CONGRATULATIONS

RESPONDING TO THE CALL OF NATIONAL FEDERATION OF CIVIL ACCOUNTS ASSOCIATIONS (NFCAA), THOUSANDS OF CIVIL ACCOUNTS EMPLOYEES FROM ENTIRE COUNTRY HAVE PARTICIPATED IN THE 2HOURS WALK OUT ON 29TH AUGUST 2013 AGAINST THE VINDICTIVE TRANSFER OF 5 ELDERLY SENIOR ACCOUNTANTS OF PAO (PTG.), DELHI  TO CHENNAI, MUMBAI, KOLKATA AND NASHIK. TILL WE PREPARE THIS REPORT WE HAVE RECEIVED THE INFORMATION OF PARTICIPATION OF THE MEMBERS IN THE WALK OUT FROM THE STATES LIKE, DELHI, GUJRAT, MAHARASHTRA, TAMILNADU &PUDUCHERRY, KERALA, ANDHRA PRADESH AND WEST BENGAL. IN THE BRANCHES LIKE KERALA AND MUMBAI NEARLY CENT PERCENT MEMBERS PARTICIPATED.  MAJORITY OF THE UNITS AND MEMBERS OF WEST BENGAL BRANCH, ANDHRA PRADESH BRANCH, TAMILNADU AND PUDUCHERRY BRANCH AND GUJRAT BRANCH HAVE PARTICIPATED IN THE WALK OUT. IN MANY OF THE UNITS OF THESE BRANCHES, WALK OUT WAS TOTAL. EVEN IN SOME ISOLATED UNITS LIKE PAO, CBEC, MADURAI AND PAO, FARAKKA BARRAGE PROJECT CENT PRESENT MEMBERS PARTICIPATED.

THE CALL OF WALK OUT  WAS IMPLEMENTED BY THE BRANCHES ONLY ON THE BASIS OF TWO DAYS’ NOTICE. MANY UNITS AND BRANCHES DID NOT EVEN RECEIVE THE INFORMATION ABOUT THE CALL. ONLY THOSE MEMBERS PARTICIPATED WHO COULD BE INFORMED. THEREFORE, THE PROGRAMME WAS A GRAND SUCCESS.

Subject: - Revoking the outstation transfers of Senior Accountants – request regarding.
                                  

Respected Sir,

          The administration of Chief Controller Accounts (CCA), Ministry of Urban Development (UD) vide an order dated 1ST July 2013 transferred 14 Senior Accountants from PAO (Printing), Delhi to different other Pay and Accounts Offices as a matter of routine. However, out of these fourteen persons, 5(Five) elderly Senior Accountants  of the age profile of more than 50 years in average  who are also Association functionaries have been ordered to move to Chennai, Kolkata, Mumbai and Nashik respectively.
          All the persons represented and tried to meet the CCA, UD personally with the request of reconsidering their transfer orders on humanitarian ground. But the CCA, UD refused to meet and consider their request.
          The representatives of the All India Civil Accounts Employees Association after protracted effort could meet the CCA, UD for two occasions. In both the occasions the representatives of the Association requested him to consider the requests of the persons transferred out of station on humanitarian ground.
          The representatives of the Association, responding to the verbal charges indiscipline leveled by the CCA, UD against the persons concerned, categorically requested him to initiate disciplinary action against these Senior Accountants if they have violated the rules. The representatives of the Association also requested the CCA, UD that, till the persons are proved guilty, they may not kindly be imposed punishment in the form of transfers to out of station through wastage of public money.
          Conceding the request of the Association, the Controller General of Accounts (CGA) had kindly intervened into the matter and advised the CCA, UD to resolve it mutually through discussion with the Association.
          But CCA, UD did not act as per the advice CGA while at the same time he re-transferred 9(nine) other Senior Accountants who were transferred to different PAOs within Delhi during the same period under the same /parallel orders.
We therefore, request you kindly to intervene into the matter and provide justice to the victimized Senior Accountants.

