Subject:- Harassment –
Non-finalising the pension case for three months by raising piecemeal
objections against the already settled old pay fixations by infusing unrelated
Govt. orders and ignoring the relevant orders – case of Shri. V Bhattacharjee, AAO
(ad-hoc)
Madam,
We the
undersigned have been directed to refer to the representation of Shri V.
Bhattacharjee, AAO (ad-hoc) and Ex-Secretary General of AICAEA, retired on
31-03-2020 which is self-explanatory (copy enclosed).
It is clearly evident from the contents of the
representation that the PAO, CGST, New Delhi is harassing Shri V. Bhattacharjee
intentionally by not paying his pension for the last 3(three) months without
any valid reason. She has unsettled the already settled pay fixation cases of
Shri Bhattacharjee which are more than 20 years old (probably) on the plea of service
verification which in fact does not fall under her purview as per the rules and
that too by infusing unrelated Government orders.
Moreover, discontinuing the Qualification Pay of
Shri V. Bhattacharjee abruptly and arbitrarily on the pretext of re-fixing the pay
retrospectively and by challenging the standing orders of the Ministry of Finance
as well as the Controller General of Accounts are the clear indications of vindictive attitude on the
part of Sr. AO, PAO, CGST, New Delhi.
These apart, service verification of employees
after completion of 18 years of service is mandatory as per Rule 32 of CCS
(Pension) Rules and the concerned employee/officer cannot be held responsible
if no such verification was done by the office.
Further, as per the instruction of the Government
of India, onus of operating
Bhavishya portal rests with the DDO/HOO/PAO. As instructed in the system, it
should be ensured that in no case pension case be delayed on account of
non-familiarity with Bhavishya. Further, if retiree is unable to fill the form,
HOO is to fill the form on behalf of retiree. But in the instant case, it has
been observed that, the Sr. AO is now advancing the plea of non-filling the
Bhavishya by the retiree was the cause of delay in settlement of pension while
in no stage earlier than 22nd June 2020 the retiree was asked to
file his papers through Bhavishya portal by the Head of Office. Therefore, the grounds on which the pension case has not been
finalised for three months are very irresponsible and vindictive form of
actions.
The Associations record its vehement protest
against the un-sympathetic attitude of the administration of Pr. CCA, CBIC towards
an employee who served the department for more than 35 years and deplore the
actions of the Sr. AO, PAO, CGST, New Delhi for her disregardful and retrograde
outlook towards her official duties and responsibilities and her innate inhuman
attitude towards the elderlies and senior citizens.
Our members are very much enraged after learning
the fact as this undue delay in payment of pension and pensionary benefits of
their former Secretary General have violated the basic human rights of a senior
citizen who worked for more than 35 years and who is starving just because of
the adamant stand of a Sr. AO, who doesn't care for retired persons and unsettled
already settled pay fixations with the ulterior motive causing harm to an
individual.
The Associations therefore, urge upon you to kindly
intervene personally and ensure release of pension and pensionary benefits of
Shri V. Bhattacharjee, former Secretary General, AICAEA with correct pay
fixations at the earliest.
The Associations further request you to initiate appropriate departmental action against the errant officer concerned
for dereliction of duty on one pretext or the
other.
