Subject: Grant of benefit of II ACP to Sr. Accountant appointed as Accountant on passing departmental competitive examination conducted by SSC.

Sir,

            In connection with grant of IInd ACP to those who were appointed as Junior Accountants on the basis of the results of departmental competitive examination conducted by the SSC during the years 1981 & 1982, we would like to draw your kind attention to the following few lines:-

1.      The candidates who had qualified the departmental competitive examination for the posts of Junior Accountants conducted by the Staff Selection Commission during the year 1981 and 1982 against direct recruitment quota of the respective departments are to be equated with the direct examination conducted by the SSC for the post of Junior Accountant.

2.      Clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol-IV dated 10th February 2000 states that, if relevant Recruitment Rules provides for filling up of vacancies by direct recruitment, induction of a person from lower grade in the next grade through Limited Departmental Competitive examination may be treated as direct recruitment for the purpose of ACPs. However, in such cases, service rendered in a lower pay scale shall not be counted for the purpose of benefit under ACPs.

3.      The CCAs (Group-C) Recruitment Rules provides the provisions for filling up of vacancies in the grade of Accountant through direct recruitment and it fulfills the requirements stated in the clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol-IV dated 10th February 2000.
  
4.      The scheme of granting ACP was introduced in the year 1998-1999, whereas the officials who have qualified the departmental competitive examination prior to the issuance of the DOPT orders should in no way be deprived of this benefit. In fact, the clarification was specifically meant for such officials only.

5.      Further, this scheme has already been implemented in CGA’s organizations offices itself, such as:-

i)                   CBEC:- Pr. CCA, CBEC, New Delhi vide order No. Admn.1 (17)9/ACP Scheme/770 office order No. 164 dated 14/08/2007 (copy enclosed) granted IInd financial upgradation with effect from 01/04/2007 to Sh. A. J. Kulkarni (PAO, CEX, Pune). He had qualified the departmental competitive examination conducted by the SSC in the year 1981.

ii)                 CBDT:- Pr. CCA, CBDT, New Delhi office order No. Admn.ii/5-23/ACP/Sr.Acctt/2005-06/486 dated 16/23.03.2007 (copy enclosed) granted IInd financial upgradation with effect from 06/08.07.2007 to Shri S. N. Kaulgud, ZAO, CBDT, Pune. He had qualified the departmental competitive examination conducted by the SSC in the year 1982. Incidentally it is placed for your information and record that Shri S. N. Kaulgud of PAO CBDT (Roll No-018 rank No.-11) was granted 2nd ACP but Shri Subhash Chander Bamramra (Roll No. 010 rank No.-6) at present working under CCA, Ministry of External Affairs, has been deprived of the same benefit while both of them had qualified the same examination in the year 1982.

            There may be many other cases who might have been accorded the benefit of 2nd ACP.

            Therefore, on behalf of this Association, I request you to kindly take early favorably action on this matter so that the deprived section of employees get rid of the suffocation they have been facing due to non-receipt of their legitimately due benefit.

ACHIEVEMENT OF THE ORGANISATION
There are large numbers of Senior Accountants who are not covered under the seniority list for promotion as AAO under 10% promotional quota. Three such members from CBEC (one from Delhi and two from Kolkata) who were due to retire on 31st March had approached Association after their requests to grant them promotion as AAO at least on adhoc basis before their retirement were rejected by the authorities in terms of the pare 7 of the CGA office OM. No. A 320/2/2010/MFCGA/Acting AAO/443 dated 21.09.2012 which states that for grant of promotion as acting AAO, concerned administration should move the proposal atleast six month ahead of the retirement of the individual.   
Com. V. Bhattacharjee, Secretary General and Com. A.K.Mehta, President, AICAEA CAT II met CGA on 28th March 2013 and requested him to remove the para 7 of the above OM so that all Senior Accountants are granted the  benefit of promotion as AAO.
CGA responded in a very positive manner and directed his office to remove the para 7 of the OM Immediately. As such these three members got the benefit and all Senior Accountants shall be eligible for promotion as Acting AAO before their retirement in future.

Subject: Payment of higher pay scale to Sr. Accountants onwards effectively from -01-01-1996 instead of from 19-02-2013.

            I am enclosing herewith copies of the following judgment on the issue of payment of arrears for the period from 01-01-1996 to 18-02-2013 arising due to upgradation of pay scale of Accountant/Auditor/ Sr. Accountant/Sr. Auditor onwards.

            1. WP(C).No. 22276 of 2007 (Z) of HC of Kerala
            2. Special Leave to Appeal (Civil)....../2013 CC 1997/2013, Supreme Court of India

            The Sr. Accountants/Auditors and others have also been denied the arrears for the above period and therefore, being similarly circumstanced the benefit of above judgement need to be accrued to the affected Sr. Acctt/Auditors and others.

In order to comply with above judgement the order issued by vide F.No. 6/82/E.III (B)/91, MoF&CA, Deptt of Expenditure dated 28th February 2003 by the Secretary Department of Expenditure will have to be modified and instead of notional upgradation of the pay scales for the period from 01-01-1996 to 18-02-2013 shall have to be made effective upgradation.

            I therefore, request you to take up the matter with the Secretary, Department of Expenditure with the request to comply with the above judgment and sanction payment of arrears for the above period arising due to upgradation their pay scales and oblige.
