allowed by the Civil Accounts
authorities.
3. CGA has decided to operate the PAO, Jute
Cell, Kolkata without DDO code and PAO, code.
Under the above background the Associations have requested the
following in the interest of Civil Accounts Organization and its employees and
officers:-
i. Re-transfer the 4 officers belonging to PAO,
Jute Cell for all purpose and intent.
ii. Vesting of PAO functions relating to
procurement of Jute bags now being done in the O/o the jute Commissioner to the
PAO, Jute Cell, Kolkata.
iii. Ensuring full functioning of PAO, Jute Cell,
Textiles as PAO, of the office of the Jute Commissioner etc.
But no action in this regard has been taken.
3.
NON
–SETTLEMENT OF MACP CASES
It has been reported by our Mumbai Branch that several MACP cases of
Mumbai offices are pending for more than a year and despite repeated requests
the office of the CCA, Ministry of Commerce has not taken any action in
this regard while as per para 6 of DOPT's O.M’s. dated 19.05.2009 and 18.3.
2015, the Screening Committee should meet twice in a financial year - in the
first week of January and first week of July of the year for advance processing
of the cases maturing during the first-half (April September) and second-half
(October-March) of a particular financial year.
Due to non-settlement of MACPS cases the employees have been denied to
have their legitimate benefits on due time.
4.
NON-FILLING
UP OF VACANCIES
It has been reported by our Tamilnadu and Pondicherry Branch and West
Bengal Branch that the Pay and Accounts Office of Chennai and Kolkata are
suffering from acute shortage of staff, but the office of the CCA, Ministry of
Commerce is not taking any action to resolve the problems prevailing in the
office.
Dear Comrades,
The National Federation of Civil Accounts
Associations (NFCAA) and its affiliates have made several attempts to discuss
the above matters with the Chief Controller of Accounts, Ministry of Commerce
& Textiles and her Controller of Accounts. But none of them had ever agreed
to meet the representatives of this Associations for a discussion on the
pretext of being busy every time as if, resolving the issues concerning
with the employees are not part of their
duties and responsibilities . Not only this, these issues were discussed in the
meeting held with CGA authorities nearly a year earlier. But, CGA authorities
have not taken any action as per the assurances given in the meetings.
Being very rational in its approach, the All
India Civil Accounts employees Association vide No:-AICAEA/HQ/A-2/2019/515-517
dated 03.10.2019 has once again requested the Chief Controller of Accounts,
Ministry of Commerce & Textiles to kindly arrange a discussion on the
issues discussed above for their settlement through mutual dialogue.
Secretary, Ministry of Commerce has also been appraised about the situation
created by the CCA, Ministry & Textiles and CGA has been requested, kindly
to intervene and resolve the matter. But, there is no response so far.
Therefore, it is that background under which the decisions of holding
Dharna and demonstrations on 14/15 October, 2019 have been adopted. The programme
may be organised on any of the dates mentioned above. It should start at 11am
and continue till 4pm at-least. All of you are requested to appreciate the
situation under which the protest programmes have been decided and implement
the programmes accordingly.

Resolution is annexed to this circular for convenience of all of you. Please
send the resolution to all concerned.

RESOLUTION
This joint Lunch
hour meeting of the officers and employees of Civil Accounts organization being
held today the 14th/ 15th October 2019 under the banner of National Federation of Civil Accounts
Associations( represented by All India Civil Accounts Employees Association and
All India Civil Accounts Employees Association Category II) at………………………records
its strongest protest against the indifferent attitude of the Chief Controller
of Accounts, Ministry of Commerce and Textiles towards the issues concerning
with the employees and officers of the Civil Accounts Organisation and demands
immediate settlement of following issues:-
- Observing procedures
prescribed by the government in respect of compassionate appointments and
immediate arrangements for compassionate appointee to join the duty who
was declared eligible by authority itself and is pending for more
than two years - who has submitted all documents including medical fitness
and character certificate on17.08.2017 - whose mother is a cancer victim -
who is from a backward caste and passing days in half-starved condition
after the death of his father.
- Re-transfer the 4
officers belonging to PAO, Jute Cell for all purpose and intent -vesting
of PAO functions relating to procurement of Jute bags now being done in
the O/o the jute Commissioner to the PAO, Jute Cell, Kolkata - Ensuring
full functioning of PAO, Jute Cell, Textiles as PAO, of the office of the
Jute Commissioner etc.
- Following the DOPT
Rules and orders on MACPs regarding holding DPC six months in advance
- grant of MACPs benefits to all eligible officials of Mumbai
pending for more than a year.
- Filling up of all
vacant posts in the offices of Kolkata and Chennai immediately.
The meeting urges upon the
authorities to kindly settle above issues at the earliest so that ongoing
congenial atmosphere in the department continue to prevail.
The meeting resolves
to forward the copies of the Resolution adopted to the Hon’ble Chief Controller
of Accounts, Ministry of Commerce & Textiles, Udyog Bhawan, New Delhi
