Subject:- Acceptance of 7th CPC recommendations on enhancement of qualification pay-request for issuance of orders regarding.

Sir,

            The Government of India had referred the recommendations of 7CPC on allowances to the “Committee on Allowances” vide Resolution No:- 1-2/2016-IC, dated 25th July 2016. The said committee submitted its report on 27th April, 2017. The Government has accepted the report submitted by the committee and ordered for their implementation vide extra ordinary “Gazette of India” No:- 169 dated 6th July, 2017.

            According to the item No:- 135 of Annexure-II of the Gazette Notification, the qualification pay has been retained and enhanced by a factor of 2.25. Relevant pages of the Notification are enclosed herewith for your ready reference.

            The qualification pay is being granted to Accountant & Senior Accountant of Civil Accounts Organization after they qualify the Departmental Confirmatory Test.

            It is therefore, requested that necessary orders for payment of “Qualification Pay” to Acctt./Sr. Acctt. at the enhanced rate with effect from 1st July, 2017 (as ordered by the Government) may kindly be issued at the earliest.

Subject:-  Promotion of 12th Class Pass Group ‘C’ (Multi-Tasking Staff) as LDC on the basis of Limited Departmental Qualifying Examination 2017 under Rule 5(3) of CCAS (Lower Division Clerk Group ‘C’ Post) Recruitment Rules, 2010 – request for removal of discrimination in counting of seniority for posting regarding.

In continuation of our letter No:- AICAEA/HQ/A-2/2017/1222-1224 dated 23.12.2017  on the above mentioned subject, we would like to invite your kind attention to following points few lines:-

1.     As per the provisions laid down in the Recruitment Rules for all cadres of Civil Accounts Organization, seniority for the purpose of promotion is maintained by the Controller General of Accounts.
2.     The purpose maintaining the seniority list by the Controller General of Accounts is for granting promotion on seniority basis. Senior most person of a particular Ministry/Department irrespective of his station of posting is to be granted promotion before his junior and in the event of availability of promotional vacancy in his own Ministry/Department he is to be adjusted first.
3.     There is no such provision under which the cadre controlling authorities are having the discretion to regulate the vacancies in different PAOs on roaster points.

In our above mentioned letter, we have cited the example of the office of the Chief Controller of Accounts, Ministry of Commerce where the junior working in Pr. Accounts Office, New Delhi has been adjusted against the vacancy available in the Ministry and his senior working in PAO, Textiles, Mumbai has been denied his legitimate claim. Before, your office had issued the posting orders of the MTS qualified the Departmental competitive examination 2017, the PAO, Ministry of Textiles vide letter No:- PAO/TEXT/MUM/ADMN/2003 dated 16.11.2017 had informed the office of the Chief Controller of Accounts, Ministry of Commerce that, since there was a vacancy of LDC in the office and one of the MTS Shri D.A. Shemadkar has qualified the examination may be promoted and accommodated in the same office (copy enclosed as Annexure-A). Therefore, it is a legitimate claim of Shri Shemadkar that he is to be adjusted in his original Ministry.

Another example of deprivation of senior person has been brought to our notice by the Allahabad Branch of our Association in which Shri Abhimanyu Kumar, MTS working in PAO, Central Excise, Allahabad has been posted on promotion as LDC to PAO, I&B, Lucknow while his junior Shri Arvind Kumar, MTS has been promoted as LDC and retained in PAO, CBEC, Allahabad itself. Shri Abhimanyu Kumar had reported as MTS in PAO, Central Excise, Allahabad on 9th April 2012 while Shri Arvind Kumar had join service as MTS on 12th April 2012 in the said office. In fact, Shri Abhimanyu Kumar had requested for consideration of his posting to Patna (his home town). But he has been posted to Lucknow which is more far from Patna in comparison to Allahabad. Therefore, Shri Abhimanyu is facing severe discrimination. (Copies of the relevant documents are enclosed herewith as Annexure-B-I, B-II, B-III and B-IV respectively).

