Subject:- Verification of membership strength of “All India Civil Accounts Employees Association Category II” under Central Civil Service (Recognition of Service Association) Rules, 1993.

Sir,
            I have been directed to refer the OM No. A-60015/1/2016/MF.CGA (A)/NGE/AICAEA-II/572 dated 14.09.2017 of your office in which it has been ordered that, since some of the offices have sent the details of members of All India Civil Accounts Gr-B, Gazetted (AAOs) Association as members of All India Civil Accounts Employees Association Category II, Principal Accounts Offices should review the information submitted to the CGA office in this regard.
            In this respect we would like draw your kind attention to the following:-
1.                 As per the procedure prescribed under CCS (RSA) Rules 1993, membership re-verification should be done for those categories together where none of the Associations could muster the minimum required percentage i.e. 35%  membership and verification was done earlier. In fact, the membership verification of the AICAEA Cat-II which represents the AAOs was done in 2015 had mustered only 27% percent membership.  Hence it was not granted recognition by your office. But subsequently, the All India Civil Accounts Gr-B Gazetted (AAOs) Association had applied for recognition and ignoring the procedure prescribed by DOPT, its membership verification was done separately denying the opportunity to All India Civil Accounts Employees Association Category II to take part in the re-verification process. Further, the All India Civil Accounts Gr-B Gazetted (AAOs) Association had been granted recognition by your office but the All India Civil Accounts Employees Association Category II, despite having 27% membership was denied recognition and ordered to undergo re-verification which is totally against the spirit of the procedure prescribed by the DOPT through the CCS (RSA) Rules 1993.

2.                 It is beyond doubt that the All India Civil Accounts Gr-B Gazetted (AAOs) Association had reached to the strength of 35% membership by incorporating the numbers of All India Civil Accounts Employees Association Category-II as the All India Civil Accounts Employees Association Category II was denied to participate in the re-verification process.

3.                 As per CCS (RSA) Rules 1993, members of a particular Association is free to change their options in between April and July of a particular year and migrate to another Association of same category. Since your office had ordered for re-verification of membership of the All India Civil Accounts Employees Association Category II vide your OM. No. 60015/1/2016/MF.CGA (A)/AICAEA-II/64 dated 25th April 2017,  some of the members have rightly and legally taken the approach of migrating to All India Civil Accounts Employees Association Category II.
            The contents of the para 2 of the above referred OM No. A-60015/1/2016/MF.CGA (A)/NGE/AICAEA-II/572 dated 14.09.2017 issued by your office is thus against the provisions of CCS (RSA) Rules 1993 and interruption to the membership verification process.
            Therefore, on behalf of this Association I request you to kindly direct your office to withdraw the said OM dated 14.09.2017 and allow employees of the category to exercise their options for membership to Association of their choice.