Sir,
            I am to invite your kind attention to this Joint Action Committee’s letter No: JAC/ 03/2013dated: 4thApril, 2013 and your office letter endorsement F No. 6(82)/IC/91(PT.I) on the subject mentioned above. Copy of our letter is enclosed for ready reference.
Subsequent to the rejection of Special Leave to Appeal (Civil) 9832/2013 CC 1997/2013 by the Supreme Court, the Govt of India had moved a Review Petition - Review Petition (Civil) 1494 of 2013 which has been dismissed by the Bench headed by Chief Justice of India n 1st of August 2013. (Copy enclosed.)
            The dismissal of the review petition by the SC makes the judgement of CAT, Ernakulam in OA/671/2003 final.
            The Accountant/Auditor/Sr. Accountant/Sr. Auditor and others were granted the upgraded pay scales along with the petitioners in the CAT Ernakulam (Junior Accounts Assistants in Railways) vide the Office Memorandum F.No. 6/82/E.III (B)/91, MoF&CA, Deptt of Expenditure dated 28th February 2003.
The Accountant/Auditor/Sr. Accountant/Sr. Auditor and others have also been denied the arrears for the above period and therefore, being similarly circumstanced the benefit of above judgement may also be accrued to the affected Sr. Acctt/Auditors and others.
I therefore, request you to comply with the above judgment and sanction payment of arrears for the above period arising due to upgradation their pay scales and oblige.
            In order to comply with above judgement the order issued by vide F.No. 6/82/E.III (B)/91, MoF&CA, Deptt of Expenditure dated 28th February 2003 by the Secretary Department of Expenditure will have to be modified and instead of notional upgradation of the pay scales for the period from 01-01-1996 to 18-02-2013 shall have to be made effective upgradation

Dear Comrades,

  STAGE 2 HOURS WALK OUT ON  29TH AUGUST2013 AGAINST VINDICTIVE TRANSFERS

           

You are aware that the 13th All India Conference of All India Civil Accounts Employees Association held at Kolkata from 9th to 11TH July 2013 took serious note of the vindictive transfer orders issued on 1st July 2013 against 5(Five) Senior Accountants as well as representatives of the Association (of the average of 50 and above) working in PAO (Ptg.), Ministry of Urban Development, Delhi to Chennai, Kolkata, Mumbai and Nashik by the Civil Accounts authorities of Ministry of Urban Development. The Conference had adopted a resolution urging upon the Civil Accounts Authority concerned to review their decision of outstation transfer of Senior Accountants and withdraw the orders as it was against the interest of the cadre. 

The Conference had also directed the newly elected National Executives of AICAEA to approach the authorities and take effort to resolve the issue across the table.

Accordingly, the available Federal Executive members had approached the authorities of CCA, UD to discuss the issue and settle it. After protracted effort, the CCA, UD held two rounds of discussion with the representatives of the Associations. In both the occasions CCA took the position that, the concerned Senior Accountants have been transferred due to keeping the bills pending and not observing the official decorum etc. etc. Moreover, the situation has been further complicated due to approaching the honorable Minister of State for Finance and Minister for Urban Development by some of the individuals transferred. Now, the orders shall be implemented as the Ministers have been briefed and their approval has been taken. However, the concerned Senior Accountants shall be brought back to Delhi after few months.
We had categorically requested the CCA, UD to initiate disciplinary action against the persons concerned if they have violated the rules. But till they are proved guilty, they should not be imposed punishment in the form of transfers through wastage of public money.  Moreover, outstation transfer being against the interest of the employees altogether, it is untenable.
Our Branches of Delhi had verified the authenticity of allegation leveled against the five Senior Accountants. They reported us that all the members of the Unit concerned informed the Branch representatives that the allegations are false and the said senior most Senior Accountants have been victimized by the administration for taking principled stand.
 Due to the adamant stand of the CCA, UD, intervention of CGA was sought by us. CGA had discussed the matter with Secretary General in presence of CCA, UD and advised both to settle the problem through mutual dialogue.
In the meantime, the affected persons had also met the authorities of Ministry of UD and represented for reconsideration of their transfers.
But CCA, UD has not honored the advice of CGA or considered the representations of any of the Senior Accountants while he re-transferred 9(nine) other Senior Accountants who were transferred to different PAOs locally during the period under the same or parallel orders.

The attitude of CCA, UD is thus vindictive, anti-Association and totally against the interest of the Civil Accounts Employees. We are therefore, having no alternative but to resort to organizational action.
 It was decided that, all Branches of the country shall hold day long Dharna on 21st August 2013 preferably in front of the UD Unit of the station and forward resolution to the Controller General of Accounts  and CCA UD urging upon them to resolve the across the table. 
Now we have decided to stage two hours walkout on 29th August 2013 to protect our interst altogather. participate and make the programme a grand success.

