OBSERVANCE OF 40TH CIVIL ACCOUNTS DAY
 ‘Civil Accounts Day’, 2016 to mark the 40th Anniversary of the inception of the Indian Civil Accounts Service was observed on 1st March 2016 in Plenary Hall, Vigyan Bhawan, New Delhi from 12.30 pm onwards in two sessions.
Shri Pranab Mukharjee, Hon’ble President of India, Shri Arun Jaietlay, Hon’ble Finance Minister of India, Shri Shashi Kant Sharma, Hon’ble Comptroller and Auditor General of India, Sh. Ratan P. Watal, Hon'ble Finance Secretary & Secretary(Exp.) attended and addressed the session.
Welcome address was offered by Shri M.J.Joseph, Controller General of Accounts. He concluded his opening speech by acknowledging the contributions of his predecessors, colleagues and staff for their contribution towards the growth of the Indian Civil Accounts Service.

Subject: - Filling up of vacant of posts of AAOs by granting promotion to the eligible candidates declared as passed in the AAO (Civil) Examination 2014 and on seniority basis.

Sir,
            I have been directed to draw your kind attention to the fact that, several posts in the grade of AAO are lying vacant in different parts of the country. Due to this, the works in the organization are suffering very badly. It is more than a year, majority of the existing AAOs are bearing the burden of attending additional work load of other AAOs and most of the Senior Accountants are performing the duties of AAOs due to non-availability of AAOs so that the payment and Accounting functions of the Government of India continue smoothly.
            In addition to the above situation, many AAOs are awaiting transfer to their choice stations on completion of their tenure and their families are suffering in different manners.
            But on the other hand, the candidates who had qualified the AAO (Civil) examination 2014 have been awaiting their posting orders as AAOs for last one year and no promotion under 10% seniority promotion quota was granted to any Senior Accountant to the post of AAO in the year 2015. Moreover, inspite of existence of an order of your office, all senior most Senior Accountants of the organization are retiring from service without even getting the benefit of adhoc promotion as AAOs.
            In the discussion held with your good self on 11th December 2015, you had kindly informed me that, work is in progress to resolve the problem and soon a decision shall be taken to grant promotion to all eligible candidates as AAOs. But even after three months no decision has been taken.
            Further, our Branches from different parts of the country have brought the following facts to our knowledge recently-
1.      While giving reply to an application under RTI Act 2005, your office vide a letter dated 16th October 2015  informed the applicant concerned  that the existing panel of candidates who qualified the AAO (Civil) examination 2014 shall remain valid till 30th March 2016.
2.      In response to a D.O. Letter dated 26.10.2015 of the office of Controller General of Accounts, the Finance (Accounts) Department of Government National Capital Territory of Delhi invited applications from the employees of Delhi Government for posting as AAOs on deputation basis in the Civil Accounts organization.
Sir, above situations has generated wide resentment among the membership of this Association spread throughout the country. The members are astonished to find that the authorities have decided to bring persons form other departments as AAOs on deputation basis overlooking the availability of qualified and eligible candidates in the Civil Accounts organization itself.
Therefore, I on behalf of the Association seek your kind and personal intervention in to the matter and request you to kindly protect the interests of the Civil Accounts employees by taking following favourable actions -
1.      Issue orders for posting of all candidates qualified AAO (Civil) examination, 2014 before 31st March 2016.
2.      Grant promotions to the Senior Accountants as AAOs who are eligible for promotion under 10% promotion quota.
3.      Issue orders for transfer of the AAOs completed their tenure posting period and awaiting posting to their choice stations.
4.      Cancel the decision of your office to bring persons from other departments/ organizations as AAOs on deputation basis and grant adhoc promotions to the eligible persons of Civil Accounts organization itself in case vacancies exist after issuing orders for promotion to the persons discussed in Sl. No. 1 and 2 above.

Sir,
                With reference to the above mentioned subject, I am to state that, since no AAO (Civil) examination was conducted by the CGA authorities after October 2014, the existing and future candidates have become totally disappointed and they are suffering from various apprehensions.
            In this connection, I would like to refer the discussion held with your good self on 11th December 2015 in your chamber wherein you were kind enough to inform me that the continuity of the AAO (Civil) Examination would be maintained and soon a decision shall be taken by the authorities to conduct the examination for the year 2015. But no decision to conduct AAO (Civil) Examination for year 2015 has so far been learnt to be taken by your office. 
            Moreover, the examination for 2016 has become due and as per schedule, the examination is to be held in the month of October-November 2016.
            Therefore, the AAO (Civil) Examination being the only available corridor for the career advancement to the Group-C Civil Accounts Employees, I request you to kindly appreciate the plight of the employees and take an early decision to conduct the examinations.

