the staff of PAO (Census), Delhi by the local administration.
Sir,
I have been directed to refer your letter No: -
200/11/Pr. AO/Admn/MHA/13-14/1231 dated 07.08.2014 and state the following:-
1.
The
para 2 of your letter is a biased administrative report. It is clear from your
letter that no fair and independent inquiry was conducted into the facts
reported by the Association vide its letter No:- AICAEA/HQ/C-10/2014/768-771
dated 7th June 2014. It seems form your letter that, you had asked
the administration of PAO (Census), Delhi to give its views on our letter and
on the basis of the misleading reporting’s of the administration of PAO
(Census), Delhi; you have issued us the above mentioned letter. This was not
probably the desire of the CCA, Home and that is why he had visited the office
and interacted with the unit representatives personally after the said letter
was issued by you. Further, the situation reported by us still remains to be
the same and it was reported individually by the unit representatives and employees
to the CCA, Home when he had kindly visited the office and met them. We have
sufficient proof to establish that, the local administration is neither conducive
towards the employees nor providing the required amenities for functioning of
office and in order to cover up the shortcomings, it has been trying to throttle
the voices of the employees representatives or functionaries of the Association
who are raising the issues.
2.
In
response to the para No. 3 of your letter I would like to bring it to your kind
information that the Constitution of India has granted the right to form
Association. Hence, the Government of India has provided the facilities of persuing
Association activities in the offices and introduced JCM (Scheme). There are
several instructions of DOPT and CGA regarding the facilities to be provided for
functioning of service Associations. There is no such orders which states that
the Associations which are formed in a department/office should not function in
office and function somewhere else. Government has also ordered to provide
office Rooms to the Associations within the office premises. Therefore, it is the
duty of the administration to provide all facilities including office of the
Association within the office premises. The local units of the employees
Associations of Ministry of Railway, Ministry of Defence, Income Tax
Department, Civil Accounts, Audit & Accounts, Postal etc have been provided
offices for the Association Rooms within the office premises. I shall
therefore, request you to kindly direct the local administration to provide
suitable accommodation to the PAO (Census) and PAO (B) unit in AGCWM Building
so that the unit Associations could operate their offices.
3.
I
would also like to inform you that the unit Association of PAO (Census), Delhi
had given proper intimation to the local administration for lunch hour meeting on
the dated by you, indication but the local administration had refused to
receive the letter of intimation about the meeting and misled you by conveying
that no information was given by the unit Association about holding of lunch
hour meeting. I shall therefore, request you to ask the local administration to
refrain from giving such misleading informations to the superior authorities in
future and follow the instructions contained in the DOPR (now DOPT) OM. No.
10/4/82-JCA dated 19.10.1983 and CGA OM. No. 11019/47/91-92/MF.CGA(A)/750 dated
11.05.1993 in future.
However, we are very thankful to you for the gesture you
have shown in the 4th para of your letter. This Association shall
also always extend its positive and cordial approach to resolve the issues
amicably through mutual dialogue and understanding.

Sir,
Almost
all the employees and officers of Civil Accounts set up of CBEC, New Delhi were
engaged in election duties during Assembly Elections of Delhi State in 2013 and
Loksabha Elections in 2014.
But
due to non-receipt of the TA/DA by the persons performed election duty, the
issue was raised by the Association as item No. 14 in the official meeting
between the official side and the representatives of the Association on 15th
May 2014 held under the Chairpersonship of Smti. Krishna Tyagi, CCA, CBEC.
It
was decided by the Chairperson that the officials performed election duty shall
be asked to submit their bills to office and the office shall send these bills
to the concerned officer of the Election Commission with the request to certify
and send back the bills to the office.
But
it is five months, your office has not issued any circular asking the concerned
officer and staff to submit their TA claim bills for further necessary action
by your office.
I
therefore, request you that, since there is clear cut instructions of Election
Commission to reimburse the TA/DA of the persons performed election duty, you
may kindly direct your office to do the needful so that poor employees are able
to get their spent money back without any further delay.
For
your kind and early favorable action, this Association shall be thankful to
you.

Sir,
I have been
direct to bring it to your kind information that, from July 2013 onward your
office has stopped deduction of membership subscription of this Association through
check-off-system and remittance of the amount accumulated to the Central
Headquarters of the Association. These actions of your office are violations of
following orders and instructions of the DOPT, CGA and Pr. CCA, CBEC issued in
connection with CCS (RSA) Rules, 1993 –

