Dear Comrades, 
Most urgent 
PAO, CGST, NEW DELHI IS INTENTIONALLY HARASSING THE SG, NFCAA:
WITHHELD PENSION VIOLATING THE PROVISION OF CCS (PENSION) RULES, 1972:
HIGHER AUTHORITIES ARE PLAYING FROM THE GALLERY.  

ORGANISE BRANCH AND UNIT WISE PROTEST MEETINGS, DEMONSTRATIONS AND BLACK BADGE WEARINGS ETC.
You are aware that the demand No. 5 of the Charter of Demands on which we had observed protest day on 25th June 2020 is ” Stoppage of routine practice of harassments to representatives of the Associations by the CBEC authorities and their PAOs in the form of withholding of 1. Pensions in violation of Rules, 2. Financial upgradation and 3. personal claims etc. This demand was composed on the ground that :-
1.  The PAO, CBIC, Madurai had withheld the pension of ex-President of AICAEA for two months who had retired in April, 2017.
And
2.    Now the PAO, CGST, Delhi is intentionally (a) not doing correct pay fixation against 3RD MACPS (b) Withheld monthly pension/ pensionary benefits and (c) not paying medical reimbursement claims etc . of   the  ex- Secretary General of AICAEA as well as the existing Secretary General of NFCAA for more than 4(four) months now.   
Apart from submission of eight representations by the retiree, Com. V. Bhattacharjee with copies to PCCA, and CCA, CBIC and holding country wide protest demonstration on 25th June 2020 by the Branches and Units of AICAEA  and AICAEA CAT II  jointly, central headquarters of   AICAEA & AICAEA CAT-II jointly wrote letter to CGA and Pr.CCA, CBIC, New Delhi vide letter No. AICAEA-AICAEA CAT II/HQ/A-2/2020/ 1449-50 dated 01-07-2020 demanding early settlement of the issue and initiation of departmental action  against the persons responsible for the inordinate delay.
Further, a delegation comprising Com. Krishna K Yadav, Secretary General, Com. Dharampal Singh, Asstt. Secretary General, Ã€ICAEA, Com.  P. K. Bhagat, Vice President and Com. Animesh, Asstt. Secretary, AICAEA Delhi Branch had visited the PAO, CGST, New Delhi on 3rd July 2020 to meet the HOO who by making mockery of CCS, pension Rules 1972 has withheld the pensionary benefits of SG, NFCAA for the last four month. 
Due to absence of AOs and AAOs from the office on the plea of roster duty, no discussion could be done there. However, from interaction of the delegation with the available staff members of the office, it could be assessed that totality of them are highly aggrieved   with the  attitude of the AO concerned with regard to pay fixation and pension of SG, NFCAA. In anonymity they expressed that they are not able to come up openly due to the terror let loose by the AO who is the HOO and unfortunately, the higher ups are playing from the gallery. 
Dear Comrades, the manner in which the pension of our SG, NFCAA has been withheld by the PAO, CGST, New Delhi is the gross violation of the provisions of the Rule 59 of the CCS (Pension) Rules, 1972.
Since the anger precipitated among the members across the country over the incident has been conveyed to us by our Branches, we have decided the following action to be taken immediately:-
1.  Since the SG,AIAPAO (Civil) didn't reply to the earlier letter of NFCAA issued in March this year, an open letter to SG, AIAPAO(Civil) shall be issued seeking the intervention of his Association. 
2.  The leaders at headquarters shall attempt for negotiations with the authorities and shall also organise protest actions from 6th July 20 onwards.
3.  All Branches shall issue letters jointly through emails the CGA and PCCA, CBIC immediately (Draft letter annexed). The email addresses of the officers concerned are given below.

4.   After Issuing of letters by the Branches, the units shall be guided to issue similar letters to same email addresses.
5.   All members shall observe Continuous Black Badge wearing programme: Black badges may be supplied by the Branches and requested the members to wear the Badges daily while on duty.
6.   All Branches should also organise area / floor meetings and centralised meetings along with ongoing activities of issuing letters and Black badge wearing. 
A  leaflet detailed report about withholding of pension and pay fixation case etc. of the Secy. General, NFCAA by the Sr. AO, PAO, CGST, New Delhi  shall follow this circular for circulation among the members by the Branches

Subject:-  Harassment – Non-finalising the pension case for three months in violation of CCS(Pension) Rules 1959 of ex-Secretary General, AICAEA  by raising piecemeal objections on the already settled old pay fixations in violation of Govt. orders 

Madam,

            We are very much shocked to learn that the PAO, CGST, New Delhi is harassing the ex-Secretary General of the All India Civil Accounts intentionally by not paying his pension for the last 3(three) months without any valid reason. She has unsettled the already settled pay fixation cases of which are more than 20 years old which in fact do not fall under her purview as per the provisions of various relevant clauses of the Rule 59 of the CCS(Pension) Rules 1972 and that too by infusing unrelated Government orders. 
Moreover, discontinuing the Qualification Pay of incumbent retiree abruptly and arbitrarily on the pretext of re-fixing the pay retrospectively and by challenging the standing orders of the Ministry of Finance as well as the Controller General of Accounts are the clear indications of vindictive attitude on the part of Sr. AO, PAO, CGST, New Delhi. 
The Associations record its vehement protest against the deplore the actions of the Sr. AO, PAO, CGST, New Delhi for her disregardful and retrograde outlook towards her official duties and responsibilities and her innate inhuman attitude towards the elderlies and senior citizens.
Our members are very much enraged after learning the fact as this undue delay in payment of pension and pensionary benefits of their former Secretary General have violated the basic human rights of a senior citizen who worked for more than 35 years and who is starving just because of the adamant stand of a Sr. AO, who doesn't care for retired persons and unsettled already settled pay fixations with the ulterior motive causing harm to an individual. 
The Associations therefore, urge upon you to kindly intervene personally and ensure release of pension and pensionary benefits of Shri V. Bhattacharjee, former Secretary General, AICAEA with correct pay fixations at the earliest. 
The Associations further request you to initiate appropriate departmental action against the errant officer concerned for dereliction of duty on one pretext or the other.