The members of the office concerned informed the Branch representatives that the allegations are not correct and the said senior most Senior Accountants have been victimized by the administration for taking principled stand including the stand of not processing the irregular bills of Department of Printing and none of these elderly and responsible persons are having any bad habit of drinking etc..
          The representatives of the All India Civil Accounts Employees Association after protracted effort could meet the CCA, UD for two occasions. In both the occassions the representatives of the Association requested him to consider the requests of the persons transferred out of station on humanitarian ground.
          The representatives of the Association, responding to the verbal charges leveled by the CCA,UD against the persons concerned, categorically requested him to initiate disciplinary action against these Senior Accountants if they have violated the rules. The representatives of the Association also requestred the CCA, UD that,  till the persons  are proved guilty, they may not kindly be imposed punishment in the form of transfers to out of station through wastage of public money.

          Iam directed to refer to our disucussion in your chamber in two occasions  on the matter of withdrwal of transfer orders of  5(five) Seniormost Senior Accountnats from  PAO(Ptg.) Delhi to Chennai, Kolkata, Nashik and Mumbai respectively. In both the occasions you had informed us that, the concerned Senior Accountants have been transferred due to keeping the bills pending and not observing the official decorum etc. etc. Moreover, the situation has further complicated due to approaching the honorable Minister of State for Finance and Minister for Urban Development by some of the individuals transferred. In the meantime, the affected persons had also met you and represented for reconsideration of their transfers .
In response to the request of the Association, honorable Controller General of Accounts had discussed the matter with both of us and advised  to settle the problem through mutual dialogue.
But it is disappointing to find that  while your offce has  retransferred 9(nine) other Senior Accountants who were transferred to different PAOs locally during the period under the same /parallel orders, it did not give any cognigance to the requests of five transferred individuals, requests of representatives of Associations and also the advice of the highest of the organization i.e.CGA. 
We therefore, once again request you to kindly consider the matter favourably and direct your office to withdraw the outstation transfer orders of five Senior Accountants.
We are however, constraint to inform you that, if our request is not considered, we shall be  having no alternative but to resort to organizational action and our  Branches of the country shall hold day long Dharna on 21st August 2013 in front of the UD Units of all stations through out India.

MINUTES OF THE MEETING HELD ON 30.05.2013 AT 04.30 P.M. WITH NATIONAL EXECUTIVE MEBERS OF ALL INDIA CIVIL ACOUNTS EMPLOYEES ASSOCIATION
          A meeting of the National Executive Committee members of All India Civil Accounts Employees Association was held with Controller General of Accounts on 30.05.2013 at 04.30 P.M. to discuss the charter of demands submitted by the Association. The list of participants are enclosed at Annexure ‘A’.
            At the outset, the Controller General of Accounts (CGA) welcomed all the members of the Association. After formal introduction, CGA apprised members about developments within the Organization during last one year. Thereafter, the agenda items were discussed. The outcome of discussions held and decisions taken on each agenda item are as follows: -

(b) Augmentation of staff strength to cater the need for new functional areas of Civil Accounts Organisation.
(a)  (i) Staff side was informed that 730 and 1248 Accountants (total 1978) have been allocated by SSC to CGA office for the recruitment year 2010 and 2011 respectively. 1052 vacancies in the grade of Accountants for the recruitment year 2012 have been intimated to SSC. Action is also being initiated to recruit Para-Military Staff on deputation basis in CCAS cadre.
(ii) Accountants who are on deputation with this organization are being absorbed in accordance with provisions contained in Recruitment Rules.
(iii) Staff side was requested to furnish the copy of Ministry of Labour’s OM dated 23.01.2013 regarding regulation of pay and service condition of contract workers so as to enable us to examine the matter.
(b) 1215 Group B & C posts have been created in various Ministries/Departments including CGA office till date. Process is still continued and more posts will be created in due course in CCAS cadre.

Cadre Review in the Civil Accounts Organisation on functional requirements and grant of appropriate Pay & Grade pay to different cadres.
(b)   MTS – Grade Pay Rs. 1800/-
(c)    Accounts Assistant – Grade Pay Rs. 2400/-(By upgrading the post of LDCs)
(d)   Senior Accountant – Grade Pay : Rs. 4600/- (Posts of Accountants to be merged. DEOs are to be re-designated as Sr. Accountants and merged with their existing strength.)
(e)    AAO - Grade Pay Rs. 5400/- in PB-2. 30% posts by promotion of Sr. Accountant on seniority with removal of condition of 53 years of age for eligibility and 70% by AAO© examination.
i)    The staff side was informed that the pay scales/grade pay have been granted to various categories of employees of CCAS cadre as per recommendation of Sixth Pay Commission. It is not administratively feasible to change the pay scales of various categories of employees in CCAS cadre as the existing pay scales are at par with the employees of other organised Accounting Organizations. Moreover, the matter comes under the preview of Ministry of Finance, Department of Expenditure. However Association may submit a proposal with due justification in this regard so as to enable this office to examine the proposal.
ii)  DoE, M/o Finance has rejected the case regarding grant of grade pay of Rs. 5400/- to AAOs.
iii)The condition of 53 years of age for promotion of Sr. Accountant to AAO under 10 % quota has been removed in the Recruitment Rules for AAOs which has been sent to the DoPT for approval.
iv)The staff side was informed regarding proposal of raising the promotional quota from 10% to 30% for promotion of Sr. Accountant as AAO that such promotional quota exists only in CCAS cadre among the all other organized Accounting Organizations. However the CGA office will look into the matter.

