Subject: Implementation of CAT, Ernakulam Judgment on the issue of payment of arrears for the period from 01.01.1996 to 18.02.2013 arising due to upgradation of pay scale of Accountant/Auditor/Sr. Accountant/Sr. Auditor onwards – reg.

Sir,

            We may inform you that, the Units and Branches of constituents of this Joint Action Committee (JAC) have staged a Day Long Dharna jointly under the banner of local JAC on 26^th March 2014 and adopted  resolutions demanding that at the direction of CAT, Ernakulam Bench, all Senior Accountants Auditors of both IA & AD as also other organized Accounts may be granted effective upgradation of the pay scale from Rs:- 5000-8000 to 5500-9000 with effect from 01.01.1996 and the arrears of fixation in the higher pay scale for the period from 01.01.1996 to 18.02.2003 may also be paid to them as the Sr. Accountants/Auditors are the same posts as Junior Accounts Assistants in Railways who were the petitioner in the CAT, Ernakulam case and therefore, both are similarly circumstanced. This Judgement which has been upheld by Supreme Court as well may be treated as a Judgement in ram in respect of Sr. Auditors/Senior Accountants and Junior Accounts Assistants in Railways.

            We therefore, urge upon you kindly to amend your OM F. No. 6/82/E-III(B)/91 dated 28.02.2003 and instead of notional upgradation of the pay scale (Rs. 5500-9000) from the period from 01.01.1996 to 18.02.2003, it may be made effective upgradation w.e.f. 01.01.1996 and also order for payment of arrears arising as a result of this modification.

We hope that the necessary orders will be issued to avert further intensification of mass agitations by the concerned employees.

            We also request you to kindly initiate meaningful dialogue for resolution of item 28 of National Anomaly Committee and Settlement of following items –

1.      i) Upgradation of LDC as Accounts/Audit Assistant and merger of Accountant/ Auditor and Senior Accountant/Auditor.

ii) Granting following pay scales to Accounts & Audit Cadres

                                                Accounts/ Audit Asstt - GP 2400. PB 1

                                                SA/PA                          - GP 4600, PB2

                                                AAO/Sr.PA                  - GP 5400, PB2

                                                AO                               - GP 6600, PB3

                                                SAO                             - GP 7600, PB4

iii) Granting MACP on departmental hierarchy basis

iv) Granting one increment and Grade pay of Rs: - 5400 from the day of passing AAO/SOG examination

  v) Granting three increments on passing departmental confirmatory examination.