Dear Sir
            Kindly refer to the NJCA letter dated 10th December 2015 conveying you the decision of the National Joint Council of Action to go on indefinite strike in  pursuance of the Charter of demands submitted there-with, if no settlement through bilateral discussions is brought about.
            I am also to invite your kind attention to the discussion the Empowered Committee of Secretaries chaired by you with Standing Committee of NC of JCM on 1st March 2016 where-in while summing up the discussions on the charter of demands you assured that a fair consideration would be given on all demands raised by the Staff Side. It was also stated by you that reasonable time should be given to the Government since the issues concern inter=departmental consultations.
            The NJCA in its meeting held on 7th March 2016 considered the request made by you. To give space for negotiated settlement on the charter of demands raised by the Staff Side it has been decided to defer the commencement of the indefinite strike to 11th July 2016 and to serve the strike notice on 9th June 2016, if the desired settlement through bilateral discussions is not brought about.
            It is requested that in the intervening period the Government may hold meaningful negotiation with the Staff Side, JCM so that a settlement could be reached on the Charter of demands raised by the staff side, in the interest of industrial harmony.

Dear Comrade,

          The NJCA met today and reviewed the discussion in the meeting of Empowered Committee of Secretaries presided by the Cabinet Secretary on 1st March 2016 where-in the Cabinet Secretary had requested for more time to arrive at conclusions on the charter of demands raised by the Staff Side.
          The meeting also considered the situation in the aftermath of the coming into effect of the Code of Conduct with the declaration of election schedule in 5 State Assemblies and the fact that there will be polling on 11th April 2016 in West Bengal and Assam.
          The meeting, therefore, came to the conclusion that it will not be feasible for us to stick to the date of strike as 11th April 2016. Considering the fact that as per section 22 of the Industrial Dispute Act, 1947 with regard to the validity of the strike notice which is not more than six weeks from the date of serving the strike notice, it was also felt that we may have to revisit the issue of serving the notice for strike afresh.
          Considering all the above aspects, the meeting took the following decisions”
1.     The indefinite strike shall commence from 6 am on 11th July 2016
2.     The strike Notice would be served on 9th June 2016.
3.     Massive demonstrations shall be held in all work place on 11th March 2016 in support of the charter of demands and strike decision.
4.     The decision of the NJCA would be communicated to the Cabinet Secretary.
Detailed mobilization programmes would be given later on.

Dear Comrades,

            In order to review of the status of the decisions taken in the National  convention of Accounts and Audit Employees and Officers organizations held on 10th January 2016 and to take further steps, an informal meeting the available representatives  of the apex level JAC was held on  2nd March, 2016  in Association room of the Civil Audit Association, New Delhi.

Since Com. M.S. Raja, Chairman was at Bangalore on organizational tour, Com. P. Prabhakar, President, All India Audit and Accounts Officers Association presided over the meeting.
            It was decided that the views taken by the meeting shall be conveyed to Com. M.S. Raja, Chairman and after his consent actions shall be taken.
            While reviewing, Com. S. Mohan expressed that we should implement the decisions of the Convention and complete signature campaign at the earliest. We should also seek a meeting with the Chairman empowered Committee for implementing the 7CPC recommendations.
            Com. V. Bhattacharjee reported that, all constituents have been requested to complete the signature campaign within 28th February 2016. He insisted for completion of the signature campaign within 10th March, 2016. He further suggested JAC should request all constituents to take all efforts to ensure collection maximum numbers of signatures and simultaneously the apex level JAC should also try to meet the authorities and also the Chairman empowered Committee.
            All others representatives present in the house endorsed the views of the above comrades.
            The meeting also deliberated the formation of CCGGOO Unit in Delhi and appealed upon all organsiations to take steps for formation of CCGGOO Units.
            After deliberations, the meeting took following decisions-
1.      All affiliates shall direct their Units/ Branches/Circles to expedite collection of signatures and send the signature sheets to their respective Central headquarters within 10th March 2016.
2.       Chairman and the Convener shall explore the possibility of having a meeting with the Chairman, Empowered Committee under the banner of JAC of Accounts and Audit Employees and Officers Organizations. A letter shall be issued to the Chairman of the Empowered Committee immediately seeking meeting with JAC. 

