 A.I.C.A.E.A. LETTER TO PR. CCA, CBEC IN RESPONSE TO HIS OFFICE LETTER DATED 25TH MARCH 2015

Sub:     Settlement of the 20 Point Charter of Demands concerning with the employees working under the setup of Pr. CCA, CBEC including the issue declaring the DEOs as surplus.

Sir,

When a delegation of this Association comprising Shri V. Bhattacharjee, Secretary General, Shri N.K. Sharma, Finance Secretary and Shri S.C. Bamrara, Asstt. Secretary General had met the CCA, CBEC on 15th January 2015 in her chamber in presence of other officers and unit President of AICAEA, CBEC Unit, Delhi and kindly requested her to settle the long pending concerning with employees of Principal Accounts office and Pay and Accounts Offices of CBEC setup, the CCA, CBEC in turn,  had directed the Association to make a fresh request to your good-self for convening meeting with the National Executives of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category-II.
Responding to the directions of CCA, CBEC, a letter vide No. : AICAEA/HQ/A-3/2015/52-55 dated 21.01.2015 (Copy enclosed as ANNEXURE -A) was submitted, enclosing the agenda items, with the request of convening a meeting with the National Executives of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category II.

But your office ignored the letter and only when the Branches of the Associations all over the country had once again resorted to protest action in the form of a daylong Dharna on 11th February 2015 in protest of the non- settlement of 20 point demands of the Association including scraping your unilateral decision to declare the Data Entry Operators as surplus, your office served a letter in the evening hours of the day vide letter No. APAR Cell/1(10)3/Association/2014-15/441 dated 11-02-2015 (Copy enclosed as ANNEXURE -B) conveying the Associations that a meeting shall be convened by the Official side on 12-02-2015 at 3.pm.

As it was not humanly feasible on the part of the National Executive members of the Associations to reach Delhi on 12th February 2015 within twenty four hours from different corners of the Country, the available office bearers of the Associations immediately called on the Sr. AO, (Estt.) of your office who was the signatory of the letter. He was explained about the aforesaid technical difficulties of the Association and it was proposed that, since the National Executive members of the Associations shall reach Delhi on 25th of February 2015 to attend the National Executive meeting of the Associations slated to be held on 25th and 26th February 2015, the meeting might be fixed on 25th February. Responding to our proposal positively, concerned Sr. AO went and discussed the matter with the competent authority and on his return informed the said representatives  that it was agreed and the Association may therefore send a letter in confirmation of its verbal proposal.

Based on the above fact, we immediately made the request for fixing the meeting on 25th February 2015 vide our letter No.AICAEA/HQ/A-3/2015/95 dated11.02.2015 (Copy enclosed as ANNEXURE-C).

But to the utter surprise of all, your office vide letter No. Admn. /1(10)3/Association/1514 dated 23rd February 2015 (Copy enclosed as ANNEXURE -D) informed Association that the meeting has been fixed on 10th April 2015.  The letter was issued by your office in such a time when majority of our out station National Executive members had boarded the Train and many of them had already covered a long distance towards Delhi.  But being very responsible in its approach, the Association also requested you very humbly, through its letter No. AICAEA/HQ/A-3/2015/100 dated 24.02.2015(Copy enclosed as ANNEXURE -E)  to kindly fix the meeting on a convenient date before 15th March 2015 for discussion and early settlement of the long pending issues of the employees.  But no response was there from the end of the authorities. Inspite of this, the Association made its sincere   attempt of discussion with the Sr. AO (Admin.)  on 25th of February also, inquiring about the modification in the date as requested by us. But he tried to evade any discussion.

When it was observed that your Administration was neither serious in its approach nor inclined to discuss with the National Executive Members of the Associations for the settlement of the Demands, obviously, such a callous attitude on the part of your administration had precipitated the resentment of the employees throughout the country and the Federal Executive Members of the National Federation of Civil Accounts Associations and office bearers of the Branches of Delhi  were constrained to take the decision to sit for Dharna in front of your office on 25th February 2015 in protest of your decision to postpone the date of the meeting from 25th February to 10th April 2015 and on  the demand of settlement of long pending 20 point Charter of Demands and also  in protest of the issue of  declaring the DEOs as surplus.

However, 26th March, 2015 your administration telephonically informed the undersigned that our request for preponing the date of meeting was not accepted by the authority and it has been again decided unilaterally to convene the meeting on 10th April 2015. Subsequently a letter dated 25th March 2015 has been emailed to the Association on the same day at 5.59 pm confirming your decision to convene the meeting on that date itself.

After considering the above discussed developments, the Association has directed me to inform you
that the Association is not averse to mutual dialogue. But such dialogue should be on a mutually agreed convenient date so that the official side is able to concentrate on the issues and National Executive Members of the Associations, from various stations, are able to attend the meeting.

We assumed that you would kindly consider our request for preponing of date and fix the meeting within 31st March 2015. But in the absence of any communication from your end till 26th March 2015, organizational travel plans were framed out for the National Executive members in connection with the call of the Joint Council of Action of The Central Government Employees towards “March To Parliament On 28th April 2015” for settlement of 7th CPC related demands and the demands like Merger of DA etc which embrace all sections of the Central Govt. Employees and Officers. So, due to pre-occupied organizational work, it is not possible for them to make themselves available at New Delhi on 10th April 2015. Therefore, under the above circumstance we request you to convene the meeting on another mutually agreed date in the month of April 2015 itself.

I am also directed to state that, it is also essential to create conducive atmosphere for mutual dialogue and hence you may kindly direct your administration to-

1.      Withdraw all orders issued threatening the employees that their participation in peaceful meetings of the Association even during lunch hour shall make them liable for disciplinary actions.

2.      Comply with the directive of the Controller General of Accounts and also as per Government of India norm, issue the open pass to the Secretary General of the Association who is a member of the Departmental Council (JCM).

I am further directed to request you that, as per JCM norm travelling allowance may be granted to the National Executive Members who shall attend the meeting from the stations other than Delhi.