We have made several attempts to resolve the issue
through mutual dialogue and understanding, but all went in vein.
2. Since the deduction was discontinued
and our requests for restoration of the same were not being given any
cognigence by your office, the issue of deduction of membership subscription
through check-off-system was raised by us in the official meeting held between
the official side and the representatives of this Association on 15th
May 2014 under the Chairpersonship of CCA, CBEC as item No: - 12. In the said
meeting the Chairperson had stated the following –
“Chairperson
informed that the matter will be considered by establishment-I section at the
earliest”
Since the DDO was physically present in the meeting and the
Chairperson had given specific assurance, it was expected that the DDO shall do
the needful. But your office did not honour the assurance given by CCA, CBEC as
a Chairperson of the meeting for last six months. The representatives of the
Association made repeated requests to the DDO to effect deduction of membership
subscription immediately. But, DDO kept on replying that the members were not
interested to get their subscription deducted and they have informed him that
their membership subscription may not be deducted. After cross checking the
fact from the members when our unit and Branch representatives requested DDO to
provide the details of the individuals refused to subscribe to Association, DDO
took the position that the information was secret and he was not in a position
to divulge it to the Association. It shows that the DDO is not at all aware of
the rules and regulations of the Government of India and he is acting against
DOPT OM. No. 2/10/80-JCA dated 31st January 1994. According to this
order, DDO at his own discretion cannot discontinue deduction of membership
subscription and it is implied that he is liable to inform the authorized
person of the Association if any member wishes to withdraw his/her membership
from the Association before stopping the deduction.
3. Due to the above situations and
inaction of DDO, representatives of the Association had once again met and
requested the CCA, CBEC to kindly direct the officer concerned to ensure
deduction and remittance of membership subscription. But, the action taken by
the CCA is not known to us. Further, the representatives of the Association
once again requested DDO to effect the deduction of membership. After a long
discussion, he insisted that he should be requested in writing by the
Association for deduction of membership subscription of the employees. Though
the position taken by him was not in conformity with provisions and procedures
prescribed by the higher authorities, but to resolve the problem in a peaceful
manner, the Association vide its letter No:- AICAEA/HQ/C-10/2014/1214-1218
dated 01.09.2014 requested DDO to deduct and remit the membership subscription.
But, till date DDO has not taken any action on this matter. However, on
inquiring from your office, when it could be learnt that subscription had been
deducted for September 2014 from a few persons, the DDO was tried to be
contracted. But he was not available. However, two cheques were handed over to
the undersigned containing a very meager amount and without any details.
Sir, from April 2013 onwards your office is not deducting
membership subscription. Within last 17(seventeen) months subscription for the
month of May 2013 only was deducted and remitted to us. So far as the month of September
2014 is concerned, we have received cheque of a meager amount without any
deduction details and the amount of the cheque itself indicates that, deduction
was done in a truncated form only to create an impression that the deductions of
subscription have been made.
Now, a new plea has been taken by your office that the
subscription shall not be deducted and remitted to Association other than
e-payment system. The position taken by your office is against the orders in operation.
As per the instructions of CGA, the subscription should be remitted to
Association through ‘A’ cheque. There is no order that the membership
subscription shall not be handed over to the Association if it does not accept
e-payment. In fact, the Association is receiving hundreds of cheques from
different PAO/ZAOs of the country coming in the form of membership
subscription.
Your kind self is aware that the Secretary General of the
Association is working full time in the Association on foreign terms and his
salary is being drawn by the Association from the membership subscription. As
your office has not been remitting the due membership subscription deliberately
for nearly seventeen months, the Association has been facing acute financial
crisis. The Association is finding
extreme difficulty to run its day to day expenditure and unable to bear the
burden of expenditure involved in payment of the salary of the Secretary
General.
The Association therefore, seeks your personal
intervention into the matter. We request you to kindly direct your office to
arrange for clearing due arrears subscription and ensure regular remittance of
subscription to this Association and All India Civil Accounts Employees
Association category – II.
We hope you will kindly take early favorable action on
our request.

Subject: Filling up the post of AAO
and Accountants –Reg.
Sir,
While
the undersigned alongwith the President Shri K. Venkata Subramanian visited Bangalore on 13th & 14th
October, 2014, the Karnataka Branch of our Association had brought it to our
knowledge that the PAO, CBEC, Bangalore has sanctioned strength of FOUR
Assistant Accounts Officers out of which 1 AAO post was diverted to CBEC,
Chennai. One AAO had retired on superannuation w.e.f. 31.03.2014 AN. One more
AAO was promoted as PAO and posted to PAO, GSI. With this only one AAO is
working in PAO, CBEC, Bangalore against sanctioned strength of FOUR. Further,
the only one AAO working in PAO, CBEC, Bangalore has been promoted as PAO and
posted to PAO, CEA office and only relieving order is awaited from Pr. CCA, CBEC,
New Delhi. On her relive the PAO, CBEC, Bangalore would not have any AAO.
Further,
two posts of Accountant/Senior Accountant are vacant in PAO, CBEC, Bangalore
for more than six months. Due to shortage of Staff, the available members are
suffering from increased work load.
You
are therefore, requested kindly to take early necessary action to fill up the
vacant posts in your office at Bangalore at the earliest.

Subject:- Resentment
against irregular transfer – regarding.
Sir,
I have been
directed to draw your kind attention to the Resolution dated 15th
October 2014 passed and forwarded by the West Bengal Branch of this Association
and state that the local administration of Kolkata has transferred two Data
Entry Operators from PAO, Revenue to PAO, Customs Kolkata without assigning any
reason as no work from PAO, Revenue to PAO, Customs was shifted. In fact the
PAO, Revenue was created for specific purpose and all Revenue related works had
been shifted to PAO, Revenue from other PAOs in all stations including Kolkata.
There is no Data Entry job in PAOs of Customs. But, two DEOs have been
transferred by the local administration while their posts have been retained in
PAO, Revenue itself. Moreover, one of the official is the Unit Secretary of
PAO, Revenue unit of this Association and as per the DOPT/Government
instructions the Chief Executives should not be transferred to another office.
It is evident
from the action of local administration of Kolkata that, transfer have been
done vindictively as this type of action has not been done by the local
administration of Mumbai and Chennai.
Therefore, the
above transfers being irregular we request you to kindly intervene into the
matter and render justice to the officials transferred vindictively.
