Subject :- Grant of the ACP/MACPS benefits to LDCs appointed as Accountant on passing Part I JAO©/ four papers of AAO© examinations.

Sir,

In  the Civil Accounts set-up, LDCs are being recruited directly from Staff Selection Commission  and as per the Recruitment Rules, they are eligible to be considered for promotion as Accountant through following procedure-
(1) Promotion on Seniority basis and
(2) promotion on the basis of limited departmental competitive examination.
Apart from the above two channels of promotional avenue, there is one more channel for getting promotion. That is those LDCs who had cleared JAO(C) Exam. Part-I earlier and now 4 papers of AAO Exam have been promoted/appointed  to the post of Accountant (then Jr. Accountant) and those who had cleared the JAO/AAO Examination have been  appointed as JAOs (Now AAOs).
However,  after the introduction of ACP/MACPs and after the clarifications and guidelines issued by the DOPT from time to time, these issue has now drawn the closer attention and the matter was probed very deeply since  the benefits ACP/MACP is counted from the entry grade in respect of the cases fall under the above category and the entry grade is taken as LDCs for the purpose of MACP benefits.
So as to decide the nature of entry grade to the above referred cases (LDCs clearing Part I/whole papers), the orders issued by the CGA office vide O.M.No:A-3216/7/77-MF-CGA(A) dt:11.01.1978 clarifies that  elevation of LDCs to the post of Accountant on passing of JAO Exam-Part I, is to be treated as appointment as Accountant and such appointment will be accommodated against the Direct Recruitment Quota only. Hence, as per the rule provisions explained in the O.M. of the CGA, the entry grade is Accountant only.  
Further the DOPT being the nodal agency for MACPs  has clarified that, for the purpose of MACP, the first appointment shall be counted from the date of appointment on promotion to the next higher post through LDCE/GDCE and the service rendered in the lower post shall be ignored, provided if:
A         the Recruitment Rules for promoted post stipulates for Direct Recruitment
B          the departmental exam through which the employee is promoted to the higher post is not the one prescribed for filling up promotion quota of the higher post.

From the above, it may be considered that, both the conditions are satisfied in clarification of the issue as explained below:-
            A         Recruitment Rules for post of Accountant provides for Direct Recruitment
            B          The JAO (C) Part-I exam through which LDCs were elevated to the post of Accountant is not the Limited Departmental Competitive Exam prescribed for promotion of LDCs’ to Accountants under 5% quota.
            The point B above is further substantiated with O/o CGA’s OM 1978 which states that, appointment-on-promotion of LDC’s as Accountants based on JAO (C) Part- I Exam. is to be counted against direct recruitment quota and will therefore not affect the normal promotion quota.
Furthermore, it may also  kindly be noted that the Recruitment Rules for the vacancies to be filled against promotional quota in respect of the post of Accountant does not prescribe JAO (C) exam., as a condition nor it is treated as the General Departmental Competitive Exam.
            It may be added  here that the clarification of DOPT issued vide OM dated 10.02.2000 has remain unchanged even after the implementation of MACPs (recommendation of the 6th CPC), as communicated in the Ministry of Railways  with the concurrence of DOPT issued vide letter dated 12.09.2012 (copy enclosed).
            In view of the above factual details, it is now requested that, for the purpose of MACP, the first appointment should be counted from the post of Accountant only, in respect of LDCs who have passed Part I JAO/ four papers of AAO examinations.
            We therefore, request you to issue the orders  in this respect at the earliest.

            I have been directed to refer to the above and state that, in pursuance of the discussion held on 30th May, 2013 in the official meeting between the official side and National Executive members of the All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category – II, the 13th All India Conference of All India Civil Accounts Employees Association held in Kolkata from 9th to 11th July 2013 had adopted a resolution urging upon you to kindly circulate the Ministry of Labour, Government of India, OM No:- 14(113)Misc.RLC (Coord)/2012 dated 23.01.2013 among the Heads of the departments of Civil Accounts Organization with specific instructions to implement the contents of the OM. The Resolution was forwarded to your goodself by this Association vide letter No:- AICAEA/HQ/A-2/2013/903 dated 16th July 2013 along with a copy of the Ministry of Labour OM dated 23.01.2013. But, we have not so far received any information about the favorable action taken on the request made by the delegates of 13th All India Conference of this Association.

            Therefore, on behalf of this Association, I request you once again to kindly issue necessary instructions to all heads of Departments to extend the benefit of Ministry of Labour OM. dated 23rd January 2013 to all Non-regular Employees working in the Civil Accounts Organization.

            A copy of the OM of Ministry of Labour dated 23.01.2013 is enclosed herewith for your kind reference.

AGENDA FOR THE MEETING

1.      Filling up of vacant posts in all cadres.
2.      Grant of annual honorarium to all staff and officers as has been granted in earlier years.
3.      Provision of sufficient office  accommodation/ sitting arrangement with required electricity supply for the staff working in Pr. Accounts office.
4.      Modernization/sitting arrangement in other offices like PAO, Central Excise, New Delhi.
5.      Reimbursement of cost of Briefcase/ official bag/ladies purse to the staff and officers as being reimbursed by other heads of the departments of Civil Accounts Organization.
6.      Repatriation of AAOs working on deputation basis from other departments and promotion of senior most Sr. Accountants even on adhoc basis.
7.      Grant of special casual leave to the representatives of the Associations for attending Association activities as per procedure in practice and followed by all heads of the department of Civil Accounts organization.
8.      Reimbursement of hospitality expenses to the AAOs as being reimbursed by other heads of the departments of Civil Accounts Organization.
9.      Promotion of better employer- employee relations: stoppage of harassment to the employees by local officers.
10.  Local transfers on the basis of policy  and consideration of local transfer requests sympathetically.
11.  Supply of adequate stationery items and supply of towel and utensils etc. atleast once in a year.
12.  Deduction of monthly subscription from the members of the Associations regularly/ monthly and following of procedures of check- off system by the DDOs.
13.   Compensation of the extra work being done by the staff and officers in the year ending.
14.  Payment of TA/DA for performing election duty.

You had kindly agreed to consider my request and assured to take a favorable decision in this respect at an early date. Moreover, while the juniors of Shri Biswas have been accommodated  in Kolkata after  promotion, his request is not being considered. Therefore, he deserves a sympathetic  treatment considering his family condition.

Dislocation of Shri Nambiar shall therefore, create a critical situation for his mother .

Therefore, Shri Subodh Kumar is not in a position to go to Guwahati and his request needs a humanitarian consideration.

Working in Aizwal for nearly two years. His  old aged father is a bypass sugary patient and mother is a patient of depression. His wife is also a patient of thyroid related diseases. As such his  presence in Kolkata is the urgent  necessity for his mental peace and survival of his family. Since he has served at Aizwal, his request deserves sympathetic consideration.

His mother is suffering asthma and other age related ailments.  He is also facing lots of problem in connection with  the education of his 12 years old son.  It has become impossible for him to manage  his family affairs by staying far away from his home town for long period. He may be transferred on the consideration that he has served at very difficult station.