  SERVING STRIKE NOTICE ON 11TH MARCH 2016
&
INDEFINITE STRIKE WITH EFFECT FROM 11TH APRIL 2016
It has been decided to take all efforts to make the indefinite strike from 11th April 2016 a thundering success, as per the call of National Joint Council of Action (Railways, Defence, Postal & Confederation). The following decisions of the NJCA are ratified for successful implementation.

It has further been decided in the light of the spirit of the deliberations held in the National Convention of Accounts and  Audit Employees and Officers organizations  in Hyderabad on 10th January 2016 that -
1.     Strike notice shall be served by the constituents concerned on 11.03.2016.
(a)   Common Charter of Demands on which the indefinite strike is to be organized shall be the charter of Demands Part A
(b)   Common charter of demands of JAC shall be charter of Demands part B
2.      Constituents shall participate in the rally on 11.03.2016 at Jantar Mantar, New Delhi and rallies at all state headquarters which shall be organized by the local JCAs and Co-ordination Committees.
3.      Constituents shall participate in the “Solidarity Day” to be observed on 29th March 2016 throughout the country.
4.      Constituents shall participate in the indefinite strike to commence from 11th April 2016.

CHARTER OF DEMANDS
 PART A
1.          Settle the issues raised by the NJCA on the recommendations of the 7 CPC sent to Cabinet Secretary vide letter dated 10th December 2015
2.          Remove the injustice done in the assignment of pay scales to technical/safety categories etc. in Railways& Defence, different categories in other Central Govt establishments by the 7 CPC
3.          Scrap the PFRDA Act and NPS and grant Pension/family Pension to all CG employees under CCS (Pension) Rules, 1972 & Railways Pension Rules, 1993
4.          i) No privatization /outsourcing/contractorisation of governmental functions.                              ii) Treat GDS as Civil Servants and extend proportional benefit on pension and allowances to the GDS
5.          No FDI in Railways & Defence; No corporatization of Defence Production Units and Postal Department.
6.          Fill up all vacant posts in the government departments, lift the ban on creation of posts; Regularise the casual/contract workers.
7.          Remove ceiling on compassionate ground appointments
8.          Extend the benefit of Bonus Act,1965 amendment on enhancement of payment ceiling to the adhoc Bonus/PLB of Central Government employees with effect from the Financial year 2014-15
9.          Ensure Five promotions in the service career of an employee
10.      Do not amend Labour Laws in the name of Labour Reforms which will take away the existing benefits to the workers
11.      Revive JCM functioning at all levels
CHARTER OF DEMANDS
 PART B
1.         Revise the fitment formula and Grant of 26000/- as minimum wage to MTS
2.         Re-designate LDC as Accounts/ Audit Assistant and Grant replacement scale of PB-1 Grade Pay Rs.2400 - i.e. level 4 pay scale of Table 5.Pay Matrix.
3.         Grant of replacement pay scale of PB 2 GP 4200 -- i.e. level 6 pay scale of Table 5 in Pay Matrix to Accountant/Auditor.
4.         Grant of replacement pay scale of PB 2 GP 4600 -- i.e. level 7 pay scale of Table 5.Pay Matrix to the Senior Accountant/ Auditor/Accounts Assistants (in Railways), Divisional Accountants.
5.         Grant of replacement pay of GP 5400(PB-2) to AAOs on completion of four years’ service -- i.e. Pay level 9, in the pay matrix.
6.         Grant replacement pay scale of GP 6600 PB-3 -- i.e.level11 pay scale of Table 5.Pay Matrix to the Accounts/Audit Officer
7.         Grant replacement pay scale of GP 7600 PB 3  -- i.e. level-12 pay scale of Table 5.Pay         Matrix the  Senior Accounts/Audit Officer
8.         Grant Pay scale of secretarial staff working in Account and Audit Organizations at par with Secretarial staff working in the Ministry.
9.         Realign Electronic Data processing staff with accounts and audit cadres at different levels   and Grant of pay scales at the levels of realignments.

10.     Granting qualification Pay to all Organized Accounts and IA&AD uniformly in terms of the recommendations of 7 CPC in Para’s 8.9.43, 44 and 45 respectively.