Settlement of the problems on e-payment system.
Staff side pointed out the inherent deficiencies in the system of e-payment and also requested for arranging training facilities to all category of employees involved in e-payment.  Since the Staff have made every effort for the success of the system and made it successful despite due to various problems e.g. lack of training etc. and additional work load involved. The staff side was requested to submit a detailed note on these issues. Further, the staff side was assured that action would be taken to give training to Accountants/Sr. Accountants regarding all accounting software used in CCAS cadre.

Grant of recognition to AICAEA CAT-II and implementation of check-off system as per Government instructions.
The Staff side was informed that CGA office may initiate action for verification of membership of AAOs through “Check-off system” for recognition to AICAEA CAT-II.

Grant of I & II financial upgradation under original ACP Scheme and benefit of III financial Upgradation under new MACP Scheme.
Staff side was asked to submit a proposal in this regard so as to enable this office to examine the matter.

Grant of benefit of II ACP to Sr. Accountant appointed as Accountant on passing departmental competitive examination conducted by SSC.
The staff side was informed that DoPT has rejected the case. However, the official side has agreed to reconsider the case and asked the Association may submit a fresh proposal so as to enable us to examine the matter.

Grant Pay Scale of Rs. 1350-2200 from 01.01.86 to DEOs as has been granted by the Defence Accounts Department as well as in terms of the CAT judgments.
The Official side requested Staff side to submit the proposal in this regard so as to enable us to examine the matter.

Restoration of 5% promotional quota to the post of LDC for GR-D/MTS.
Provisions have been made in CCAS (LDC Group ‘C’ posts) RR, 2010.
Regarding exemption from appearing DCT, CGA stated that a Special Examination may be conducted in respect of those who have exhausted all chances and in order to help them in passing requisite examination, candidates may be imparted specific training.

Settlement of cadre problem in PAO, CRPF arisen after amalgamation of the office in Civil Accounts Organisation.
1) Problem of Group C employees will be looked after by the cadre controlling authority i.e. CCA, MHA. Association may take up the matter with them.
2) All problems relating to Group B officers have been sorted out by the Group B section. The staff side was further informed that the persons who were drawing the grade pay of Rs. 4600/- and working as supervisors prior to their absorption in the Civil Accounts Organization may be considered for promotion as AAO under 10% quota on seniority-cum-fitness basis as per provision laid down in R.R.

Decentralization of CPAO and formation of regional offices to make the very purpose of operation of Pension Accounting Offices effective and conveniently accessible to old aged Pensioners.
CGA has agreed to consider the request of Staff side and asked the Association, may submit a detailed proposal on the matter of decentralization of CPAO.

Adoption of mutually agreed transfer policy for AAO and implementation of the policy transparently. Deportation of all AAOs brought on deputation basis.
Transfers of AAOs are being made in transparent manner as per CGA’s transfer policy. However, Staff side was asked to submit suggestions in this regard.

Grant of 4 increments on passing DCT between the periods from 01.01.73 to 31.05.83 and 3 increments to others for passing DCT.
The Staff side was informed that matter has been referred to DoPT for clarification/approval.
Staff side requested CGA to kindly intervene personally in to the matter as it has been delayed abnormally. CGA agreed to consider the request.

Provision of amenities to the Central Office of AICAEA.
The Staff side was informed that directions have been issued to CCA, Supply from time to time in this regard. However, CGA office will intervene in the matter so as the repairing work may be completed at the earliest.

As has been done in earlier occasions and granted by Defence Accounts Department, grant of honorarium for checking of pay fixation cases and pension cases after implementation of 6th CPC recommendations.
Association may submit a detailed proposal in this regard so as to enable this office to examine the matter.

Issuing of Gradation Lists of all cadres immediately.
Gradation list of Group B officers have been issued and uploaded on official website. Gradation list of all Group ‘C’ employees have been issued by all Ministries/Departments.