This Association therefore, requests you to kindly examine the examples cited above and provide justice to the individuals by upholding sanctity of the policy of seniority for the purpose promotion.

Subject:- Vacation of office space at 16-A, Akbar Road Hutments, New Delhi and provision of alternative accommodation to All India Civil Accounts Employees Association (Recognized by Government of India) for the purpose of functioning of its office.

Sir,

            I have been directed to refer this Association’s letter No:- AICAEA/HQ/A-35/2017/1115-34 dated 10.11.2017 on the above mentioned subject (copy enclosed). It was brought to your kind information vide our above letter that the Chief Controller of Accounts, Ministry of Commerce, vide letter No:- PAO/MOCT/Staff Strength/DGS&D/1140-1143 dated 09.11.2017 had asked our Association to vacate the office space at 16-A, Akbar Road, Hutments, New Delhi by 13th November, 2017 failing which the office of CCA, Commerce and Textiles will not be responsible for any loss or damage to the property of the office of the Association.

            We had accordingly, requested you to kindly provide us an alternative accommodation at the earliest. Along with our request we had also informed about the sparable accommodations available with some of the Heads of Civil Accounts Organizations. Thankfully enough, your office had kindly requested the Pr. CCA, Ministry of Shipping, Road Transport & Highways, Pr. CCA, Ministry of Home Affairs and CCA, Ministry of Housing & Urban Affairs to provide accommodation to the All India Civil Accounts Employees Association for the purpose of functioning of its office.

            However, the accommodation is yet to be provided to us.

            We have now learnt that, as soon as the office of CCA, Ministry of Agriculture is shifted to the new accommodation in Jeevan Tara Building, New Delhi all structures of 16-A, Akbar Road Hutments Complex shall be demolished and thus the documents and other properties of the Association shall also be destroyed during demolition process as it is not in a position to shift its documents and furniture’s to any other accommodation.

            I therefore, request you to kindly appreciate the gravity of the situation and provide us an alternative accommodation without any further delay.

            We would also like to submit that, the accommodation for the purpose of the use of our office was officially provided to us by the Controller General of Accounts in 2007 as we are entitled to official accommodation in terms of Directorate of Estates OM No:- 18011 (6)/68-Pol (I) dated 25.04.1969 (copy enclosed).

            I have been direct to refer your office letter No:- A.12034/6/2016/MF.CGA (A)/NGE/583 dated 11th January, 2018 and invite your kind attention to this Associations letter No:- AICAEA/HQ/A-2/2018/13-17 dated 12.01.2018.

            In this connection, we would like to submit the following few lines for your kind perusal:-

1.     The office of Controller General of Accounts maintains the seniority of all cadres for the purpose of promotion and allocates the posting of the persons on the basis of their seniority.
2.     So far as Ministry of Commerce is concerned vacancies in the grade of LDCs were available both in Delhi and Mumbai. The PAO, Commerce, Mumbai vide her letter No:- PAO/TEXT/MUM/ADMN/2003 dated 16.11.2017 had informed about the vacancy position of her office to the administration of  the Principal Accounts office, Ministry of Commerce, New Delhi and requested them for  accommodating the available Departmental Examination qualified candidate as LDC in her Office itself.
3.     As there was only one vacant post under promotion quota in Ministry of Commerce and the senior most qualified candidate was available in Mumbai, the official should have been promoted and posted against the promotional post as there is vacancy in Mumbai and he is working in the said office at present. But, it seems that the administration of Ministry of Commerce did not bring the fact of availability of vacancy and qualified candidate in Mumbai to the information of your office. As a result of this, order of seniority in promotion has been disturbed. In fact the junior in the Ministry has been given preference and granted promotion first while the senior has been denied his legitimate right.
            Therefore, the matter is a serious injustice and we urge upon you to kindly intervene and undo the injustice.

            For your kind favorable action this Association shall be highly thankful to you.
